  2. This sounds like a seller financed loan. The interest from payments is income. The principal is not: it adds to her assets. The problem is that the nature of loan amortization is that income declines over time. So ideally for you, the principal is invested, and it produces investment returns. It is possible this will be required.

  7. The question and answer that matters is why didn’t your son petition your husband? The (truthful) reasons others had to that question are only relevant if their answers are the same as what your answer will be. So for example, if, hypothetically, it comes out that you plan to spend most of your time with your husband and use your green card as a way to visit the U.S. with more ease, that is an invalid use of a green card, and I would expect the IR-5 to be denied.

  10. I do not know where the child was born or where the father resided at the time the son was a minor, so I was not about to rule out a third way to legitimate the son. In any case, since it appears there was a relationship of sorts between the father and son before the latter reached age 21, the possibility the son can petition the father is in play.
