Katerina, your best next step is to get on the first flight possible to enter the US, even if it's only a quick trip and then you return home to get your affairs in order before you come back with all your stuff. Use that IR-1 visa as soon as you can and take your evidence that the marriage was entered into in good faith with you in case CBP questions you because of something he does between now and then, like contact them or the consulate abroad or USCIS and claims fraud.
As for the divorce, I suggest that you file for divorce in the state where you take up residence in the US. Get a good divorce attorney. Maybe do some research about divorce law in the state where he lives and the state you will be living in to understand how property is divided in a divorce. File wherever it is advantageous for your situation. Normally, only the property that you accumulated while married is subject to the 50% division guideline, so most likely in your case that will be minimal. If you own property together it could be more complicated. If he fights the divorce it could be a long and expensive process unfortunately, with discovery and depositions and accountants and attorneys. Save your evidence that he cheated, that he was abusive. Don't give him any money, and fight for your rights. Ask your divorce attorney to file a restraining order against him so that if he harasses you or threatens you, a police report can be filed, he can be arrested. So sorry that you are going through this, but the light at the end of the tunnel is a new life in the US that hopefully will be good for you in the end. You can always go back home later if you don't like it here. Reach out to family and friends for emotional support. Good luck to you!

Lots of advice here to ponder
but aside from the immigration part, he is your husband
that requires he needs to accept some responsibility as your spouse
he can not just shovel you off by saying "don't want you anymore"
if you do come to the USA , do not sign divorce papers without seeing a lawyer here
he can serve papers to you if he wants a divorce thru the lawyer
If you are unable to come, still do not sign papers he sends
i usually don't say anything when it comes to divorce but you gave up a job and sold everything to come to him
he now, needs to understand how much this impacted you and your future and the pain it caused
on lighter side, you are lucky you don't have to live with someone who blames others and can't accept his own issues

No one seemed to raise any ToS issues when Brian was told his wife could still come to the US. Not sure why it’s different in this case?

We got Issued status today! Three days after being approved at interview. Embassy was closed for Thanksgiving yesterday so I didn't expect to get Issued status this fast. I can't believe we get to spend the holidays together and welcome the new decade. This has been such a long, exhausting journey. So incredibly thankful for the wealth of information and community in this website. It'll be your turn soon enough, it's almost over and you'll get to be with your loved ones 😊😊😊😊

I just got an email - 7h30 EST, saying all our documents have been approved. We were delayed a week for having to resubmit docs.
Our timeline was:
September 14 - Submitted all docs;
October 28 - Two docs rejected, one being an editable AOS form, and the other, the tax transcript, made no sense.
October 28 - I called NVC and complained about the tax transcript, and the rep agreed it made no sense and requested a supervisor review; he stressed I should not update the documents while the review was pending.
October 30 - I called again, and a different NVC rep told me I could update the docs if I wanted to.
October 30 - resubmitted the two docs. The transcript was the very same that had been rejected.
November 4 - DQ - I'm assuming a supervisor review happened and approved everything.
Yay!

We've seen people say this countless times and now it's our turn to say the magic word "APPROVED".
Went in 7:30 a.m and by 9:30 a.m I was on my way.
Asked to come collect passport tomorrow at 3pm.
All's well that ends well.
Keep the faith. Yours will go smoothly like ours.

Hello Everyone, please if you are on this thread and have case complete make sure you fill out the form and get added to the spreadsheet.
Check the spreadsheet to make sure your information dates are correct. i just went through these 7 pages and there were 10 VJ profiles here posting that have never filled out the form. This is very time consuming to chase down information . especially for those who don't fill out their timeline.
The timelines is where VisaJourney gets their stats. No updates no stats So please help the community by being a good member and fill out your timelines and complete the form to be added.
Thank you

pinano got a reaction from Balamban in Beware of accidentally finding oneself on Medicaid.
I've found this to be a good distillation of the updated rule, with particular focus on health services:
https://www.kff.org/disparities-policy/fact-sheet/public-charge-policies-for-immigrants-implications-for-health-coverage/
We have used CHIP for our daughter when she was a newborn, and did so for about a semester, while I was a grad student in the US. So naturally, I was worried, given that can be understood to be under Medicaid.
Luckily, the rule stipulates the immigrant must have been the beneficiary, in addition to explicitly excluding children (by applying the Medicaid criteria to adults 21 and over). Phew...
