NVC DQ Complete - What is next?
JeanneAdil replied to Kyle6811's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
NVC and embassy work now to schedule interview date u will get an email notice with further instructions when it happens There is a long queue for Mexico so now u wait USC should make sure the 2023 tax returns have been completed and if the Mexican has spent more than 6 months out of Mexico , except the USA, a criminal report will be needed from that country. Otherwise, have patience, -
USCIS has 2 sites https://www.uscis.gov/tools/checking-your-case-status-onlinehttps://www.uscis.gov/tools/checking-your-case-status-online 1 when case is at USCIS 1st stage (little info there) and another when NVC gets it which is slightly better https://ceac.state.gov/CEACStatTracker/Status.aspx the only way to insure u can be on the same flight is to book them them at the same time If he books a return ticket ahead of flight from US, there may not be a free seat for u when holding a US approved visa , u can use many canadian airports for POE and customs and do not need a Canadian transit visa. Montreal and Toronto are 2 of them

Colombian, Cuban, Ecuadorian, Guatemalan, Haitian, Honduran, or Salvadoran, or their immediate family member as part of the family reunification parole processes. Only individuals who received an invitation specifically inviting them to request to be a supporter and initiate the FRP process by filing Form I-134A may file. There is an invitation number listed in the invitation letter that each individual filing Form I-134A must provide or we will not confirm the Form I-134A and the FRP process will not move forward If you are agreeing to support a beneficiary seeking humanitarian parole who is not applying for parole under Uniting for Ukraine; the Processes for Cubans, Haitians, Nicaraguans, and Venezuelans; or the family reunification parole processes, you must file a paper Form I-134, Declaration of Financial Support, along with Form I-131, Application for Travel Document, through the appropriate Lockbox location. For more information about parole, visit our Humanitarian or Significant Public Benefit Parole for Individuals Outside the United States page.

the embassy does not like immigrants to do additional international travel after the interview/that would require additional security checks / u already have 3 countries to verify and if u were born in India or Pakistan, the wait is extended as those countries (among many others) have poor record keeping and make the AP long.

After age 26, u need your own insurance plan very surpprised that casa did not make u show research for health care plan that u could afford for your new "to be wife" A job that offered health is best as Government plans are not that great. still waiting (Split)
JeanneAdil replied to tahagill's topic in Bringing Family Members of US Citizens to America
Approved by USCIS or an interview? If USCIS u will be waiting for a visa to be available according to the Visa bulletin and country https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2024/visa-bulletin-for-april-2024.html -
Further down the road you will need to show that USC filed federal tax returns if worked outside the US If no US income, joint sponsor will be needed immigrant will need criminal reports from all countries lived in https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html Criminal reports per USCIS needed: Are 16 years old or older Lived in your country of nationality for more than 6 months at any time in your life Your country of nationality Are 16 years old or older Have lived in your country of current residence (if different from nationality) for more than 6 months

Moving from family, your country and friends can be stressful and by doing K1, it adds to stress of waiting out the AOS process and homesickness on top of feeling walled in as u can not work or return home to visit . That is why the spouse visa is superior. check crazycat's charts. Have u and USC checked the new fees to adjust your status in the US after marriage? AOS fees now total $2540 for I 131 , I 485 and I 765 plus if USCIS requires a new medical in the US , there will be dr appointment costs. with I 129 K1 fee of $675 https://www.uscis.gov/forms/filing-fees/frequently-asked-questions-on-the-uscis-fee-rule The cost to do a spouse visa is $1070 for for I 130 and the 2 NVC fees with an additional $220 to process green card after visa issued. Marrying and filing for spouse visa would show a real relationship and aid your new process Add to this which is important to USC,, you can be added to workplace insurance easier and USC can include u on tax returns to double the deduction (in the year u marry)

Normal red flags still exist for a new husband Did you help the ex ROC ? USCIS may be looking to see if he did ROC or naturalized I am so sorry for what happened to u in the 1st marriage that seems to have messed up the happiness in the 2nd this is not a judgement or saying "u r doing this" but these past few years USCIS has seen several cases of sham marriages / some for a visa and/or money. so marrying another from the same country after divorcing the 1st is going to get extra scrutiny especially if the 1st spouse has not gone thru ROC with divorce waiver or Naturalized and they don't know where he is. they may be looking at how u met both to see if u r considered a target. U may not think it but USCIS trys to protect both parties in these relationships. I do know the wait is heartbreaking as it took us 6 years to get a visa. Have u sent in an inquiry about your case? Have u considered filing a WOM? if he did not naturalize, remember u r still on the hook for the I 864 from AOS While u wait

Do I need to withdraw my N-400?
JeanneAdil replied to VWV's topic in US Citizenship Case Filing and Progress Reports
OMG No don't mess with the minds of USCIS and trusted computers i can see them cancelling all and u trying to correct this -
Receiving an "unacceptable" determination from USCIS regarding your no objection letter means that USCIS has found issues or deficiencies with the letter you submitted. This determination does not necessarily mean that your waiver application is denied outright, but it indicates that USCIS has identified concerns that need to be addressed. It is crucial to carefully review the reasons provided by USCIS for the "unacceptable" determination and take appropriate action to rectify any deficiencies. Check USCIS site to understand a waiver https://travel.state.gov/content/travel/en/us-visas/study/exchange/waiver-of-the-exchange-visitor/exchange-waiver-faqs.html

He is your biological child? if yes, then He is USC or LPR? If yes, then then he qualifies as relative INA 212(i)(1) Qualifying relatives are generally limited to applicants’ U.S. citizen and LPR spouses and parents. https://www.uscis.gov/policy-manual/volume-9-part-b-chapter-1 then If he does not qualify as not your biological son, u can forget this petition (IR5) the USC father can come and marry and file a spouse visa go thru the long process and if mentioned to apply for the waiver at interview, then file one

yes, original difference was only to be $10 so this is a big change and well worth filing online when sometimes the mail is so slow and weather dependent
