Hello, I received a Prima Facie extension of 6 month last week, and I do not think my lawyer asked for extension. So I received the first Prima Facie in mid 2022 for 1 year and then nothing after that, till last week I got one which expires in Sept 2025. Is this normal?

If you don’t mind can you share nationality of the client? Just trying to gauge if it falls under the high risk countries list. That will at least give an idea of underlying process changes.

So running both in parallel EOIR 42B with court, and I-360 with USCIS will have different out comes. Lets say the individual is in removal, and if the I-360 gets approved, then what? Who should 485 should be filed with? My assumption is USCIS but it would not adjudicate it until removal is taken off. So for removal it has to have EOIR 42B approved which will result in termination of removal. And then file 485 with USCIS. The times with USCIS is faster than court I believe, as court may give verbal approval but due to limited number of GC it will take years to actually get one. Given that attorney had filed under category C10 then the 4000 GC Cap does not apply as per the chart below

Gotcha so this will go through court. So step 1 will be EOIR 42, then court may on discretion grant verbal approval and then after many years get a Green Card. Is the assumption correct?

Hello posting a scenario so see what are everybody's thoughts. Given that an individual had a legal status, got married filed i130 and it got denied, now the individual fell out of legal status and was put on removals and had court date and filed EOIR-42B. Filed vawa and given that vawa gets approved, will the individual have to get the 485 with the court or USCIS?

Hello all just wanted to share the journey so other people do not make mistakes for a simple EAD card which is already taking a long time to get it approved. 1. EAD filled category C10 (for vawa self petition) the time is 18 months for approval 2. File Date May 23 2023 3. Gave my attorneys admin to update the address November 23 2023 4. EAD approved notice and card sent on Oct 11 2024. 5. Found out they uscis mailed it at my old address (since the admin did not update the address and did not notify me that they werent able to update the address) 6. Filed AR-11 to update the address on Jan 2025 7. No way to find out the status so reached out to the Rep office Feb 11 2025 and got a response that i have to call USCIS to update the address. 8. Called USCIS Feb 20 2025 to update the address. 9. Opened service ticket with USCIS Feb 27 2025 to issue new card and resend approval notice. 10. Got response from USCIS on 3/13/25 they cannot service the ticket and I should call USCIS and open a ticket. 11. Called USCIS and the service agent said to apply again for replacement and it will take again the same amount of time to get it processed (that is 18 months). So fellas make sure that do not rely only on attorney's it is our job to confirm everything. This process is exhausting but do not give up.

Congratulations so good to hear some excellent news. Did they ask for psychologist evaluation? The timeline seems about right just little 2 months early based on the processing time for i360.

My attorney did send an extra page with AR-11 which states the name, A#, DOB, and wording of address change. The actual AR-11 form was signed by me (no digital signature but actual hand print signature). It does not say anything about VAWA. It was mailed out in Dec right before Christmas. The reason to confirm the address change is because I want to request a new EAD card to be mailed to the new address. When they approved ead they sent it to the wrong address. So before I order I want to make sure that it is indeed updated. your response makes sense. The only way to find out positively is going through Rep or a Senator. Thanks.

Quick question to all fam - has anyone updated address with USCIS. For vawa online update is not possible so AR-11 is the only way. Does anybody know how long it takes to be updated and if we get any type of confirmation or receipt mailed To the new address.

Approval of 360 would not impact. approval of 485 it may impact depending on severity of the charges. Approval of citizenship definitely it will ring all the alarms 🚨 at USCIS. you will need a good attorney to sort things out.

The current i360 processing time is 41.5 months. So add that up with 2022 month filing. And if you had unlawful presence how did the combo that have 131 or advance parole got approve. Should that individual be put in removal proceedings? How it is possible unless I’m missing something here.

You I360 was approved in 2020 why your 485 is still pending? It’s been almost 5 years.

Oh Lordy…look at the extra mile they went thru to discourage people. You gave them the right? Do you mean consent to disclose the information? Did your lawyer made you sign any consent form on behalf of USCIS? Because I believe utility companies may give out information if done via proper channels. This is a heck of an experience that you went through. And congratulations for the waiting period end. Insane amount of time that you had to wait. But alls good when the end is good. Just out of curiosity how did you found out that USCIS fraud reached out to the utility company to validate the documents. So does that mean that a court order or subpoena is not needed and they have a clear outreach here? Does it same apply for other institutions such as banks etc?

Messy? Are you pointing towards criminal back ground? Or frauds or combination of all? It’s good to have interview but we do not know what exactly they will be looking for. For marriage interviews we know what needs to be done. But for vawa we submitted the proofs. And some one with poor communication and not able to relate how attorneys present or put things in places will be a tough hill. also a question to all has anyone gotten a denial from USCIS explicitly saying as word “fraud”?

Correct. Even if it makes through senate and house it may not get votes from states. And even if somehow they do it can be challenged in court by that time he will be out of office hopefully.

No he will not. It will be in-humanitarian and vawa is at the bottom of the barrel low concern. He can definitely do something for new arriving asylees but that can be taken to court as unconstitutional.

Are you talking about a reversal of i360? That it was approved and now the status has changed from Approved—>under review? if not then I believe you inquired about 485. It does not get approved just by default. USCIS before approving 485 will of course review it. But since i360 is approved it wouldn’t be much of a problem to approve 485. It is normal.

It’s NBC and I got the 797 ead approved receipt. Just haven’t received the card yet. I opened up ticket with uscis to issue a new one and got a new date to not inquire till Nov 27. Amazing USCIS.
