Your parent can start the process by filing I-130 now and does not have to live in the U.S. now. However before you are issued a IR-2 visa, your parent would complete an I-864 that convinces a visa officer of the intent to move to the U.S. On day you travel to the U.S. on your IR-2 your parent must either be traveling with you or must already be inside the U.S. Depending on how much physical presence your parent or your parent’s U.S. citizen parent had in the U.S. before you were born, your parent could have filed N-600K and obtained your U.S. citizenship. This process had to have completed before you reached age 18. It is too bad too many younger folks wait until age 18 to ask these questions. -

If the Dems do go after Santos, the GOP will weaponize going after politicians who lie. They are already planning to weaponize tax returns. We all want to know how Nancy Pelosi achieved a net worth of $100M. And we will find out. I am looking forward to all of this. -

Actually if I were in your situation in would prefer to not be using CBP pre-clearance. Your first challenge is getting past airline check in to reach CBP pre-clearance. Your second challenge is getting CBP to accept anything but an original extension letter. CBP’s policy is clearly written. A non original extension letter is not acceptable for boarding a flight. So you can try it but I am skeptical it will work. Unlike the rest of the crowd, I agree with you about printing your copy of extension letter on thick green tinged paper as that might help you get past airline check in Dublin. But then you are at the mercy of CBP who can deny boarding. Do not represent your extension letter to CBP as an original document. Make it clear to CBP it is a copy. Since it will be A4 and not U.S. letter size it should be obvious to CBP it is a copy. The alternative is to use your visa waiver to fly to Canada or Mexico and then enter the USA on foot. You might have to pay the I-193 fee. How long have you been outside the U.S.?

Yes. We see this several times a month. I always recommend getting a passport card too so that if one document is lost once can easily use the other to get a replacement. In the future he might need a certificate of citizenship. Plus it Wilbur a third proof of U.S. citizenship. So it is a good idea. Since the father was able to petition his son for a green card, paternity was already established by the department of state So I don’t see it being an issue for a U.S. passport and passport card. Thus when he was under 18 and had a green card, all his surviving custodial parents became citizens, making him a citizen. -

I think if Santos can be arrested / convicted / sentenced / removed from office for lying so can every politician. I trust after the police in NY are finished with Santos they will deal with Biden next. -

No. I-130 for spouses of US citizens is between 10.5 and 16 months with Vermont being the outlier. My understanding is that the tough cases go to a Vermont. Also my understanding is that consulates are giving higher priority to CR-1 than K-1 while the backlog continues.

Before that act, both parents had to be or become citizens before the child reached age 18 in order for the child to become a citizen. So had his mother still been alive when he was 18, he likely would not be a citizen now. But sadly she passed away before he reached age 18. So that produces the outcome that he is a citizen. I’m sure he would rather still have his mother than be a citizen, but such is life. -

Sadly that just made it clear cut. He is a U.S. citizen. N-400 will be denied. He should apply for a U.S. passport and passport card at a post office. He needs: * green card (make copies front and back cuz he might not get it back) * birth certificate * death certificate of mother * marriage certificate of parents (if they were married) * naturalization certificate of father * proof he lived with his father on or after the day his father naturalized and before he reached age 18. 30 years after the fact this can be hard to prove. But it won’t be hard for a private investigator. Make 2 copies of all of the above. Keep one copy for himself and one to give to passport office with originals. The originals should be returned. Once gets his passport, he should then should apply online to file N-600 to get a certificate of citizenship. He should include a scan of his U.S. passport and passport card in his N-600 application along with all the other evidence he provided to get his U.S. passport n That’s it. -
Climate changists like to shame people who run the A/C, use golf courses built on the desert watered with recycled water, have a back yard pool, etc. The only reason North America north of the Rio Grande has civilization is because Europeans sailed over and brought technology and domesticated animals. The previous inhabitants killed off the horses. Llamas and alpacas aren’t exactly going to sustain mixed agriculture like sheep, hogs, and cattle. The original inhabitants did try and you can read about the Mound civilizations. But the wind and cold just flattened them.

2022 - 47 = 1975. He was born before 1983 so he does not benefit from the child citizenship act of 2000. This makes it more complicated. Tell us more about his mother. 1. Did she become a U.S. citizen? 2. Was she alive when your husband reached age 18? 3. Was she married to his father? -

In some cases a K-1 is forced to get a medical a second time once in the USA. With CR-1 it is one and done. K-1 is just a much more complicated and expensive process. I am mystified as to why people are drawn to K-1. Unless the alien fiancé(e) has older kids K-1 is the worst of all choices.

If you can’t then get married in Vegas or do Utah zoom wedding. The fact he plans to go Monday when it is a holiday suggests to me that there are problems with the planning. It’s probably cheaper to hire an immigration journey who understands I-864 issues than it is to leave the country. I know there are people who have successfully navigated I-864 with VA compensation and expect they will be replying to your post shortly. Generally I advise those who didn’t have to file tax returns to file regardless if they want to petition relative for a green card as this is less taxing of the minds of ISOs examining your petition. Hang in there. I leave you with this: consider that by definition, 50 percent of the population has an IQ under 100. Have you ever wondered where they are? Because I don’t encounter them from day to day. I believe a large segment of them work at USCIS.
