N-400 Application - Additional Evidence
Mike E replied to kiwirst's topic in US Citizenship General Discussion
When filing N-400 on the basis of being married 3 years to a U.S. citizen, you need evidence of bonafide marital union. You have obviously been an LPR for more than 5 years. You do not have to provide evidence of bonafide marital union for the past 3 years File under 5 year rule. The evidence required for most cases is light. 5 years of the most recent IRS tax transcripts. And some people don’t even have to provide that. -

N-400 Application - Additional Evidence
Mike E replied to kiwirst's topic in US Citizenship General Discussion
You should not. If your I-751 was from 2013, then you don’t need joint account statements. File under the 5 year rule. It is simpler. -
You might have a 10 year ban due to over stay. However, the topic of F-1 over stay is complicated and I suggest hiring an attorney, as sometimes F-1 visa holders thing they’ve overstayed and they really haven’t. Or they overstayed but not as long as they think. A 3 year ban would hardly matter given processing times for K and IR visas. Even though same sex marriage is illegal where you live, it is not illegal in Utah county, Utah, USA. You can get married online through Utah county and once you meet in person, file I-130 to start your IR-1 visa process. https://www.utahcounty.gov/dept/clerkaud/PassMarr/RemoteAppearanceFAQ.asp

N-400 Application - Additional Evidence
Mike E replied to kiwirst's topic in US Citizenship General Discussion
Yes. We included all our I-751 evidence plus * another 4 statements for each joint account for the year after we filed I-751 * Since we filed N-400 in November 2022, we also had statements for October, September, and August to show that the applicant resided in Arizona for 3 months before filing. Since we changed states between filing I-751 and filing N-400 -
N-400 Application - Additional Evidence

We don’t have a mortgage but we sent one statement for each joint account for every three months. We also included one statement for each joint account for each of the three months preceding filing N-400. This was for evidence of continuous residency of 3 months in the state where we filed N-400. -

Three miracles in row. Buy some lottery tickets. Make a legal bet on the superbowl. And stay home for 5 years. Congratulations.

Can I travel to my country while N400 pending?
Mike E replied to dnhk's topic in US Citizenship General Discussion
No, because you said since you became an LPR, you had just one absence from the USA for 31 days. So your physical presence was roughly 5 * 365 - 31 = 1,794 days. Based on the what you’ve written, you can safely travel. -
Can I travel to my country while N400 pending?
Mike E replied to dnhk's topic in US Citizenship General Discussion
1. When did you file N-400? 2. How many days of physical presence did you have when you filed N-400? 3. How many days of physical presence will you have between the date you filed N-400 and the date of your trip? There is law and policy when it comes to residency and physical presence after you file N-400. A. By policy, USCIS enforces 50 percent physical presence looking back 5 years from each of the date of filing, date of interview, and date of oath. B. By law, the 5 year look back does not apply after N-400 is filed, but you are expected to maintain continuous residency after filing N-400 which implies 50 percent physical presence from: * date of filing to interview * date of filing to oath I see (A) enforced all the time with cases denied. I’ve never seen (B) enforced. -

The underlined is not a requirement to immigrate on the basis of a spousal petition. Also OP asked how to marry not how to immigrate. -

https://guides.sll.texas.gov/marriage-in-texas/conducting-the-ceremony Ceremonies with Texas Prisoners Previously, Texas law allowed prisoners to marry by proxy, a process that allows an appointed person to stand in for the absent applicant at the ceremony. Section 2.203 of the Texas Family Code was amended in 2013, and now proxy marriages are only available to active-duty military members stationed in another country. For those wishing to formally marry someone who is currently incarcerated with the Texas Department of Criminal Justice (TDCJ), a wedding ceremony will need to be conducted on TDCJ property. See the resources below for how to apply for a ceremony with the Department. Administrative Directive AD-03.42. Offender Marriages [PDF] Rules issued by the Texas Department of Criminal Justice on how prisoners can get married while incarcerated. Application of Person Requesting to Perform a Marriage [PDF] As stated in AD-03.42, an individual seeking to perform a marriage on TDCJ property or contracted facilities shall complete this application and submit it to the Access to Courts headquarters at least one week prior to the scheduled marriage date. Offender Rules And Regulations For Visitation [PDF] Rules issued by the Texas Department of Criminal Justice on prisoner visitation. It includes marriage ceremony rules related to eligibility, attire and prohibited items. -

Whether the documents were really there when he was VP or planted after he became president is beside the point according to a hypothesis I heard The point is that the fact the story was reported is an indication the Democrat Party wants to dump Biden from the 2024 nomination, and since he won’t go gently, now it is hardball.

Yes the woke and left have moved into majority depraved. This shift was predicted by Anthony Burgess in his 1962 novel “A Clockwork Orange”. I never read it but did see the 1971 movie delivered by Stanley Kubrick in the 1980s. Based on the plot comparison listed in Wikipedia I think Kubrick got it right. Despite America, Canada, and UK being firmly in grip of the right wing at the time I watched it, the movie rang true as it would for anyone who attended public university in any of those countries. Even if these perverts are convicted and sentenced to prison, it remains to be seen if this will will dissuade the other perverts in schools and on school boards from depravity. My prediction is the next Democrat or RINO Governor of the state will pardon, commute, and re-instate. “Singin’ in the rain, I’m singin’ in the rain, …”

No and that’s the “last mile” problem of your ordeal. Once usps.com tells you the day the card is going to be delivered, get a chair and sit near your mail box to await the carrier all day. If the carrier fails to deliver, chase after the carrier to get your card. A gc delivered to the wrong mail box is something I see several times a year. Those who aren’t proactive have years of agony. Don’t expect your next gc to be produced as fast. Seize this opportunity. You went through and survived a hellacious CBP secondary. You can do this.
