  1. A bigger picture thought is that it may well work once but not a second time unless she spends significant time in the US .. so it is not really a long term solution
  2. I hope you were actually going for naturalisation not neutralisation !! 🤪 Please post a photo of the actual paperwork you were given with personal details redacted. It helps us to give the best answer if we can see the paperwork.
  3. she will most probably be asked how long she has been out of the US and why. That can trigger what can be very solid questioning by CBP and can be very intimidating especially to sometimes who is not confident in arguing the finer points of the law. If you are considering having her try, it might be worth considering going to her home county and traveling back with her.
  4. Yes it is one possibility. CBP doesn’t take “Not knowing” very well. Technically she should be let in but this is a very challenging way to try to renter and not for the uninformed or unprepared as arriving in Secondary inspection is pretty confrontational
  5. The option is to finally stop being naive and do things right. This will take time but it’s better than continuing the way you are going Relinquish the GC formally using I407 Apply for a visitor visa after that step 1 has been completed No it wont happen in time for the baby’s birth But this is the reality of living in different countries to your parents / children. A reality we all live with on here
  6. Uscis website has everything laid out clearly Follow the good on the vj website. You need to understand the process well by doing lots of your own research and study That’s how each of us started. Happy to answer specific questions as you work through the process b Read the guides and the Uscis instructions. Everything is explained there
  7. https://www.gov.uk/apply-citizenship-british-parent/born-on-or-after-1-july-2006 This tells you how to apply for a UK passport for children born overseas to UK parent
  8. You can only pay this fee after the visa has been issued and you have your passport in hand You will need info from the visa foil, which is only available once you have the visa in hand
  9. 1. Yes i understand 2. This may or may not be successful. You have done what you can with NVC 3. You will. This is automated . 4. They might. 5. If this happens you will need to be in contact with the Consulate. They may or may not do what you want them to.
  10. It will now be up to the Consulate to determine. Email the Syd consulate using your case number as the title line. They are usually pretty responsive
  11. Agree to these comments. The case referred to seemed to be an aberrant application of the 3 month rule .. but its a pain to have to negotiate the system when the IO gets to decide how things will be interpreted. Play it safe and file 92 days after you return
  12. Use the IOE receipt number to track the progress. Can take 6 weeks to 9 months 😵‍💫
  13. Use whatever method you used when you submitted your documents to NVC. Post or upload
  14. 1 yes 2 Keep excellent records of ALL contact with NVC and consulate correspondence .. hard copies and electronic records. Don’t rely on one form of contact every 12 months .. even if it’s the same “ reminder” sent several times each year , and putting a new document on your case at NVC each year 3. Yep. People are people and known to not read the notes fully .. If it gets sent to Sydney then you need to be very active with them in holding your case.
  15. Next option is to wait until one is at the consulate and email them asking them to hold the first one until the second one arrives. Hopefully you won’t need to do this.
  16. Immigration visa for a parent of a USC does not allow for “derivatives” .. that means that any child.. adopted or natural.. needs their own visa. The child cannot immigrate as part of the mother's immigration visa. Assuming the adoption meets all required documentation for the USCIS, the mother could apply for the child once she has her GC status but b the child cannot immigrate until the process is completed.
  17. It may be the late stage of pregnancy which would prohibit travel
  18. Who is the beneficiary ? If it is your wife and she now has German residency, then you must wait until the case is sent to the Naples consulate then contact them to request it be moved over to Germany Consular If you are both resident overseas, do you have v what is required to meet the sponsorship and US domicile requirements?
  19. Nor do I. Referring to I 797 as advanced parole ?? It is a receipt number for an NOA. What did she use to enter the US What did she say was the purpose of her trip.
