    Petitions are adjudicated by humans. Humans move at different speeds from one another. It’s very reasonable that two petitions sent at the same time will be reviewed at different times there is no need to worry

    I did EB3 consular processing in Germany in 2019. My I-140 was approved in May and my interview was eventually scheduled in September for mid October.

    Are you saying you entered on the B2 visa with the intention to stay in the US and find a job?
    Its clear that you don't meet the NIW requirements so there is no point in trying again in the short term.
     
    Even if you find a job the timeline will not allow you to stay in the us on a b2. You will not be able to adjust status if you are out of status so you should plan to leave before that happens.

    There is no judgement I am simply stating that if you are currently in the US and now submitting an application there is no way that it will be approved on your current stay which would allow you to adjust. Therefore you would have to leave the country and then go through consular processing as returning again with the intent to adjust would be fraud. The wait times in canada for consular are quite significant

    Even if you have an employer ready to sponsor you, there is no way you will get an I-140 approved and be able to adjust status in time if you are currently in the US. You will need to leave while the application is processing. If you overstay then you will not be able to adjust status

    Sorry this is incorrect
    Trying a drug once does not require a waiver. Unless there is a criminal record involved, the drug use is evaluated by the panel physician. It will be up to them to determine if drug testing is needed or not. There are plenty people here who had tried marijuana once and were not required to undergo drug testing or received a ban
     
    OP he should not "mention" anything, only truthfully respond to the questions asked.

    You dont submit any documents. There is nothing you can submit that will help their case. They need to show strong ties to Nigeria.

    O1 petition can be done DIY but results are generally much more successful with a lawyer. Anyone charging you $49.99 is not offering you a service that you couldnt do yourselft. Save your money

    No the waiver qualifications are extremely limited. Covid 19 is not one of them

    Quickest would be to premium process an O1. Get a good lawyer and see if you can qualify (unlikely but if money doesnt matter then you might as well try). My EB3 took 2 years pre covid.

    Now, it's obvious that you are shopping for a way to be with your girlfriend.  Whatever schooling that will get you a F1 visa to spend more time with her.

    What does the child think of all this? She’s probably never met you. At 15 she will have established friendships and developed bonds with people in her family and neighborhood. This isn’t an abandoned puppy you can just take home from a shelter and call it your own.

    A CR-1 would be a better choice, imho.  You are both already together.  You can marry now and start the CR-1 process.  You can have a marriage celebration with family in 1 to 2 years.
     
    Every couple has their own priorities, and each couple must decide which visa is better for their situation.
    K-1
        
        More expensive than CR-1    
        Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
        Spouse can not leave the US until she/he receives approved Advance Parole (approx 5-6 months)    
        Spouse can not work until she/he receives EAD (approx 5-6 months)    
        Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
        Spouse will not receive Green Card for many months after Adjustment of Status is filed.
        A denied K-1 is sent back to USCIS to expire
      
    CR-1
        
        Less expensive than K-1    
        No Adjustment of Status(I-485, I-131, I-765, I-944) required.    
        Spouse can immediately travel outside the US    
        Spouse is authorized to work immediately upon arrival.    
        Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
        Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.
        Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

    The K1 visa requires you to sign an agreement that states you WILL get married. The K1 is not intended to test out a relationship
