  1. As you are a U.S. citizen it is possible you have standing to force a yes but I am not sure if that applies to derivative. The case law on this is relatively new.
  2. For the sake of the 14 year old it is time for your sister to consider the greater good and accept her visa and those for her children. Had your sister accepted her visa 3 years ago she would have had 2 more years today to file for citizenship. And the 24 year old would be on glide path to citizenship As a U.S. citizen your sister would have standing to force a yes.
  3. WoM is just going force a no. How old are the kids? Who is the petitioner? Had your sister accepted her visa she would have had 2 more years today to file for citizenship As a U.S. citizen your sister would have standing to force a yes.
  4. I am sorry for your loss. If the previous visa is still valid, try to get the passport back today and go fly to USA before it expires.
  5. Some new cases are being processed LIFO (3 months or less) or FIFO (15 months or more). You won’t know which queue you end up in until you file.
  6. Perhaps George P Bush will primary Cruz? Maybe the great W himself? I am truly intrigued about who is slated to beat Cruz in the primaries. https://en.m.wikipedia.org/wiki/2024_United_States_Senate_election_in_Texas has a list of potentials, of whom I’ve only heard of Ken Paxton. If the polls show Cruz winning a the presidency then I expect a primary challenge so that runner up can position her or him self to be appointed Senator if Cruz does become president (which will take months even if elected since he will have to beat a charge that he is not natural born). And in that scenario the field of primary challengers widens considerably. But I don’t see anyone beating Cruz in the Senate primary.
  7. if the online form lets you enter Soviet Union or USSR I think it should be entered. Soviet Union or USSR
  8. You are welcome. Also let me take the opportunity to congratulate you on timing the point of entry to avoid removal of conditions (I-751). All newly weds / newly engaged should follow your example.
  9. https://edition.cnn.com/2022/12/28/politics/us-covid-measures-travelers-china/index.html US to require travelers from China to show negative Covid-19 test result before flight By Arlette Saenz, Kevin Liptak and Nikki Carvajal, CNN Updated 9:10 PM EST, Wed December 28, 2022 CNN — The United States will require all travelers from China to show a negative Covid-19 test result before flying to the country as Beijing’s rapid easing of Covid-19 restrictions leads to a surge in cases. ….
  10. That is not always true. I dare say is usually not true. The law says you should get a 10 year gc.
  11. Welcome to America. Please stay a while.
  12. You should have an applied for an SSN 2 working days after point of entry. Apply now. Even if you get a denial, that denial letter should be able let you get past the SSN requirement from the Florida motor vehicles department. See https://www.flhsmv.gov/driver-licenses-id-cards/what-to-bring/frequently-asked-questions/
  13. 1. Does USCIS have the PO Box on record for the beneficiary and sponsor(s)? 2. Is the plan to have no physical address in the USA for 4 months? 3. Can the petitioner be credited with 40 or more social security quarters?
  14. Yes. The pattern is repeatable and I’ve never seen an RFE for a medical followed by an interview. Regardless it doesn’t matter. Failure to respond to RFEs produces a denial.
  15. @ImmigrantKrish My research on the web shows lawyers divided on this issue. Some say you don’t have to disclose such tickets. It was under $500, right? If so, I would not (and did not) disclose. If you do disclose, I’ve seen such cases held in limbo because the ISO insists the applicant produce evidence the ticket was resolved and the applicant cannot produce it for the reasons you are seeing.
  16. And if you wait until the date of the biometrics and are denied entry in RI, and can’t reach USCIS before the appointment time to reschedule, your case will be denied. I am trying to help you. I am advising you try something that has succeeded in the past. If you try today and get denied, then you know that your next move should be to reschedule the biometrics. Or return to Texas, bring the biometrics letter and your AR-11 to your field office a day before the appointment and try. You might be allowed in. You might be told to comeback the next day. Or you might be told to just go away. If the latter you can reschedule. Best wishes for your immigration journey.
  17. did you move? She can try walking into another office now and see what happens. Experiences vary. Some advise waiting until traffic is light. Some just get turned away. I don’t know if Johnston does biometrics. I would try the ASC
  18. She needs to book international flight and cruse reservations in her passport name and carry an original marriage certificate When she gets a U.S. passport she can book in her real name except when traveling to her country of origin. Or she can renounce that citizenship if her country allows that.
  19. 1. country of citizenship matters for Florida. 2. Have you applied for an an SSN yet? 3.. Are you following the steps in
  20. Also just so you aren’t surprised, I gather your N-400 was filed on the the basis of a 3 year marital union to U.S. citizen. I believe once you convert I-751 to a divorce waiver, you won’t be eligible to naturalize under the 3 year rule. Thus is part of the reason I suggest you also tick the abuse box on your amended I-751: so you can naturalize under the 3 year rule. A lawyer will navigate this with you.
