Greencard adjustment of status
Mike E replied to Acslate's topic in Removing Conditions on Residency General Discussion
sorry read, and you filed this in the adjustment of status forum. Yeah that is moving to live overseas for a year. You will have to attend the I-751 interview and before that file I-865 to show your change of address. -

DS-260 is at least one way to have sought a visa. Filing the affidavit of support is another. -
Greencard adjustment of status
Mike E replied to Acslate's topic in Removing Conditions on Residency General Discussion
You have to sign I-864 and if you move overseas, I-865. You will also have to attend the I-485 interview in person. if you are not be living with her, she will not be eligible for I-485 approval. 1. Does she have an SSN now? 2. How is she adjusting from K-1 if she was your wife before she entered the U.S.? -

F2A Aging Out
Mike E replied to Bere's topic in Bringing Family Members of Permanent Residents to America
Cspa DOB is 3/9/2003 + ( 9/27/2022 - 1/18/2021 ) = 3/9/2003 + 617 = 11/15/2004 On 9/27/2002, the F2A was current on both charts. Did the beneficiary seek a visa? -

I-130 process for a daughter
Mike E replied to rooji's topic in Bringing Family Members of US Citizens to America
As per your other topic, her daughters birth certificates have the father’s other wife as the the mother. There is no pathway for the daughters through their maternal ancestors. -
K1 VISA QUESTIONS / CONCERNS [merged threads]
Mike E replied to Adze's topic in K-1 Fiance(e) Visa Process & Procedures
You can email the consulate, noting the I-129F expiration date. If, 2 weeks before I-129F expires the embassy has remained mute, I would file DS-160. -

yes Cannot hurt to inform NVC and the consulate that the beneficiary remains interested in the visa despite the petition expiring. -
K1 VISA QUESTIONS / CONCERNS [merged threads]
Mike E replied to Adze's topic in K-1 Fiance(e) Visa Process & Procedures
As long as the beneficiary is actively seeking a visa, then the expiration of the approved I-129F petition should be extended by the State Department until the K-1 is denied or approved. -
Interesting phrase. What country is that? The title suggests 6 months in another country. I believe that would invalidate the visa because of the requirement to get police certificates from any country where you have lived 6 months. Fortunately, DoS has a neat trick to keep people from shooting themselves in the foot: And the exam is 6 months or less before the visa expires. So 6 months in a third country is not possible. I have seen on visajourney, visas get canceled weeks after they were issued. I advise the beneficiary to book the next flight to the U.S. as soon as the visa is in hand.

Changing last name after filing I130
Mike E replied to Lauren05's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
No issue. I suggest submitting a letter stating you are taking your spouse’s name, and include a copy of your DL or U.S. passport and your marriage certificate. For the beneficiary I am always argue to change the name either before I-130 or after (and not as a part of N-400), but the petitioner is a free agent. Hopefully you have several official copies of the marriage certificate in case any agency wants to hold a copy for examination. Start your name change with SSA. And for that, take the opportunity to drop the middle name(s) if you have any, since SSA policy is that middle names do not exist. -
Electric vehicles have an efficiency problem
Mike E replied to Nature Boy 2.0's topic in Current Events and Hot Social Topics
Agreed and not just the EVs themselves but the infrastructure: * charging * repair Tesla had 1.4M cars on U.S. roads by the end of 2022. Its charging network is more than sufficient for all those cars. But * there are entire states without a Tesla repair shop. * it usually takes 2 weeks to get a service appointment And the legacy automakers nominally can repair the EVs they make at any dealer, but the reality most dealers do not have technicians who can repair their EVs. I can see individual medium sized cities in the sun belt adopting a mandate by 2030, but anything beyond that is not feasible. This mandate will be pushed repeatably like the REAL ID man date. If the Dems do stick to it, they will swing more elections to the GOP. The urgency to switch is not needed. -

Disruptive technology always has flaws compared to things they replace. Then they get better and the old thing falls into disuse. That’s why you stopped using a slide ruler in 1975, even though that Digimatic 8 from Sears cost 10 times more, needed a power source, and didn’t have logarithms. -

Most do, unless based on the 3 year rule and their spouse’s state of birth makes it illegal to photo copy a birth certificate. -
Adopt her. Once the adoption is complete she is a U.S. citizen and she bypasses I-751.

Electric vehicles have an efficiency problem
Mike E replied to Nature Boy 2.0's topic in Current Events and Hot Social Topics
Exactly. I have always used a similar term: “smartphone with 4 wheels” because there is in fact a phone built into a Tesla. Most of the bad experience was because this was a rental. Several functions are most easily available from the Tesla smartphone app. The car is bound to a phone by the owner or lease holder. A renter is neither. * no owners manual? It is accessible from the Tesla phone app. * hard to lock car? The phone makes it easy. But I just do “walk away” locking on my Tesla , which is a setting on the car I am sure there are higher end ICEVs with the same issues now. Cars that generally are not rented by most people. My other car is a 2007 Mercedes E350, and for its time, the level of technology is impressive compared to other cars made that model year. I will guess 2024 E350 works the same way as a Tesla in terms of locking, manual, etc. The original Tesla S and Tesla X had a display screen behind the wheel and center touch screen cleanly integrated into the center dash. The steering wheel had all those tactile controls. When using navigation, both screens had map and guidance. Then the Model 3 and Y came out with the giant tablet bolted onto the center dash abf bi behind the wheel screen or tactile wheel controls. Which was fine: lower end car and if you wanted higher end features, buy an S or X. But then the S and X were refreshed and now the experience is the same: Also, I did not understand the whining about being unable to find super chargers. Not a problem IME unless they were not using interstates. Tesla has these Destination Chargers at hotels and too many people think they are supposed to be a primary solution for charging while on road trips. They are not and never will be. Road trips are typically 600 miles per day. One would charge and EV up to 90 pct and drain it to 10 pct, leaving 80 pct of range. 600/0.8 = 750 mile range battery. Even if one had a 750 mile battery, it is physically impossible to charge 600 miles over night at a level 2 charger with current materials. The car would have to weigh a third of what it does now, which might be possible if the frame is cast or 3D printed as single truss, but my god the manufacturing cost. Tesla should kill Hotel Destination Chargers as too many people are confused by them. Instead it should go all in on Super Chargers. A level 2 charger partnership with AirBnB / VRBO makes sense though. If you are spending a week or more somewhere, it is like being at home: * you do want to a dedicated level 3 charger where you sleep. * you also are not charging 600 miles a day. -
It does not count as an absence. Even if you stay just one night, it does not count because the day you depart the U.S. and the day you return to the U.S. count as days in the U.S. Days counted in the U.S. cannot count as days absent from the U.S. day trip : 1 day of presence : 0 days of absence 1 night away : 2 days of presence : 0 days of absence 2 nights away : 2 days of presence: 1 day of absence 3 nights away : 2 days of presence : 2 days of absence …
