Well the point is that I provided the driver license green card and the voter information and only the citizen can vote further to add here that the abuser is a US citizen and this was established by the VAWA unit moreover the establish this there is a method mention in VAWA policy manual chapter 2 and the VAWA unit has done due diligence needless to mention here that in n-400 instruction it’s mentioned that citizenship interview the status of the abuser should not be questioned because it was first established by VAWA unit then the case was transferred to national benefit center and then the adjustment is status field office has check the requirements now after 5 years sending an RFE in n-400 to send a copy of abuser citizenship certificate or us passport is almost impossible since we are already divorced and it’s very difficult for the victim of abuse to get the personal record of the abuser

I got my green card through VAWA at that time I have submitted the drivers license, Social Security, and the voter information of the abuser and based on the information the VAWA unit has verified the citizenship status of the abuser and as a result, First approved my VAWA case And then later on, I got my green card now recently I applied for US citizenship and the officer first question is to show the citizenship status of the abuser and I informed her that that the same has been verified by the VAWA unit moreover there is a special method to mention in chapter 2 of VAWA how to determined the the citizenship status of the abuser further in the in N-400 instructions page 13 it’s mention that the abuser citizenship status is not required if you got your green card through VAWA but despite all these strong arguments I received an RFE to send the naturalization certificate or the passport copy of the abuser which I don’t have to because I was in a hostile situation and that’s why I filed WAVA now my question is there any provision of law where we can request to change the interviwing officer and ask for supervisor review. all suggestions are Wellcome

The citizenship status is the first thing that the VAWA unit verified and that what they issued prima facie moreover as per the book and rules if you are a victim of abuse the VAWA unit will verify the things through other means if they will check the record but now this RFE is very weird and if the n-400 didn’t go through what happen to the green card

Dear friends, my VAWA got approved in 2020 and I got my green card in 2021 then based on three year rule since I am a spouse of US citizen I applied for US citizen Unfortunately, it was a really bad experience. The officer who is interviewing me is very rude and the first question he asked is your spouse US citizen and I said yes he asked me to show his passport or US citizenship certificate i informed that the proof I have is drivers license, Social Security, and the voter information of the abuser and based on these the VAWA unit has already verified his citizenship status and approved my VAWA and that’s why I got my green card but the officer. Don’t want to listen. He is keep insisting me to prove the citizenship status of the abuser.then latter on he issued the RFE to either send the abuser passport copy or citizenship certificate I applied for FOIA but the USCIS refuse to give the citizenship certificate of the abuser now my question is how to respond this RFE need some suggestions.I have only 10 days to respond this RFE

  13. Dear freinds once your VAWA approved even if your abuser suppose passed away or lost his citizenship this will not your VAWA case or your ability to become us citizen can some one send me the link where this information is mentioned I need it so as to respond a RFE
  14. Can some one guide me that what is the ways to get the citizenship proof of the abuser if she is naturalized beside the FOIA to USCIS or voter registration because both these ways are not working for me what else method can be used.

Thank you for your kind help and support I already proof the status of the abuser with social security driver license and voter registration in VAWA process no RFE was ever issued because the VAWA unit verified the same then in the green card this fact was verified by the file office but unfortunately in the citizenship interview I encountered a really bad officer who is asking again and again about the abuser status I provided her the supporting documents but despite all these proofs she issued a RFE to prove the status of abuser and surprisingly it has only 30 days to respond feeling depression

  18. Thank you for your kind help and support. You are the best but you know like there are so many problem in USCIS system. I applied for VAWA five years before I got approval notice of VAWA without any RFE. I got my green card without any interview but unfortunately since I’m appearing in the citizen ship interview I have encountered with is a very rude officer over there who started again asking the question and putting pressure on me to verify the status of the abuser and I told her that these things were already established then she took the citizenship test and at the end gave me a letter the civic test is pass how ever no decision was made and later send me the RFE to establish the abuser citizenship status feeling pressure
  19. Dear freinds can someone share the experience that if I request the USCIS to obtain the citizenship certificate through FOIA about the abuser as third party will this work what is the procedure have some one able to got a success in this way.
  20. Dear freind can I apply a FOIA request to get a complete supporting documents or any other relevant data showing that the person is a US citizen from social security administration how this process work need some guidance the matter is urgent.
