  1. So if someone is denied entry, my understanding is that it can go one of two ways: 1. The alien is permitted to withdraw the application to enter the U.S. 2. The alien is given an expedited removal. Is this correct?
  2. RoC won’t be abolished and if it is, you under estimate Congress. Congress could for example add a divorce waiver to I-90 if the gc was obtained through a spousal petition and couple is divorced. Ditto N-400. Rarely does congress simplify anything.

  4. Why did you leave the U.S. with a a defective gc if this worries you? What is the nature of error? Is it MM/DD/YY vs DD/MM/YY or something else? You've a 2 year gc. My belief is that you if you file I-90 now, given processing times, you will never get replacement 2 year gc with the correct date of birth. Not before you're gc expires, and not before your 3 year extension letter expires. So I would do nothing about it now unless the airline refuses to board you. If so, file I-131a to get a boarding foil or travel to Canada or Mexico and enter via the land border. If at the land border, you can request CBP give you an I-551 stamp. They probably won't but if you don't ask the answer is always no. Once state side, if you want USCIS to give you an I-551 stamp, you will first have to file I-90 (it won't cost anything if it was USCIS's fault). Once you have an I-90 receipt you can request an I-551 stamp. If you get an I-551 stamp, expect to surrender your gc.

  7. There are more immigration visas than K visas and so your document translator is not familiar with the K-1 process at Ankara. Indeed for some consulates, K-1 visas are rarely applied for and even more rarely issued. Perhaps Ankara is in that category.
  8. I don’t know of any other visa besides K-1 for fiancé cases. You should get familiar with the process, as not knowing your visa type you are fortunate to have gotten this far. This is a good over view: Then there is no upload.
  9. NVC doesn’t manage K-1 cases and so each consulate has their own procedures. Not knowing your consulate I can’t answer your question. Some consulates want documents: * dropped off before the interview. * sent by courier * sent by mail * emailed * uploaded to ustraveldocs.com * brought to the interview At Rangoon where my wife interviewed, the policy used to be drop off and then it changed to a combination of email and bring to interview.

    Current income is what matters Is this an I-134 for a K-1? Where do you upload an I-134 for a K-1? Procedures vary by embassy so I suppose it might be possible.
  12. 1. Does he live with you? 2. Do you have legal custody? If the answers to 1 and 2 are both yes between the date I-485 is approved and the day before he reaches age 18, he is a U.S. citizen. Are any of these true: * you are currently married to his other parent * he was born out of wedlock and you remain unmarried to his other parent * his other parent deceased * you are divorced from his other parent and you have a legal custody agreement or court order that grants you full or partial custody If any of above are true you have legal custody. If the other parent is alive, and has full custody, that parent might be willing to grant you (or not contest your bid for) legal custody several months before your son reaches age 18. The above isn’t an exhaustive list but covers the majority of cases Now is the time to document he lived with you and that you have legal custody. You should then give a copy of this to your son and the person you’ve designated as his guardian should you pass away.
  13. IME that gap between marriages is not an issue, but that could be because we were fortunate. We did have a tough ISO so if it disturbed him he would have brought it up. I think the real issue is the length of the previous marriage that enables the one to become a citizen and thus be in a position to petition someone else. My first marriage lasted 30 years. Less than two years later remarried, and 2 years after that used my naturalization certificate to get a green card for my second wife.
  14. A California school district claiming no experience with foreign vaccination records is an either a lying school district or its students perform poorly. So poorly that affluent immigrants either refuse to send their kids to public school there, or they live in a school district where homes cost more because the school district is higher performing. Don’t re-jab your kids. Doctors can order titer blood tests to verify their vaccinations.

Add another year for NVC and consular processing and that’s: 2023 - 2007 + 1 = 17 years. It’s worse because if you look at the February 2018 bulletin ( https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2018/visa-bulletin-for-february-2018.html ) cases filed 22JUL04 were being considered by NVC 2018 - 2004 + 1 = 15 So in 5 years the wait grew by 2 years. This adds 16 / 5 * 2 = 6 years to sibling petitions filed today. so 17 + 6 = 23 years: my prediction for when she will get a gc. In 22 years when it goes to NVC she need documents like police certificates, your spouse tax info, etc which would be pointless to gather now. https://www.uscis.gov/i-130 has a checklist of documents needed today.

  18. Too soon to worry. Set up usps informed delivery. Cards do sometimes arrive before the status has changed. Lesson leaned: if an ISO says you are approved, slide your passport over and ask for an I-551. The answer will say if you are actually approved or not.
