The visa expiry date is usually set as 6 months after your medical date so that both are still valid when you enter .. So you will have less than 6 months from your interview.. how much less depends on when you do your medical prior to the interview. Don’t cut it close… illness, weather issues, transport strike.. only a few of the not out of the ordinary occurrences which can derail travel plans.. And an expired visa is not what you want at this stage.

My quick read of the I864 exemption is that for immigration, he can count only the quarters that you accrued while married to each other. For actually claiming SS spouse income, he has only had to be married to you for 12 months. So i think you can’t use the exemption , though your SS income should be considered as ongoing when you return to the US and, if sufficient. will avoid the need for a joint sponsor.

Marrying in the US on an ESTA then returning overseas will not be an issue. But you will need to demonstrate intent to reside in the US.. you may have to go ahead of your spouse have an established residence before the interview .. and make sure you meet the financial obligations or get a joint sponsor

Assets must be deemed able to be liquidated within 12 months and the value needs to be verified. One issue i can see with stocks is that it is an “on paper” moment in time valuation which can vary greatly and in n fact become worthless .. unlike tangible assets such as property, cash in the back etc. Either a joint sponsor is needed or increase to the household income as a second job, with 4-6 payslips that document the now increased income- 5 replies

Thanks. Yes call them asap and see what they can do. Go to the visa interview no matter what .. Take photos of the envelope before you leave it with the medical clinic for repair in case they can’t do it while you wait If you don’t have a medical envelope for the interview, simply explain to the officer what happened and what you have arranged to do to fix this. Show them the photos. Make sure you pay close attention to any instructions they give you regarding getting the report to them .. they may want the clinic to send it directly to them .. they may tell you to post it .. they may tell you to hand deliver. Write down the instructions and read them back to the interviewer, so you know you have understand fully.

Im sorry but I am confused. Can you clarify 1. Have you completed the medical in preparation for your interview? 2. Were you given an envelope from the medical exam that you are carrying to the interview ? 3 Is your interview on Dec 4th 4 Is the envelope fully sealed ? I’m not sure what you mean by “strapped” on the side. Did you “strap” it up? Bottom line is that , if the medical envelope is not in the condition it was when it was handed to you, then there is a very high chance that the Interviewing officer will require you to get the medical officer to redo the whole packet and will not be willing to finalize your application until they have received the undamaged sealed report You won’t need another medical appointment. The office just needs to have the original packet back so they can recheck everything is there and get it into a new envelope You will need to speak to them asap

Are you referring to 1. an envelope given to you by the medical team containing your report and that you are hand carrying to your interview at the consulate OR 2. The envelope which you received with your passport following a successful interview and that you are hand carrying when you enter the US on your Visa ? If 1. then the medical team must replace /reseal/reissue it before your interview If 2. then the consulate must reseal it before you try to enter the US

This is a full standard form letter that is always used .. and then specific issues for your individual filing are marked out added on at the end It’s obviously easier for them to send the full text plus rather than tailoring each individual letter. But yes it can be confusing -
Your comment about the copies not being stamped highlights the futility of any one other than the file creator.. ie NVC CEAC USCIS … fixing the “lost file” mess. You and the consulate have no way of proving or ensuring the documents you have or present are actually the same as the ones on the file. You’re probably getting the run around from the Consulate because, rightly so, it’s not theirs to fix. It needs to go quite a few pay grade levels above where its stuck now at USCIS. I agree with filing the N400. Many people do so successfully with lost GC and you have all the documentation needed now (temporary I551) You might think about the better of two fall back plans if you do need to get an ADIT stamp… if this remains unresolved and close to the 12 months mark .. a trip to the USCIS office in the neighbouring country or a quick trip back to the US to get the stamp there. Neither easy nor cheap but may be needed. Better to think ahead now than ignore the possibility and in times like this, unfortunately, it’s not what you know that matters.. it’s who you know. stay in touch .. We are all eager to know how you go with this mess and will celebrate when you get through the system
