  1. Exactly. She continues with the process in the US. And remember she cannot leave the US unless you apply for advance parole and it is approved.
  2. No no, don't abandon. Continue. If she was adjusting from let's say, a tourist visa, you would still need to file the I-130 before the I-485. My point is that based on the humanitarian parole she could not adjust directly as she would require to apply for asylum first. The good thing is that you already have the I-130 approved.

  5. It is the official name for a temporary proof of residency. Can be a stamp on your passport or a stand alone paper with your photograph and bio info.
  6. Include the image you have of your GC, an explanation and the I-90 receipt notice. If it is rejected, they won't charge the fee and they will say why it was rejected so you would be able to file again including what's needed. Given that you have the I-90 receipt notice already, call customer service to request for a paper ADIT to be sent to your house. That will be your proof of residency.
  7. The main issue is that ROC requires a copy of front and back of the green card. The case could be rejected if that is not in your packet. And I'm not sure if they will actually issue a card that might be valid for just a month - if they process your case past the expiration date they won't issue it at all-.
  8. Do you already have the receipt notice for the I-90? I'm not sure if the front pic would be enough to file. Maybe you can file a FOIA request just for the card. And you MUST file for removal of conditions within your 90 days window.

  10. The main issue is that, as you said, you don't know if he has been working - the law does not refer to 10 years but 40 qualifying quarters of work-. The "easiest" way would be finding out if he is already a citizen. Do you have a way to do so?

  14. In our experience airlines allow pets traveling with you if the box fits under the seat, the pet+box is under 22lbs and the box is rigid - not a fabric backpack for example-. Now, I am not sure if that is not the case for flights 7+ hours.

  16. She will be on vacation in Hawaii and will file while being there. She is not moving. You don't need to be at home when you submit a form online. 😐
  17. You can file from Hawaii and then visit Australia again BUT for a short period as physical presence and continuous residence are considered also AFTER filing. What exactly are you planning on doing in Australia besides visiting?
  18. I'd go for the tourist visa rather than petitioning. Maybe just for your mum to see if she likes it.
