  1. sorry for what is happening to u BUT if USCIS found something in a background check , where did they get the info from??? u need to find out and go for the same info they found / it is possible if court or arrest, and the county/state has no record but it on a criminal background , get copy of your criminal check and ask the appropiate clerk to write saying "records no longer available" it will not help to marry as the same issued will come up for a spouse visa but spouse visa is a better choice and this sentence' I have a choice to fight and ultimately possibly lose not being able to produce very old documentation, or just give up... because fighting over this with USCIS could be counterproductive. What if I withdraw the application altogether before they deny it? Seems like a logical thing to do right now. Personally u also say "hard to find the right partner if Life" then do as i did K1 2009 denied married 2010 applied CR1 2010-denied 2011 appealed and won got the visa 2015 he's here he's a citizen married now almost 13 years and took us 6 to get approved u just don't give up on love and the "right partner in life"" Lawyer???? don't know about that one
  2. Every case goes into Ap 1. sometimes just to print out the visa (as it takes about a week unless computers or electricity or internet as sometimes happens) 2. AP can be for extra security checks as needed in high fraud countries 3. AP can be wait time for needed documents required by CO and embassy 4. AP can be wait time to check the documents that were submitted to check the validity of them
  3. for K1 joint sponsor only needed 100% of poverty level income for AOS , its 125% u need to find a joint sponsor who qualifies with 125% the items to show sponsor qualifies are spelled out (proof of USC or LPR) other items to show are I 864 affadvit and supporting W2 a 1099 would be for income doing contractor work 1099R is for SSA income (if new sponsor is retired) form 2555 is used by taxpayer for foreign earned income to use the tax exempt allowed by IR all that from a joint plus your most recent (2021) tax returns and a new I 864 and the supporting W2 or any 1099 or any 2555 u supplied to IRS
  4. so sorry for your mom Let's hope the cancer is treatable / many women do survive this i would continue with the visa process and spend as much time now with her then, get your I 551 stamp on passport and travel (when able) to be with her important to her to have family support especially if she needs any surgeries

  9. Who gets an I-94 form? A Form I-94 is needed by all visitors except: U.S. Citizens, returning resident aliens, aliens with immigrant visas, and most Canadian citizens visiting or in transit. Travelers will be issued an I-94 during the admission process at the port of entry. Print out this USCIS page and take it to employer as Spouses with CR1 /IR1 don't get I 94 https://www.uscis.gov/newsroom/alerts/uscis-updates-guidance-on-employment-authorization-for-e-and-l-nonimmigrant-spouses#:~:text=As%20of%20Jan.,C%20of%20Form%20I%2D9.

  15. https://www.govinfo.gov/content/pkg/FR-2022-09-09/pdf/2022-18867 the new rule goes into effect December 23, 2022 for petitions dated on that date or after its 168 pages of read and i have read and reread as it's like all other legal documents a hard read /goes back and forth from the 1999 rule to the 2019 rule to this new one what i do get out of it is the following Under the INA, noncitizens are inadmissible and therefore (1) ineligible for a visa, (2) ineligible for admission, and (3) ineligible for adjustment of status, if, in the opinion of DHS (or the Department of Justice (DOJ)) or consular officers of the Departments of State (DOS), as applicable),2 they are likely at any time to become a public charge.3 While the statute does not define the term ‘‘public charge,’’ it does provide that in making an inadmissibility determination, administering agencies must ‘‘at a minimum consider the alien’s age; health; family status; assets, resources, and financial status; and education and skills.’’ 4 The agencies may also consider an Affidavit of Support Under Section 213A of the INA submitted on the noncitizen’s behalf when such is required. bottom of page 4 into 5 details the non citizen'd health, family, assets, and education and what will determine "totality of circumstances the September 9, 2022 final rule for Public Charge Ground of inadmissibility makes an attempt to define "public charge" page 5. DHS is amending 8 CFR 213.1, relating to the acceptance of public charge bonds. With these amendments, DHS is: • Adding a new paragraph specifying that USCIS may invite adjustment of status applicants who are inadmissible only under section 212(a)(4) of the INA, 8 U.S.C. 1182(a)(4), and whose applications are otherwise approvable, to submit a public charge bond in USCIS’ discretion and clarifying that USCIS will set the bond amount and provide instructions for submission of the bond; • Modifying the existing

  21. it was an overhall of the system to interview abroad but the funny part is the questions didn't change some favorite questions were 1 what color is spouse's house? 2 what color is bedroom carpet ? 3/ What restaurant do u often eat at in US? these types of questions that someone would know only if living her with spouse continued even in 2009 when we first interviewed
  22. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-5-collect-financial-evidence-and-other-supporting-documents/step-7-collect-civil-documents.html for each parent I 864 IRS transcrpits for most recent year (2021 , 2022 to take to interview if it is after 4/15/2023)
  23. years ago the way the process worked was a fiancee or came to USA, interviewed here and then was approved or denied when and why it changed i could not locate by doing internet search But as far as why some can AOS and others can't? Ask one of the Senators on the committee https://www.senate.gov/general/committee_membership/committee_memberships_SSGA.htm when u write ask also why they approve DACA and then take it away and then approve it again (over and over)? why they have a 10 year bar but then have a waiver for it? why they allow joint sponsors when the poverty level is so low? why they say "criminal past" is a "no no " but have a waiver for that too? why they say some student visa holders have to return home for 2 years but then allow a waiver? Seems all rules are made and then rules are made to break the rules
