Enter their names. It is not until the interview stage do you do something or in your case nothing for them to get the K2. Make sure they understand it will be years before they can get to the US if they don't come with mom.

She will most likely need her degree evaluated. Here's one that is often recommended on here to do the evaluation. https://applications.wes.org/degree-equivalency-tool/ Might want to get a jump on it so when the time comes she can easily pass it on at the interview. -
Wow, that would make such a mess. Maybe at that point the couple should just use common law marriage to immigrate on. Sheesh so messed up.

Keep emailing them. Use catchy words like Urgent K2 Ageing out. Also I know your case is not at the Consulate yet but email them too with Urgent K2 ageing out and ask for an expedite. They may be able to talk to NVC and request the files. -
That is not how it works. Sadly the lawyers are telling you what you want to hear. Lets go with your own examples. If she is given 1 billion then she sure is not below the poverty line so the I-864 would give her nothing she is over the poverty line no if's ands or buts about it. Read your actual divorce agreement. We know her lawyer got some wording in there for the 250K plus a monthly support. But you need to actually really understand what that wording is. Yes some divorce courts will use the I864 as a guideline to set support. You yourself just posted the part that the lawyers are feeding you. You are not understanding the part that she must be below the poverty line to start with. Your example that if Bill Gates had married an immigrant he would still have to pay according to the I864 even if she had a 1billion payout, why would he be paying her a cent after that payout, she sure would not be under the poverty guidelines? For a 1 person household with the poverty guidelines posted above is just over 12k a year and that is based on 2023. You've been overpaying according to your own lawyers.

No such thing as a 90 day rule. The issue is when you plan to get married AND adjust status. The adjusting status when you know before hand is where the fraud comes in. If you to plan to get married real quick in the US on the next visit. Then your fiancé heads back up to Canada and plan your wedding if you're having one. As soon as you have that marriage certificate you can start the I-130 and your fiancé waits out the process in Canada. Nothing illegal with this method.

I do not know if their 10 weeks is accurate. I have seen many members encourage ppl to get married State side to avoid this delay. If you're seeing places saying up to 6 months I would not doubt it. Send a letter it sure can't hurt. If there is a way to get married in the US with a JoP do it. Then have the wedding in Canada if that was planned already.

That is one of the downsides to getting married in Ontario. From what I have seen here in the past there is no expedite for immigration purposes.

Most of the threads I have seen on here where the marriage questions come in, is usually when ROC and divorce happens so soon after approval or there were other red flags in the history. Being you filed ROC with the waiver your case is already more upfront. Nothing sneaky you're trying to get by them. Bring the lawyer if the fee won't hurt you and it gives you peace of mind.- 36 replies
