  1. If it is paid, it is work. If it could be paid, it is work. Volunteering is work. Remote work is work. Household tasks done for your household is not work. Passive income is not work. Gambling is not work.
  2. For your protection, use the number in https://www.uscis.gov/contactcenter under live assistance. Say “info pass”
  3. Your conditional residence expires September 10, 2023. Do file before September 10, 2023, as your expiration date is too close to 9-11 for comfort.
  4. @isis375 She has not been on VJ since April and I consider her the foremost expert. Personally, I would ordered additional copies of the marriage certificate. We have 10 from the county where we married. In lieu of Isis saying what her spouse took to interview, I would order more copies of the paper marriage certificate, and send the one you have to your spouse using DHL.
  5. I prefer to use individual accounts. But while I was watching all San Jose I-485 filers who were interviewed the same week as we were in the sane office get same day approval, while we got nothing, I got religion. Someone on VJ once said: USCIS wants evidence not excuses. So between I-485 interview and I-485 approval, I restructured all our household bills so that they were paid out of a joint account. And each month, auto transferred cash from my individual account to the joint account. We were the third couple in the October 2021 I-751 filers to be approved.
  6. Our I-751 was 77 pages. Our lawyer scanned most documents 2 and 4 to a page. If I were an USCIS supervisor I would give 6 pounders to ISOs I want to fire. 😂
  7. Be prepared to show uscis the math on this. I have never seen the combined tax liability of MFS being lower than MFJ. I would say showing joint bank accounts would be detrimental in this case, because your explanation is at odds with bonafide marital union. Show the PoD declarations. Both
  8. Why not IRS tax return transcripts? Do any of these statements list both spouses? yes I could see this as being useful evidence of bonafide marital union provided you have actual proof you were remote worker at home where your spouse lived. Do either of you have life insurance, 401ks, IRAs, or accounts with a beneficiary designation? If so, show the beneficiary statement that shows spouse as primary beneficiary. Any jointly titled vehicles?
  9. 1. Has she ever applied for a visa to enter the U.S.? 2. “never been divorced” is odd phrasing. Had she ever been married?
  10. And presumably, * you lived with your husband continuously since “resident since” * your husband does not have a criminal record involving a gf while married to you * USCIS will have no reason to think his IRS tax transcripts are fake * your signatures have been consistent since the day his immigration journey started * either no USCIS officers made a home visit or if they did, they found you both living there * if USCIS asked either of you if you owned a TV or a car, you would answer the same * your husband did not enter the U.S. on a B visa and then go to school. * if USCIS officers presented badges to a former landlord, the landlord would had no problems confirming you both lived there. Now maybe some of the above applies in your husband’s case. But if VJ’s terms and conditions permitted gambling, I will wager all of the above does not apply to your husband’s case.
  11. It is exactly 2 years after the “resident since” date on the gc, assuming the date was on or after I-485 was filed, or the beneficiary entered the U.S. on a CR visa.
  12. I recommend everyone go to the visitors’ line. We did when my fiancee entered as a K-1. We did at airports where LPRs have been relegated to visitors’ line. No point risking an armed CBP officer screaming at us. That worker: * is not a CBP employer * was correct that family stays together (for several reasons this is pretty much required) * incorrect to have directed your party to the U.S. citizen line The advice was good and it is not fraud as long as the LPRs are honest about how long they have been absent. At some CBP ports of entry, the station boss has a “no I-407” policy and thus a “no NTA for abandonment” policy. Eventually the LPR will get a CBP officer that has a finding of abandonment. The LPR can still enter the U.S., and * opt to contest the finding, * file I-407 at port of entry in exchange for a 6 monthly entry stamp on a B status, * file I-407 just before leaving the U.S., or * file I-407 after leaving the U.S., with the choice of USCIS or embassy processing
  13. Criminal record (“DV” charge and jail from a gf OP had after marrying), infidelity, no one home during home visits, accusations of forged documents, going to school on a B visa, living separately at times. In the DIY WoM post, OP noted that 99 percent of the time, USCIS is willing to settle. This is a 1 percent case.
  14. Pretty easy to fake an IRS tax transcript and the NOIT (NOID?) says USCIS believes they are fakes.
  15. USCIS believes: * she did not sign * she does not live with you * your tax returns are fake yes. because I-751 is denied It is quiet because your I-751 was denied. If you do nothing, you are going to get a Notice to Appear in front of an immigration judge. You will have a final opportunity to make your case for removal of conditions. If you fail, given your criminal record, I expect you will be deported.
  16. If so, perhaps the lawyer was unable to rebut the accusations of forging signatures and government documents. A lawyer would use all svailable ways people who are inadmissible manage to stay in the U.S. indefinitely with work authorization.
  17. Oh. This was your previous thread. https://www.visajourney.com/forums/topic/787709-suing-uscis-due-to-extremely-long-roc-wait-time/#comments I am not surprised I-751 was denied. You need a lawyer. And that’s it.
  18. 1. Did your husband know his former spouse before he applied for his student visa? 2. Are your husband and you from the same country? Seems so. There are lawyers will accept her money, but I have never heard of a lawyer having any effect in this situation.
