    What about the "what could happen" factor after the arrival of beneficiary? You forgot 4 outcomes of the situation:

    Girl loves Guy A and says "Goodbye" to Guy B :blush:

    or

    Girl loves Guy B and says "Goodbye" to Guy A :blush:

    or

    Guy A loves Guy B and vice-versa. Both say "Goodbye" to Girl. :yes:

    or

    Girl, Guy A, & Guy B all say "Goodbye" to each other.

  2. OP!: please come back and clarify the tax situation. Are you being claimed?

    This is what she said from her first post, "Either of my parents could qualify for this but I think my boyfriend would be the best choice as I am a dependent on his taxes and live soley with him". She has got to submit her tax returns for the K-1. It's going to state on her taxes who was able to claim her as a dependent on their taxes. This may be the roadblock to filing any time soon. :o

  3. Isn't there a box on the Federal 1040 that asks if you're being someone else is claiming you as a dependent on your tax returns? If your boyfriend is, as the original poster has stated, how is this being done? They're not married. She's not receiving full-time medical care. She's not under the age of 18. How? I am very curious. If the original poster has to submit her previous tax returns as required for a K-1 petitiion, it's going to say the person who the person is that has claimed her on their taxes. Am I right? Or have I missed something? :unsure:

  4. There seems to be no fraud attempt. No use stating what isn't there. I don't remember reading anywhere stating in the visa guidelines anything about "love". I've only read that the person(s) applying for a K-1 have to prove a legitimate, ongoing relationship. The government does not outline how the relationship is to be conducted between a man and his wife. Being married and having another lover on the side is more of a moral issue. It's not a legal issue. How many people are married and having affairs with another lover? They don't go to jail for having sex with another consenting adult if they are married. You certainly do not get "stoned" for it here. Imagine the consequences. People can jump on the Bible bandwagon. There's nothing illegal if someone decides they want to take on as many lovers as they want and have sex with whomever they wish. From a legal standpoint, the person can only marry ONE person at a time when they are free and able to marry.

    I'll trade you time differences! Whenever I fly to Ukraine from California, I have to go through 2 other airports and with the wait time at airports, my trip to her is about 20 hours. I forgot to add in the time to go back and forth from the airport also...add 2 more hours. :o

  6. My fiancée and I are just completing the forms necessary for the K1 visa and are confused about the G-325A form. Do we both need to complete one of these forms? If so, who is the applicant? I am the US citizen, but there are questions like "Applicant's last address outside the USA for more than 1 year" and "Alien Registration number" that do not really pertain to me.

    Who is the applicant?? Me, my fiancée or both?

    Both the petitioner and beneficiary, you and your fiancee, are the applicants for the G-325A and need to be completed and signed. There is a total of 4 pages for the both of you that you must fill in and each page requires original signatures on each one. Do not photocopy the signatures for submission to USCIS. Each page may look the same. But they ARE different at the bottom of each G-325A. Pay attention to this! I didn't and wait for USCIS to request new G-325A's from me and my fiancee.

    If you lived outside the USA for more than 1 year, you need to list it. If you are not a naturalized citizen, you will have an "Alien Restration Number". If you were born in the USA, you're not an alien. So you won't have one. If your fiancee had resided in the USA, she was probably issued an Alien Registration Number.

    Be sure to read the GUIDES and FAQ's section on this site. It will make the visa process much easier for you. Good luck!

  7. My fiancee is 10 hours ahead of me. I'm in California, she's in Ukraine. I'm lucky being self-employed and working out of my home. I spend about 4 hours a day with her. But sometimes, she gets to sit and just watch me through the webcam and actually do some work ^_^

  8. I do not know what you can do about the J1 restriction. Consult an attorney maybe if you do not find your answer here. If you discover there is nothing she can do about the restriction, both of you can use the time until November getting your case together by gathering evidence of your relationship from the beginning up-until-the-day you decide to submit for your K-1.

  9. I don't know how many posts I've seen on here where someone has asked to whom do they make the check out. A search would have found it. Actually, researching would have given the answer too. On the USCIS Website where the forms can be downloaded, it says "Fees should be made payable to Department of Homeland Security or U.S. Citizenship and Immigration Services." You can make your check out to me if you like! :lol:

    Is my fiance able to petition me to be with her in the United States whilst I am there on my visa waiver tourist thing? If this is possible how much time scale on average does a K-1 take to come thru? If we are looking at within the 90days then do I have to attend an embassy in the United States or would I have to return to my home country to be issued the visa to then return to the US under the K-1?

    Your fiance can petition while you are in the US on your tourist visa. When the time arrives for an interview with the US consulate of your country, you will have to attend that consulate. Unless the petition requested another embassy and it was granted. So, yes, you will have to be home to be issued your visa. Then return on the K-1 visa if you are approved.

    Since you say you are engaged, it is not recommended that you come to the US and get married. That will move you to another type of visa and whole other set of rules. Remember this, you have to prove when you first met and provide documentation supporting your relationship. If it is discovered you arrived in the US other than just "visiting" your fiance and ended up getting married, you may be denied receiving a visa for a while.

    I would highly suggest you read up on the guides section this website has to offer. Information is power and having that power is what will make good decisions throughout the visa process. Good luck! ;)

  11. Can anyone help me out with my situation please? My fiancee has interview in Mumbai consulate in April. I have sent I-134 along with employment letter, pay stubs (December - (reflects whole year income) to February), Savings account bank letter, tax returns for (2006 to 2004).

    Now, the question is that I graduated from University in 2005 and didn't start my full time job until Sep, 2005, which is reflected in 2004 and 2005 tax returns (below poverty line income). However, my income in 2006 tax return reflects full time job and pay (about 300% more than 125% poverty guidelines for the household of 2 people), and hv savings about (7k). Do I need to worry that my income from 2004 and 2005 will disqualify me as a sponsor? Can anyone please tell me how do they determine affidavit of support qualification? I am really nervous. Any suggestions.

    Add in your most recent pay stubs. How far back? It's up to you. But I do not think you have anything to worry about for 2004 & 2005. It's your current status that matters.

    Recieved my I-130 NOA1 - I-797, all the information is correct except for my wife's last name, which is also my last name. In the Benificiary Name area, my wife's last name is missing one letter, it's a typeo......

    what is to be done now?

    i recieved it friday at 7pm, too late to call USCIS....; i will have to call 8AM Monday morning; what can i expect ?

    If there any of the information is incorrect, you need to call the phone number at the bottom of the NOA immediately. That's what the instructions state. You will need to follow them. I think the only thing you will expect is that they will correct the error. That is what you want, right? ^_^
