  1. AOS always looks like a great idea until it doesn’t. I think people underestimate the ‘not being able to work or leave the US’ part. I assume you were aware of all the implications when deciding to do AOS? You could have told your partner that doing AOS would put you in a difficult spot, and that leaving the US on time and doing the CR1 would be a better decision for the long run. My husband and I were in the same boat, I was visiting the US and when we talked with a lawyer, they said I would be eligible for AOS, but I was not going to put myself in that situation and my husband completely understood.
  2. We also don't have that, the house is already paid off. I did explain that in a cover letter though, so I think it doesn't have to be an issue.

  6. No need to send 100 photos, pick a few and make sure they cover the entire timeline of your relationship/marriage. 100 pictures will not prove more than 10 carefully selected ones
  7. USCIS understands that couples who live in seperate countries don’t have that type of evidence. We had the same thing, and we sent pictures of us together (and with family and friends), wedding pictures, some screenshots of social media posts, some text messages, boarding passes and pictures of the stamps in my passport when I visited. Any type of evidence of time we spent together. I am also from an EU country.
  8. Did she explain why she thinks it’s important to marry in the US? You are already married, also in the eyes of the US.
  9. How bonafide is this marriage? Sure, it might be official, but you haven’t seen each other in 5 years and ‘sort of’ are in contact? This really doesn’t look good.

This message means that one shouldn’t use a tourist visa to enter the US with the intent to adjust status, because that is a no-no No, not everybody moves to the US by using a tourist visa to enter and then file for an adjustment of status. The ‘proper’ way to do it is to file for a K1 or CR1.
  14. Just an FYI, I don’t know if you have siblings, but before you want to also have them enter the US on a visitor visa and file for an adjustment of status for them, that will not work.. Starting to see a pattern here.
  15. This makes me wonder if you know what visa to apply for? You are talking about doing the adjustment of status, which is not a visa and also not an option for you. You cannot use a non-immigrant visa (or Esta) to enter the US with the intent to adjust status. The IR1 is your path, or possibly DCF.
  16. His health is on the line here as well, protection might fail (I assume you are/will be intimate) and that puts his health at risk. Apart from the ethical and moral aspect, you have (and will want to have) to let him know this PRIOR to getting to the US. It is not fair to keep this from him..
  17. But you are already planning/thinking about doing this. And, ‘surprising’ you girlfriend by making her homebound and unable to work in the US for a few months doesn’t sound like a very nice surprise.. Do you know what the adjustment of status entails?
  18. I was able to get a new Esta while my case was still pending, had no issues.
  19. Yes, the stamp acts as your green card until you receive the physical one.
  20. Right?? I mean, come on… The thing that is kind of weird is that I have to send my RFE packet to the Fresno, CA field office. That doesn’t make sense to me, I am in MN. What are your thoughts on that?
  21. It is completely random I think. They are now processing and approving I-751’s that were filed 3 months ago as well, it’s a disgrace!
  22. No email notification or update on my online account, just a letter. The same thing happened when I received my biometrics letter in November 2022. After doing the biometrics, they did add that to my account (“fingerprints taken”).
  23. Received an RFE today… Not because I didn’t send enough evidence when I filed my I-751, but because “your case has been pending since August 2021 and we need to see evidence of a continued marital union”. Really, USCIS??? Tell me; why has my case been pending for almost 2 years? I am beyond frustrated.. Just assembled ANOTHER packet, ready to be sent out. USCIS, you suck!!! 🤬
