Not sure why this error has not been recognised and corrected well before this stage … it may be a difficult sell to the IO that the error got this far .. i hope all the paperwork associated with the application .. the I 130/ DS 260.. all show consistently correct dates . But that aside.. Attend the interview with the certificates she has .. explain the error and how she is addressing it .. Hope that the IO gives her a 221g paper requesting the correct certificate and putting the application under administrative processing until the corrected certificate is provided.

  3. Unfortunately it’s going to be a challenge probably to do so . As I said, its not just the technical meeting of the rule. Visiting Guam isn’t the same as returning to your residential domicile and living life there.. No no one knows what your IO will decide unfortunately .. No lawyer or us or you .. if denied you can apply in a few years after this travel period is no longer on your 5 year history.. your money is gone either way .. withdrawal or denial.

Its not only judgement on if you met the technical requirement.. but it is also evaluated on perceived intent .. big risk that your 4 day trip might be seen as seeking to avoid the reality of your situation.. which it was.. you visited not lived in Guam.. IMO it’s shaky ground. I would need looking to see if you have other evidence of not having abandoned your US residency ..

  7. Correct wording is important. The USC petitions for their foreign spouse and is always the primary sponsor even if she does not meet the financial requirements . She must demonstrate US domicile. You are the joint sponsor.. you fill out an I 864 but the petitioner is the one who does all the “filing” .. including filing the joint sponsor paperwork Minimum.. she needs to make a quick trip to the US. establish a bank account using your address. Register her with Usps at your address.. use these to get a drivers license, voters registration card, US phone number etc. discuss with school their enrollment policies v and get a letter from the school indicating potential enrollment
  8. Simplest is for her to return to the US and set up house. .. Lease/purchase/utilities, drivers license , offer of employment or contract/ voter registration, bank accounts, credit cards, kids enrolled in school, daycare etc .. The other option is to try to demonstrate intent to establish domicile using many of the things without her staying in the US . May require a trip to the US for her to set some things up .. and some consulates do not accept intent only actual residency Might be good for your B sister to join here and give us first have info re their circumstances. Always lots of wisdom here if we have full accurate info !
  9. If she gains 40 quarter credits and becomes a USC, she will be able to receive SS income and Medicare benefits once both conditions are met and she meets the age requirements for both. This will take at least 10 years after she becomes a USC. So in the long run, yes, this is a good plan. But remember, she has that 10yr plus gap where she will have to either get employment based health insurance or buy it from ACA. The cost may be significant or , depending on location, she may get good premium relief. It all depends on her income and the state rules. Remember also that at tax time, the premium relief is reviewed against what she actually earned .. compared to estimated or previous income.. and this can result in a tax bill for some/all of the premium relief. It can be quite a surprise

  11. Her house hold number for the I 134 will be 2 not 7. But yes she does not meet that financial criteria.

She must be in the US when she applies .. biometrics must v be completed and that usually happens within 2-3 months .. she can then leave and have the Rentry permit sent to the overseas consulate for pick up when it approved . 2. I131 avoids these problems The I131 is only valid for 2 years .. she can apply for another permit but must be in the US to do Applying and receiving naturalization would avoid all these issues. Look into your local field office timeframe for N400. Things are speeding up a bit and it may be able to complete this before then if you move on it immediately
  14. You are already married. Unless you want to divorce her and then remarry her. You can have a party to celebrate /renew your vows to each other … but there is no legal standing/ceremony/recognition of a renewal or celebration

Keep watching your case status on your USCIS. account USPS will not forward this piece of mail .. if not deliverable it will be returned to USCIS 😳

  17. How does the expiry date of your conditional green card compare yo the expiry date of your Drivers License ? Moved to living and working in the US as this topic best fits there.
  18. You cannot update the DS 260 online. Yes give the IO the information at the interview. They will determine what to do with it
  19. Present the info at the interview As the stay was less than 6 months it does not require a police check
  20. Fire the lawyer. Read the instructions. Follow precisely. Do it yourself. Mist of us do it successfully without lawyers

I believe the wording in the NVC letter is “ should not” referring to actions like booking your trip to immigrate, resigning from your job so you can immigrate, selling your house so you can immigrate.. they are saying that you should not assume your visa will be granted.. wait until you have it in hand before making all your immigration arrangements The statement does not relate to your question about traveling as a visitor .
