that is the form u will use (much later in the process-the NVC stage, u will do the I 864) study guides above will help u with the process if u do not file tax returns , request a letter from IRS to say "no tax returns filed" Download IRS Form 4506-T. Complete lines 1 – 4, following the instructions on page 2 of the form. Line 3: enter the non-filer's street address and zip or postal code. ... Line 5 provides non-filers with the option to have their IRS Verification of Non-filing Letter mailed directly to a third party by the IRS.

Filing the tax forms -just follow the IRS site for MFJ or MFS on the IRS site for non resident alien spouse Tax treaty with UK so no taxes owed keep a paper copy of the 1040 and all documents u provide as u probably will not have the IRS transcripts in time https://www.irs.gov/individuals/international-taxpayers/nonresident-spouse At this point the IRS will not be fast to process forms as IRS says https://www.irs.gov/newsroom/irs-operations-status-of-mission-critical-functions#:~:text=We're processing tax returns,we continue to experience delays. We're processing tax returns, payments, refunds and correspondence. However, we continue to experience delays. We are working hard to get through the inventory. the following IRS site has all the information u need on foreign income including the 2555 form for the exclusion https://www.irs.gov/individuals/international-taxpayers/frequently-asked-questions-about-international-individual-tax-matters#:~:text=Do I still need to,or foreign income tax credits.

i-485 and DS260
JeanneAdil replied to Cookie88's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
the chances of even getting a tourist visa with a I 130 in the system would be slim and if granted, u would more than likely be turned back by CBP as your I 130 shows immigrant intent It is best to have the USC visit as much as possible to strengthen your spouse visa request If this was legal and possible, we would all have done it, but its not -
Until u receive the Ghana case # from NVC, u need to wait for that ACC # ; then send the email include the new # ,both names and both DOB's

https://www.nolo.com/legal-encyclopedia/free-books/fiance-marriage-visa-book/chapter1-5.html If you pose as a tourist (whether with a visa or on the VWP) with the secret intention of staying in the United States for an indefinite time, you will have committed visa fraud. Visitor visas, or indeed any temporary visas, are for people who intend to stay temporarily—and then leave. They are not for people who plan to marry and live happily ever after in the United States. If U.S. Citizenship and Immigration Services (USCIS) chooses to make an issue of it, your misuse of a tourist visa could lead to your losing the right to obtain not only a marriage-based green card, but most other types of U.S. visas. WE would have all done this if it was legal/its not

Withdrawal. An applicant or petitioner may withdraw a benefit request at any time until a decision is issued by USCIS or, in the case of an approved petition, until the person is admitted or granted adjustment or change of status, based on the petition. However, a withdrawal may not be retracted. This is for protection of the bene that USCIS can not properly ID https://www.ecfr.gov/current/title-8/chapter-I/subchapter-B/part-103

yes, IRS site under FILING STATUS AND DEPENDENTS #2 for dhildren https://www.irs.gov/individuals/international-taxpayers/frequently-asked-questions-about-international-individual-tax-matters#:~:text=In general%2C you can claim Children usually are citizens or residents of the same country as their parents. If you were a U.S. citizen when your child was born, your child generally is a U.S. citizen. This is true even if the child's other parent is a nonresident alien, the child was born in a foreign country, and the child lives abroad with the other parent. You must include on your return the Social Security number (SSN) of each dependent. If your dependent is a nonresident alien who is not eligible to get a Social Security number, you must list the dependent's individual taxpayer identification number (ITIN) instead of an SSN.

Update 15 months after son's Death (Merged 4X)
JeanneAdil replied to RubysMom's topic in Philippines
https://www.uscis.gov/green-card/green-card-eligibility/widower To obtain a Green Card, you need to file Form I-360, Petition for Amerasian, Widow(er), or Special Immigrant, with all required documents as listed in the form instructions. If your spouse filed Form I-130, Petition for Alien Relative, before his or her death, we will consider the petition as if you had filed an I-360. Your unmarried children under the age of 21 (known as “derivatives”) may be included on your immigration petition. As “immediate relatives,” your derivative children are granted benefits of the Child Status Protection Act, which “freezes” their ages as of the date of the principal’s filing of Form I-130 or I-360, whichever is applicable. This provision prevents them from aging-out if they turn 21 prior to adjudication of their adjustment-of-status or visa application. They must, however, continue to meet any other additional filing requirements. For more information, see our page on the Child Status Protection Act. -
yes, u r as visa is still valid the big issue is that week is Thanksgiving week here in the US with the most traveler's by plane than any other week including the following weekend And therefore the costs skyrocket check the prices for that week against the week before i can not find a city in Mississippi called Arizona so i have no idea what airport u would be using

if u have not submitted all the supporting documents for the ds 260 and/or I 864, u can delay the process for up to a year at the NVC step this can allow the son's I 130 to catch up u should notify NVC by email or snail mail once a month to keep wife's case open during this time and include the information about the son

Great to hear but why they left the world's busiest airport off the list of airports that handle this seems to be another government error among all the others Is Atlanta International airport the busiest? Hartsfield-Jackson International has once again been declared the world's busiest airport, according to an official ranking. The Atlanta airport with 93.7 million passengers passing through in 2022 had more traffic than any other airport in the world, according to industry group Airports Council International World.Apr 5, 2023
