  1. so. why not marry and apply for spouse visa it takes about the same timeframe to get to interview
  2. https://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter1-5.html If you pose as a tourist (whether with a visa or on the VWP) with the secret intention of staying in the United States for an indefinite time, you will have committed visa fraud. Visitor visas, or indeed any temporary visas, are for people who intend to stay temporarily—and then leave. They are not for people who plan to marry and live happily ever after in the United States. If U.S. Citizenship and Immigration Services (USCIS) chooses to make an issue of it, your misuse of a tourist visa could lead to your losing the right to obtain not only a marriage-based green card, but most other types of U.S. visas. WE would have all done this if it was legal/its not
  3. u state u are not in the US from Nolo law https://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter1-5.html If you pose as a tourist (whether with a visa or on the VWP) with the secret intention of staying in the United States for an indefinite time, you will have committed visa fraud. 4. Notice of interview for a spouse visa goes to the USC and is scheduled by NVC and embassy not the beneficary
  5. marry while u are there and apply online from Europe/that starts the process not fast nor easy nor cheap
  6. there is no quicker way there is only 1 way you file a I 130 for the spouse visa/ its anywhere from 18 to 24 months to the interview so study the USCIS guide for the process OR the guides at the top of this page
  7. you can always apply but the wait time for tourist visa in Amsterdam is 192 days so u would not be able to have one for December Interview Required Visitors (B1/B2) 192 Calendar Days https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/wait-times.html
  8. CEAC does not post information on visa till the case is at the 2nd (NVC stage) AT this point u would use USCIS site (if u have the recipt and know the case # https://www.usa.gov/immigration-case-status
  9. Withdrawal. An applicant or petitioner may withdraw a benefit request at any time until a decision is issued by USCIS or, in the case of an approved petition, until the person is admitted or granted adjustment or change of status, based on the petition. However, a withdrawal may not be retracted. This is for protection of the bene that USCIS can not properly ID https://www.ecfr.gov/current/title-8/chapter-I/subchapter-B/part-103
  10. yes, IRS site under FILING STATUS AND DEPENDENTS #2 for dhildren https://www.irs.gov/individuals/international-taxpayers/frequently-asked-questions-about-international-individual-tax-matters#:~:text=In general%2C you can claim Children usually are citizens or residents of the same country as their parents. If you were a U.S. citizen when your child was born, your child generally is a U.S. citizen. This is true even if the child's other parent is a nonresident alien, the child was born in a foreign country, and the child lives abroad with the other parent. You must include on your return the Social Security number (SSN) of each dependent. If your dependent is a nonresident alien who is not eligible to get a Social Security number, you must list the dependent's individual taxpayer identification number (ITIN) instead of an SSN.
  11. https://www.uscis.gov/green-card/green-card-eligibility/widower To obtain a Green Card, you need to file Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, with all required documents as listed in the form instructions. If your spouse filed Form I-130, Petition for Alien Relative, before his or her death, we will consider the petition as if you had filed an I-360. Your unmarried children under the age of 21 (known as “derivatives”) may be included on your immigration petition. As “immediate relatives,” your derivative children are granted benefits of the Child Status Protection Act, which “freezes” their ages as of the date of the principal’s filing of Form I-130 or I-360, whichever is applicable. This provision prevents them from aging-out if they turn 21 prior to adjudication of their adjustment-of-status or visa application. They must, however, continue to meet any other additional filing requirements. For more information, see our page on the Child Status Protection Act.
  12. yes, u r as visa is still valid the big issue is that week is Thanksgiving week here in the US with the most traveler's by plane than any other week including the following weekend And therefore the costs skyrocket check the prices for that week against the week before i can not find a city in Mississippi called Arizona so i have no idea what airport u would be using
  13. if u have not submitted all the supporting documents for the ds 260 and/or I 864, u can delay the process for up to a year at the NVC step this can allow the son's I 130 to catch up u should notify NVC by email or snail mail once a month to keep wife's case open during this time and include the information about the son
  14. Great to hear but why they left the world's busiest airport off the list of airports that handle this seems to be another government error among all the others Is Atlanta International airport the busiest? Hartsfield-Jackson International has once again been declared the world's busiest airport, according to an official ranking. The Atlanta airport with 93.7 million passengers passing through in 2022 had more traffic than any other airport in the world, according to industry group Airports Council International World.Apr 5, 2023
  15. there is no way to tell but if i were u , i would hit the word portal above to go to Moroc site and read some timelines of those K1 that are either interviewed or been scheduled and get your supporting documents together best to send the I 134 and IRS transcripts plus proof of US residency ASAP and be ready
  16. only USC can cancel but u can stop it by not going to interview To be fair to the USC , tell the person Sorry it did not work out for u
  17. First of all, make sure this is what u want to do and if u have decided completely, do not attend the interview But understand many cancel a K1 petition for various reasons like a disagreement members have done this and then asked, "can i reinstate my k1 pettion after cancelling it?" and NO u can't , u would have to start from scratch
  18. he may have never heard of it, but it is needed (in Arabic and the English translation) if he is missing any of the documents for the interview , he will receive a 221 g -means he needs to send them to the embassy and is in AP (refused while the embassy waits for documents) AP delays are lengthy The following tells about the "fiche " https://www.wikiprocedure.com/index.php/Morocco_-_Obtain_Police_Clearance_Certificate_(Criminal_Record)#:~:text=You can get a certificate at a Moroccan embassy or,de la Mamounia in Rabat.
  19. unforuntely we choose to meet and marry foreigner and must face long wait times for any action the best u can do is forget the process unless u receive a RFE and need to respond otherwise , when u chat ,this is the normal time for dating and getting to know each other Gather your patience and do not dwell on immigration if doing the K1 is strssful, the AOS is twice as bad so prepare check the following site to see if your case will prompt any red flag issues Best to u both https://www.nolo.com/legal-encyclopedia/red-flags-that-make-uscis-suspect-marriage-fraud.html
  20. nurses are needed in Canada and the US Why not apply for jobs, then work permit if u apply tourist visa, and are honest about looking for work , the CO should deny or if u get the tourist visa and come with all your paperwork to stay and work, border patrol can deny entry as that's the wrong visa to work
  21. u need confirmation page for the ds 160 when NVC sends case to casa, u will schedule the interview online Embassy should send a check list of needed documents and instructions for getting them translated to English meanwhile complete an I 134 and get your latest IRS tax transcripts and send to Moroccan I believe Casa still collects the fee (others will chime if , if wrong) Moroccan needs 2 police reports a "fiche anthropomtrique" at the local police office. and des casiers judiciaires
  22. u do not need US work visa to work abroad for a US company the US company would need to follow the rules the company needs to set up a legal entity to do business in the country Yes, you can hire a foreign employee, but the process is not as straightforward as putting them on your payroll and cutting a check each month. While some companies opt to set up a legal entity in a different country to hire foreign employees, entity establishment is costly and time-consuming. Fortunately, there are other options to pursue employment without establishment. 0R hire out thru subcontracting companies Rather than setting up a legal entity, companies can engage contractors or partner with an employer of record (EOR) to hire employees and avoid the risk of noncompliance.
