  1. You have done nothing wrong. Its a risk assessment by CBP. Everyone entering on a visitor visa is presumed to have immigration intent .. and its up to the officer to assess it at that time. Refusal of entry or issuing a warning is based on the decision by the officer that the likelihood of overstay is greater than they want to allow. Its not “innocent until proven guilty” unfortunately .. rather the other way round. You didn't do anything wrong .. its unfortunately up to each officer in the moment and the decision they make. You may have done nothing more than chosen a line at immigration staffed by a very pedantic/grumpy/not enough caffeine/too much caffeine/new and applying the guidelines overly keenly /tired /overworked/?????? agent. But yes it is very unsettling. 😢
  2. Its likely that the warning has been recorded on your CBP entry record. Keeping visits short and well spaced out is a good move .. its unfortunately easier to raise CBP concerns rather than to decrease them ..😳
  3. You are an LPR until you are deemed not. That doesnt happen until an immigration judge deems you to have abandoned status or your I407 has been filed. From the USCIS website. Follow the filing instructions. Pretty clear steps. https://www.uscis.gov/i-407 if you are determined to do it at POE i would ask for a supervisor to give it to. I dont think i would risk it sitting in a CBP entry office.. mailing it with a receipt of delivery seems safer
  4. If only it was that predictable or consistent !!
  5. Theres probably a pile of paperwork that CBP is trying to avoid completing!
  6. Print off the form.. fill it in .. hand it over at cbp.. or make a trip to your nearest US consulate .. you will need an appt. You are an LPR until the day you submit the form .. don't get caught with US tax liability by assuming its the day you last left the US
  7. Makes no impact on filing for CR1 .. just one less thing to attend to after immigrating
  8. Authorized reason for non citizen non lpr to be issued a SSN. No problems created and several issues avoided by having one !
  9. Thank you. The K1 would have just expired . Filing for a K1 but not entering should not be an issue for a Canadian .. i believe you do not need a visa for a land entry at least
  10. Need more info .. as asked before .. tell us your status regarding how you enter the US.. and if you still have a current unexpired ESTA or B1/2 visa in your passport. Its not an easy or no answer to your question
  11. Country has no bearing on ESTA being issued. All online and electronic
  12. What is she trying to do ?? Please be very clear about status, dates etc .. better still have the “relative” join and ask her own questions
  13. I was never officially told but i think that the fingerprints taken at POE were not printing well enough .. trouble is they just kept trying using the same prints .. eventually i was sent for new biometrics and voila .. produced But honestly, 6 weeks after POE is the shortest Ive heard of.. and you have the stamped visa foil which is 100% your temporary green card .. so there is nothing about life here in the US that you cant move forward with .. its not like an RFE.. you are already here.. you are an LPR.. you have government issued documentation of your status
  14. System glitch. You don't send fingerprints .. they either reuse ones on file or send you for a biometrics appt.. if it is at the interview stage you will get the letter in a week or so .. if its still at review then waiting is your friend again
  15. I had my status stuck at Being produced for 5 months. Glitches occur. Dont sweat this one yet
  16. Im tending to think it was an “ operator” error and maybe trying SSA again might bring success
  17. Because they can. Its at their discretion and we have been seeing more and more RFE if the tax return is sent rather than the transcript.. despite their own instructions
  18. 2 requiremrnts you must meet under the 5 year rule 1. present in the US for at least 30 months total ( not necessarily 30 months in a row) over the 5 yr period This meets the physical presence requirement 2. Continuity of residence.. no trips out of the US which are longer than 180 days but less than 1 year, unless you have evidence to demonstrate that you maintained domicile in the US during the absence. Absence over 1 year breaks continuity of residence.
  19. No. You can only apply for DCF through the consulate that has jurisdiction for your country of residence . It is not a right to be able to access DCF. It is an opportunity that may be available but is not guaranteed. It is at the discretion of the consulate.
  20. My understanding is that there is no communication of info from the IRS to USCIS But you are likely to get an RFE for your tax transcript.. so you need to sort out the tax return filing
