  2. Because OP didnt pass the N400 requirements .. OP met several ofvthe requirements .. but not all. Not able to be given the “pass” for N400 until the ROC is approved first
  3. It would be prudent to go asap to a Deferred inspection office of CBP. The visa needs the correct stamp as documentation of entry

  5. Yes she can travel. That is one of the reasons for stamping the visa. I used my stamped visa to reenter the US prior to receiving my physical GC It is to be used for this purpose prior to receiving the physical green card

  9. Self employed evidrnce is the most recent tax return. Money can be moved into bank accounts to give the appearance of solvency .. so these don't really carry any weight.. and cant really be verified.. .. i doubt an IO will even look at them.
  10. That the first marriage was bonafide and ongoing and not used for immigration and naturalization purposes. The shorter the time between naturalization, divorce and remarrying the higher the likelihood of scrutiny

Adjustment of status AOS requires you to remain in the US through the process You can apply for work authorization and advance parole card ( which allows you to return if you travel overseas ) but these applications take 8-9 months and until they are approved you cannot work, get a SSNumber, most states will not allow you a drivers licence.. or return to the US if you go overseas ( your AOS will be considered abandoned if you leave the US without this ) The actual AOS process takes 12-18 months. This is no easy route .. lots of challenges that many many underestimate.. are you really ready to not be able to work, drive, travel back to your home country and walk away from your current life /work/study/friends/family for the best part of the next 12 months. Short term gain of being together has cost many couples their long term relationship

Defacto relationships are not recognized by USCIS so unmarried relationships do not void the visa conditions But the history as you described may raise questions about the relationship especially if you have lived apart for many years. The question he will have to answer is “is it a marriage for the purpose of immigration “ You will need strong evidence of a bonafide marriage .

Employees submit payslips as part of their I864 documentation… Self employed do not … the advice you were given related to the other poster’s circumstances .. not yours. Always use the official sources .. as you are doing .. NVC site as above PLUS the instructions sent to the beneficiary ( your mom) from the interviewing consulate. Each consulate has some specific directions and these can add to what is needed

  16. Yes the stamped visa happens on entry. At POE .. When asked to confirm the address for the GC to be sent, you do not need to explain why there will be no GC.. just confirm the address The reason for doing SSN first is otherwise you would have to wait until after the US passport is received. The only downside of getting the SSN using the stamped visa is that it will list the child as an LPR.. after the US passport is in gand, make another trip to SSA snd update the info to citizen

Go to the local SSA office within a few days of arrival with the passport and apply for the SSN in person Make an appt for the US passport application for him for as soon as you can after visiting the SSA office and apply for the passport. The order of these tasks is important as you need to submit the passport with the application.
  20. The I864w is an exemption from the responsibilities of the I864 and your circumstances seem to meet the criteria But the fee for filing is not “exempted”. The fee reflects the NVC costs of the assessment of the documentation The instructions for the I864 state the same info for the fee ..
