  1. Adoption of a child (born overseas) by a USC does not bring with it an automatic right to before USC. The process of bringing an adopted child to the US seems to depend on which path of adoption has been followed and whether the adoption is finalised in the US or overseas. There is just not enough information in your post to know which way the adoption is being completed. My “guess” is that unless it is being arranged by an authorised adoption agency following the Hague adoption process, that they will need to need the “Immediate relative process” which can take years and has significant physical custody requirements ( ie parent must live with the child outside the US). Also, the USCIS link identifies some issues with this process when adopting children from Hague convention countries but not through the Hague Process. I hope your nephew is fully researching this prior to any adoption, as he may unfortunately find himself with 2 adopted children who cannot enter the US to live for several years or worst case , cannot enter at all. He needs an adoption immigration specialist before he adopts anyone.

  4. Im a little confused. Are you still outside the US with an immigrant visa in your passport? If yes, what is the name spelling on B your visa .. does it match your passport ?

  7. Who is the LPR filing for ROC.. you or your husband ? If its you, and you decided to divorce , you are still able to proceed with ROC but you must change the application type from joint to divorce and will need the divorce papers before it can be finalized. The ROC process can take several years so you have time to get these documents in hand Firstly get yourself to safely.. consider carefully what you want to do .. if you need to file an intervention order against him , do so…. Changing the ROC status can be done anytime prior to the interview
  8. You could ask at the interview about the instruction, but i am pretty sure you get either 1. shoulder shrug.. No issue 2. explanation that all is digital But, CBP don’t ask about xrays and yes, 8 years later, ours remain on the cd in the bottom of the storage chest .

  17. It can be 3 weeks to 9 months. No rhyme or reason. You haven’t listed your country ,. Z but it’s worth confirming with your country’s consulate that you must return your current payout when applying to renew. I know Australia used to have this policy.. But they no longer do., they just cancel the old passport electronically. If you do have to send it with your application, you could request an ADIT stamp as evidence of your LPR status.   18. Depending on the state she is in.. in many states you have to actually have a low income.. If you have no income then you fall through the gap .. and an LPR can’t get Medicaid in most states.
  19. Your wife as petitioner is always the primary sponsor even when unable to meet the requirements. She must file an I 864 with all required documentation. Her brother is the sole joint sponsor… and he must complete his own I 864 with all documentation . If he is married, it is recommended though not required, for his spouse to file the I 864a

  22. She will need either the GC or a work permit to get a SSN. Work permits used to be processed more quickly than GC and were free if applying at the same time as the AOS.. But now processing times are similar and there is fee .. So its not really a lot of positives in applying for the EAD.
