  1. Apply as soon as they enter using the stamped visa as evidence of their LPR status
  2. Uploading tax transcripts is recommended yes though not mandatory. Easier to submit them with the application online than delay or complicate the process by their absence
  3. Congratulations on the successful interview. The fee is required once the visa is issued, before the physical green card can be manufactured. It can be paid after entry but the recommendation is to pay it as soon as possible after receiving the passport back ..
  4. With a valid, unexpired GC you will be v able to board your flight At POE , if /when challenged- do not sign the I407 to relinquish your LPR status. Tell CBP that you wish to appear before an immigration judge. They are the only ones who can terminate your status. Don't forget to apply for a renewal of your GC as soon as you are eligible. Immigration court will take years .. the outcome of your case is uncertain but you have time to get a competent lawyer, build a life , pay taxes etc and hopefully present a strong case to retain your your status
  5. This is not an uncommon situation. Reenty permit is costly .. but being presumed to have abandoned LPR status is a way bigger issue.. apply for the Reentry permit and stress way less about counting days and wondering if you are going to face tough questioning everytime you renter
  6. I certainly wont hurt .. as it strengthens your financial position .. could she be approved without it.. possibly… but my plan would be to be better safe than sorry
  7. No you cant. You might talk your way round with documents demonstrating you have filed .. but until the NOA1 is issued you are out of status from July 11. That's why it’s recommended to not file so close to your expiry date
  8. Having children only proves you had sex together. Not the strongest evidence, no . The interviewing officer will be looking for financial co-mingling, evidence of shared lives .. wills, beneficiary of insurance etc, shared residence, joint ownership, joint utility accounts .. ….
  9. As above. As stated in the I864 instructions pdf The petitioner files the I864 and adds household member ( spouse) in the appropriate section. Spouse completes the I864A
  10. There are many many posts asking this question here on vj with full and correct answers. Search for these threads See my reply to the OP It is actually clearly stated in the infotmation pdfs for the I 864.. though i agree that it is complex and hard reading / sorting through it
  11. The petitioner is always the primary sponsor even if their income is insufficient.. she completes the I864. As her spouse you are going to combine your income .. she will fill in your details in the “additional household member” section of her I864 and you will complete the I 864a form. Ensure you both have all the required documentation as needed for both forms. Upload everything
  12. Yes whatever visa category you used when admitted to the US yes it is multiple reentry
  13. Yes damage waiver. Lots of different terms depending on country
  14. There may be issues with the current stored biometrics taken at POE.. usually the fingerprints … and during processing of the GC this was noticed. My card was delayed for months because of the quality of my prints at POE. If this is what has happened… . be glad they identified it early
  15. Expect a surcharge if you are under 25 no matter who you hire from. Larger companies like Avis, Hertz etc are kore expensive but usually have better coverage for collision damage etc. Discount companies like Budget, Enterprise are cheaper at the base rare but add extra costs for insurance, one way etc Never rent without including hire company vehicle damage insurance.. you can choose to decline other forms of insurance if you want ..buying a third party hire vehicle insurance often means you need to pay full costs first then claim back for your insurer
  16. Rest of the world speak for rental.. yes
  17. See if you can add her receipt number. If you cant then she will need to set one up
  18. She will get the GC if the fee is paid. 60 days isnt guaranteed. Mine was 7 months. Without the stamp on her IV visa she has no documentation of her LPR status until the GC arrives. No drivers license, no bank account, unable ti complete the documentation to be verified to work. Its an inconvenience yes. Its not your mistake. But it is your problem. Drive to Baltimore
  19. It means you are to use the checklist to prepare the paperwork and documents .. but that you make sure 1. you complete forms in line with the instructions for each form 2. you provide all requested documents as indicated by both the provided checklist AND the forms/instructions 3. you do not send the checklist paper as part of the packet .. don't use it as a cover sheet or contents list The evidence/documents you describe fall under the categories of demonstrating you have met face to face, and that you have a legitimate relationship… as outlined on the I129f instructions. They form part of your application The first section of the checklist .. headed “ Did you provide the following” is for ALL petitioners filing this form The section of this “ checklist” that applies specifically to K1 applicants also list the requirement to state your intention to marry within 90 days of entering the US and evidence that you have met face v to face v within N the prev 2 years Reread the USCIS page again with these things in mind .. hopefully it will make more sense There is a link towards the top of the same page directing you to the pdf instructions. If you haven’t done so already, print off this and read and highlight the sections and documents needed. The checklist is really just a summary of part of the instructions.
  20. Follow the consulate requirements. They have jurisdiction and discretion over the interview and what is required
  21. From memory, you fill it in before you go.. but check if you have to sign it in their presence If in doubt, fill in everything except a signature (if its required) Its been a while since I did mine.. but i think it just saves the officer from having to ask for the information .. they just copy it from the form
