In your evidence that you upload for NVC include a note requesting the correction. 4. At the interview, correct it. 5. Correct the visa if the name is still not correct. 6. File I-90 if the name is wrong on your green card 7. File N-400 with the correct name, and 8. Refuse to take oath of citizenship until the naturalization certificate is correct.

  14. This is NVC we are discussing. I have low expectations. yes. I know of no other way. It will have to be, because the name on visa must match the name on the passport, which in turn must match the name on the birth certificate.
  15. If it was a 3 year ban, I would suggest leaving to serve out the 2 year home residency rule and 3 year ban. Since it is a 10 year ban, it is worth finding a competent lawyer to see if it makes sense to appeal the denial of I-612. If not, then you will still want a waiver of the 10 year ban. Did your current lawyer advise you that if I-612 was denied, that you would be banned for 10 years?
  16. File N-400 in June 2025 under the 5 year rule. Today (and I do mean today) he should download all his IRS Tax Return Transcripts from irs.gov. This way, when he is ready to file in 23 months, he will have all 5 years of tax return transcripts: 2020, 2021, 2022, 2023, 2024
  17. Why would you wait until Sep 2023? To review: Arguably at this point continuous 3 year marital union was broken. So you will move to Utah in April 2024. The 3 year clock for martial union would complete in April 2027. Meanwhile his 5 year filing window will open June 2025. If money is no object, he should file N-400 today (since we are inside 90 days from his 3 year LPR anniversary) and let the ISO decide if 3 year marital union was broken.
  18. Per your own words he has not received a green card because from where I am posting it is July 2023. So perhaps reply to this comment with a correct “resident since” date.
