  2. I hear your heart. My parents are 94 and in Melbourne. My bag is always packed. Go. You will not regret it. Dont wait any longer past the next appt. If it a no.. just go. Your husband can file the I 130 .. yes it is taking you away.. but .. what of the two options would you regret most in 5 years time… when we immigrate we know this is a big possibility .. that doesn't make it easier when it happens. Im headed to Melbourne in a couple of weeks. PM me if there is anything i can do

Likely to result in extreme questioning at entry.. maybe not the second entry but pretty soon after.. a stern warning perhaps .. notes on your file… refusal of entry if you try after that any sooner than 6+ months … Just my assessment of 15 years of visiting family here on ESTA.. one time where i had an unplanned emergency trip .. 3 days only.. then a planned 3 week visit 10 days later … didnt think i was going to get in. Suggest you find another plan. And definitely do not volunteer,.. tourists don’t volunteer… they visit

  5. If the immigrant enters the US after the 2nd anniversary of the marriage then the visa is endorsed for an IR1 LPR status.. unconditional 10 yr green card… thus avoiding ROC. This happens even if the Visa is issued before the 2nd anniversary as a CR1. Its the date of entry using the visa that is the marker. She can delay entering until the second anniversary of needed.. as long v as the visa is unexpired and the medical still current… usually 6 months but can be shorter

    What country is her citizenship ? If she is not eligible for an ESTA then she will need to apply for a B1/2 visitor visa
  10. The consulate has final say over what is required at their interview. Follow their instructions which will be emailed once they have the application in hand. The usual is “ the original and a photocopy of all documents submitted to CEAC / NVC”. Better to have and not need than ….. The interviewing officer will determine if the joint sponsor is needed
  11. Yes. It still requires the ROC be approved before the N400 can be finalized.. but often it seems to get the ROC finally moving

  13. Yes. 48 month extensions for ROC applications began to be sent out the last few weeks. Its an acknowledgement if the long days in processing ROC

    The ESTA Electronic Travel authorization.. once approved.. is a multi entry visa waiver valid for 2 years. Stay of up to 90 days usually ..
  16. Marry. File I130 asap. The spouse process will be 18-12 months until the visa is in hand. Your temporary stay in Japan will not be an issue. You will need to demonstrate that you will be returning to the USA to live in order to meet your domicile requirements. You must enter the US before or with your immigrant spouse when that time comes. Keep your US state drivers license, voter registration etc current while away.. use a safe reliable address of parents, sibling , friend etc as your US mailing address. Enjoy the experience !!

  18. Boiler is wanting you to realize that what was approved in 12 months was the first step only .. approval of the underlying I 130 petition….not the whole process
  19. Overthinking this. Make the location plans that work for you. Use your parents address until you are settled. Dont forget address change AR11 for your spouse when you do settle. Most people doing what you are doing stay with family and/or use their address for USCIS at least initially The job carries all the evidence weight you need. Honestly USCIS wouldnt care if you were camping in a tent somewhere
  20. Read the instructions. First form is I130. All info is in the instructions on the USCIS website for the I130. Do lots of research on the financial costs for older immigrants especially if they are not planning in working, getting employmemt based healthcare and accumulating 40 SS quarters in order to access SS and Medicare. Lots of good threads on these topics if you search the vj site
  21. Is she immigrating or visiting If immigrating, you can go together through a manned visitor line. If visiting, use separate lines if she has an ESTA.. the ESTA booth is way faster than waiting in line
  22. No risk. Common situation. Thats what I did. 10 weeks out of the US. Thats one of the things the stamped visa is for. Its good to use your time in the US to get your SSN, drivers license, phones, bank accounts etc established
