  1. I downloaded all the paperwork for the packet 3 from embassy website and i have a question about the case number it asks for. Where is the case number assigned that packet 3 asks for? Is the case number assigned at NVC or at the embassy? Also if its at the NVC how can i find out if the its been assigned and also how long does it take before the petition is sent to NVC and how long before its sent to the embassy?

    I think it's the NVC that assigns the case number. According to http://www.visajourney.com/timeline/stats.php?history=90, it took average 27 days from NOA2 to Embassy receiving the case using around 600 data samples. After Mumbai Embassy gets the approved petition, it takes around 54 days till visa interview according to that same page (using "ALL time" instead of just the last 90 days). So, if we round up the nearest months, you're looking at 1 month till Mumbai receiving petition, and 2 months till interview date.

    Is there anyway we can track the progress at the NVC for I-129f

    We applied for the K3 Visa in Nov 2004 and have been waiting since then for the approval. I used Holmes & Lolly and found them to be wonderful, however since Dec 2005 they informed me that the case is undergoing background checks as per what the NBC has told them when they check on the status. I checked the status on USCIS website and it shows that the I129F is "Case received and pending" and that it is at the NBC. However I then checked the processing times for the I-129F at the NBC and it shows Sept 2006. I am confused as to why my background check would take so long and neither me nor my wife have committed any crime before. Is it possible that this could be due to the fact that I am an American convert to Islam and my wife is from Pakistan? My wife and her family were in the US before but left on voluntary departure, could this also be a reason?

    Holmes & Lolly suggested that I ask a senator to intercede but told me that if I choose this route then they themselves can no longer help me at all anymore according to the law.

    All of this seems really strange to us... Any advice and answers would be helpful and greatly appreciated.

    Did you apply for the K3 visa or submitted teh I-129F for to USCIS?

    What is teh current status of your I-130?

  3. You know what I had the same problem. What I did I printed all 4 Forms out and filled em out with a fine Pen. It is just a pain doing that cos you have to really fill in all 4 with a pen and you get tired after the first two lol.

    I would print them out and try to fill em in with my handwriting,if you do it that way use a black pen!!!

    I had to do the same thing. Every time I would go in to type the date, it would cut it off with the little + sign, so I very clearly wrote in all the dates by hand in black pen and made a little notation on my cover letter saying something like (please pardon the handwritten dates on the G-325A application - the form from the USCIS websit cut off part of the dates).

    I actually opened the form in adobe acrobat 8.0 and modified the font of the the text feild and everything fit.

    Attach the form and let me know the text you want to fit in it and maybe I can do it for you if you like.

    For job dates just call Human resourse of you rprevios job and ask for a reference and dates and they will tell you them.

    I have gotten approval of I129f in the mail and am just getting prepared for the packet 3 to be sent to my wife.

    I discovered that my wife's birth certificate doesn't have her name specified so I looked up the faq on USCIS site and found the following:

    Each applicant must submit an original and a clear photocopy of his/her birth certificate. The certificate should include the applicant’s name, date & place of birth, the names of both parents, an annotation by the issuing office indicating that it is an extract from its official records, and the seal of the issuing office, i.e. the municipal authorities or the village authorities (gram panchayat or talati-cum-mantri). The certificate must be in the original, official language of the state in which you were born.

    Unobtainable or incomplete birth certificates

    If your birth was not recorded, please submit a “no record of birth registration” letter from the relevant municipality or village authorities along with secondary evidence (see below). If your birth record has been destroyed or the municipality or village authorities will not issue one, submit a letter from the municipality or village authorities stating so along with secondary evidence of birth. If your name is not mentioned in the birth certificate, submit the certificate along with secondary evidence. If any details are missing in the birth certificate or if there is a discrepancy regarding your date of birth or name, submit the certificate along with secondary evidence. If your birth was registered more than three years after you were born, you must submit the certificate along with a magistrate’s order concerning the late registration.

    Acceptable secondary evidence of birth

    Following are examples of secondary evidence of birth (which should also include your name, date and place of birth; names of both parents; and the seal of the issuing office): a baptismal certificate, an adoption decree, a school record, a notarized affidavit from a close relative (a parent, a close relative, a neighbor or friend who was present at the time of your birth) on the appropriate stamp paper which must be sworn before a First Class Magistrate. The person making this affidavit must state how he/she knows your family and how he/she knows the facts of your birth.

I was wondering if someone had an example of this affidavit or if someone can give me some got vocabulary to put on this letter

    Im reviewing our I-130 before we send it off this week. Im at question 15, where it states Name and Address of present employer(if any). Is this for the US citizen or the beneficary ? Because it's in the C column(information about the spouse) but there's a thicker black line above it, so it could be for the petionner. Im confused :/

    I got the approval for my I129f in the mail and wanted to prepare what I can to send to my wife for when she gets the packet 3 in the mail.

    I am not sure what forms I should fill out and what kind of other docs (phone bills, pics, video etc.) I should send to her.

  12. I filed an I-130 for my wife on Dec'14 2006 and then filed an I-129(f) on Feb 1st after receiving the NOA1

    Yesterday I got an approval notice for both applications and they state the following:

    I129(f)

    It says that "The above petition has been approved. We have sent the original visa petition to the Department of State National Visa Center (NYC), 32 Rochester Avenue , Portsmouth, NH 03801 - 2909. NVC Processes all approved immigrant visa petitions that need consular action. It also determines which consular post is the appropriate consulate to complete visa processing NVC will then forward the approved petition t o that consulate."

    It says that "The above petition has been approved . The petition indicates that the person for whom you are petitioning is i n the

    United States and will apply for adjustment of status . He or she should contact the local INS office to obtain Form I-485, Application for permanent residence. A copy of this notice should be submitted with the application."

    If the person for whom you are petitioning decides to apply. for a visa outside the United States based on this petition, the petitioner should file Form 1-824, Application for Action on an Approved Application or Petition, with this office to request that we send the petition to the Department of State National Visa Center (NVC).

    Now, the biggest problem is that my wife is still in Pakistan and I have no idea why the I-130 says she is here.

    Now I am confused as to what my plan should be, should I continue with the K-3 and when she gets here process the I-130? is that the fastest way for me?

    The approval notice for your I-130 says what it does because they assume your wife will be entering the US on a K-3 visa and will adjust status after she's entered the US. That is what most people entering on a K-3 do.

    You can pursue the I-130/CR1 if you wish and have your wife return to her home country for the I-130/CR1 interview at a later date by filing I-824, which costs $200 and takes up to six months to process. Most people following the K-3 route find it easier to adjust status, but you do have the option of pursuing the CR1 visa.

    If you go the normal route and decide to adjust status once she's entered the US, you do not need to do anything further with the I-130. You will include a copy of the I-130 approval notice (2nd NOA) in your petition to adjust status.

    Thank you very much for your help, I have also scheduled an appointment with an immigration officer this wek to ask the same question.

    I do have another question that if I continue the K3 route, can she get a SSN when she enters US so she can get on my health insurance? I plan on trying for a children and would like her to be on my Medical insurance.
