  1. Gotcha! It surprised me because it came from a pretty established member here.
  2. Where did you get this info from? Did anything change because as far as I know the I-130 doesn’t apply if the beneficiary entered on a K1 and the couple married within 90 days.
  3. If she entered on a spousal visa the I-485 does not apply. Make sure that the immigrant fee is paid and she should receive her greencard in up to 90-120 days. why the last sentence “Appreciate the help w/o any BS please”?
  4. They think she would just end up staying in the US.
  5. Even though it is of course great that you have a lot of evidence, but if your packet is HUGE are you not sending repetitive evidence? I just stacked my papers and put them in an envelope.
  6. What kind of work visa is she on?
  7. She can try to get a tourist visa, but her chances of getting one approved are very slim. If her tourist visa gets denied based on suspected immigrant intent it won’t impact her current case.
  8. No changes in this process or situation.
  9. The requirements are that you have met in person at least once in the 2 years prior to filing, which you have.
  10. OP: I also saw your post on Reddit and I really think you should wait until your I-751 is approved. As mentioned there too, it looks like your first marriage didn’t last long, you had a conditional greencard and are already remarried while your I-751 is pending. You might want to make sure first that you don’t have issues with your I-751.
  11. Her chances of getting a tourist visa approved are not great, and for good reason because it looks like she’d try to use it to enter with the intent to adjust status.
  12. For tourist visas there is no petitioner or beneficiary, there’s only the applicant.
  13. They should reschedule their trip and stick with the interview.
  14. Gotcha. Now the case will be sent to the NVC and after that it will move to the Embassy. Here is a great overview, you can click on each step for more info. https://travel.state.gov/content/travel/en/us-visas/immigrate/the-immigrant-visa-process/step-1-submit-a-petition/step-2-begin-nvc-processing.html
  15. I assume this is a consular case? Where and who is the beneficiary?
  16. Both the US and Canada can deny you entry because you don’t seem to have any ties to your home country if you can spend this much time away. You can be considered a high risk of not leaving the US (or Canada for that matter).
  17. Please enter the dates in your actual timeline because that will help people more.
  18. If you were denied entry for suspected immigrant intent it will not impact your CR1 because that actually is an immigrant visa.
  19. Only the ones with questionable issues. Many, many people re-enter the US everu single day.
