  1. Listing her on I-129F merely enables her to file DS-160 to get a K-2. She does not have to. If she does not enter the U.S. on a K-2 within a year of her mother entering on a K-1, she will have to enter on an immigration visa, ideally filed as a result of an I-130 filed by you. So no notice to U.S. government needed. During K-1 interview the topic might come up.
  2. Then afaik, you have not applied for anything with respect to her children. At least not through I-129F. Is her daughter your biological daughter?
  3. Every non immigrant visitor is presumed to have immigration intent. Her word that she intends to file I-485 will be accepted by the CBP officer. And over 99 percent of the time, the officer will suggest she withdraw her application to enter the U.S. (or worse). Her I-130 and her statement are all it takes. I think the point being made by @igoyougoduke is that when people ask the question that was in your OP, they should ask what will happen if they are honest about their intentions at the port of entry, in addition to being honest to readers of forums like visa journey. We would never advise lying to an immigration officer. https://www.visajourney.com/timeline/irstats.php?history=90 311 days between I-130 approval and interview. Japan might be faster. They is just one record for Japan in the last 90 days, and it is 132 days. For the past year, for Japan it is 5 cases averaging 124 days.
  4. Delay your case until you have filed your 2024 tax return if this concerns you.
  5. That seems inconsistent with https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/Egypt.html “Issuing Authority: Maazoun, Ministry of Justice (in the case of non-traditional divorces otherwise prohibited by the religious authority), CSO”
  6. NVC told OP case was If there in fact is no visa number, then DoS has complete control to retrogress, and in fact has had 13 opportunities to do so. WoM seems appropriate. Would love to see an AUSA explain this to a judge. But I think AUSA is going to tell NVC to schedule the interview.
  7. What a cluster. There is no lawful change of name document. Yikes! He should get a new passport. I believe I-130 asks for other names used. Make sure to mention those. That is fine
  8. Give it a try. 1. Why is lease in one name 2. why is the joint bank account dormant? 3. did your spouse file I-865?
  9. Are you filing I-130 for him? Canadian citizens get a new passport number with each new passport. What does “english” in quotes mean? Are all the characters for all his names in the English 26 character alphabet or something else?
  10. OP’s timeline for the wife is a bit of a mess, but it is safe to deduce she became an LPR in 2010. If she filed I-130 in 2010, then her son’s PD is current. From the June visa bulletin, F2B, Philippines: 22OCT11 - final action 01OCT13 - date of filing The presumed filing date, 2010 is before either date. So a visa number is available. This has not been the case of Filipinos for a while, assuming it ever was. From the June visa bulletin, F1, Philippines: 01MAR12 - Final Action 22APR15 - date of filing As you can see F1s from the Philippines wait less than F2Bs from the Philippines.
  11. I saw something on VJ this month where a civil document was written in several languages, including English, and there was still an RFE for a translation. Get a certified translation.
  12. The NOA1 does not buy you much. Your bigger concern should be if it was mailed to the correct address. Review your copy of the I-129F you sent. The I-129F approval, aka NOA2, is a valuable document you do not want to lose when it is sent.
  13. If his date in the final action chart has been current for over a year, then his mother can file a writ of mandamus. @igoyougoduke
  14. Morocco has no jurisdiction. If you both live in the same state, then you get divorced in that state.
  15. No Was the above meant for another topic? Oh. I am not seeing a successful path to getting a K or immigration visa for you.
  16. CR-1 In the past 4 years how many meetings?
