  1. Big question here is where are they now? If they are outside of the US, this is not even something to wonder about because you’ll only have the option to do consular processing (meaning outside of the US) anyways.

  5. Does it say this on your online USCIS account? I guess you'll find out in 2 weeks, but don't get your hopes up because this USCIS feature has proven to not be very accurate.

  7. Exactly this! This payment would have been a recent payment. After paying the fee, it could take up to 90 days to receive the green card. I remember receiving a confirmation after paying the fee and the confirmation also mentioned the timeline for receiving the card (up to 90 days) and to contact USCIS if I hadn’t received it after 90 days. I ended up having to contact them, and received my card after 120 days.

  10. Not an issue at all! I also didn't have a sealed package, everything was checked online by CBP when I entered on my CR1.

  12. Wonderful news! I am an August 2021 filer, so I hope for an update soon! Good to read that you hadn’t filed for the N-400 yet, this tells me that there was no trigger to get your case to move more quickly yet. I also haven’t filed for the N-400, so your post gave me hope!
  13. The timeline of everything looks a little fishy to me. Moving after being married 2,5 years (ensuring to receive a 10 year green card) and then divorcing a month after entering? I agree that your husband could have decided not to move forward with the process if he had somebody else, why go through all the trouble only to file for divorce a month after you moved to the US? Something is not adding up here…
  14. This is way too much visiting in way too little time.. 5 times in 7 months is a lot, even if you have the financial means to do it. CBP is very likely not going to like that.

You already received all the correct answers and, as a Dutchie myself, your spouse would be miserable doing the AOS because she wouldn't be able to work of leave the US (think about emergency back home, etc.) until she has her work and travel authorization. I can only imagine that your spouse has an independent life in the NL, and being stuck in the US without being able to do much of anything would not be ideal..

  18. No, no desire to become a US Citizen. As long as they keep sending me extension letters until my I-751 is approved, I am good 😅👍🏻

Yes, it will mean that you’ll be apart for a little while longer, and I understand it gets expensive to have multiple short trips, but how would you be able to afford being away from work for extended periods of time? I see that you own your own business, but you are aware that you can’t work while visiting on your Esta, correct? Having extended visits will raise flags with CBP
  21. This is turning into a very slippery slope now.. Yes, technically somebody can adjust status from a tourist visa if they are in the US already and circumstances changed. In this case however, OP is NOT in the US yet and already thinking about or advising the option of adjusting status in the US is a little shady because of that. Don’t do it.. To OP: yes, you can visit the US on your Esta while your I-130 is pending. I visited my husband many times while mine was pending. I had short visits (1-2 weeks per visit) because I couldn’t be away from work for longer, and this also showed a strong tie to my home country. I would not apply for a tourist visa because you are Esta eligible and might lose your Esta if your tourist visa gets denied.
  22. I received them all by now (12, 24 and 48 months). Your current 48 month extension letter is the one that you need to keep. Please note that it is a 48 month extension from the expiration date of your green card. So in my case, I only have an additional 2 years because I’ve already been waiting close to 2 years since filing for my ROC.

This of course is not legal advice, and nobody can predict how difficult or easy your AOS will be, but from an outside perspective it does look like the ultimate goal was to get a green card one way or the other (asylum, U visa and now marriage). If you can’t afford a lawyer, all you can do is prepare your AOS package very well, send enough evidence and hope for the best!
