  9. You got your GC through your mother after the appropriate waivers. Will you be asked about it. We cannot be sure, but with immigration they can ask just anything. Will it be a problem about your past asylum case. I highly doubt it will be an issue, as you followed the proper steps after that. As for your marriage, yes they can ask but as you did not get any immigration benefits from that marriage. They probably won't ask other then to check your legal marriage status. Which you would show your divorce decree. Again it will not harm your case.
  10. They should be able to attend college, whether anyone would want to pay the tuition rate is another story. The issue usually comes from them not yet being permanent residents. Once the AOS is filed they will be allowed to remain here in the US but it is sort of a limbo status. Very few reports over the years have been some colleges, usually community colleges would take your residence information and apply to your spouse and child. Giving them In-State tuition. Many though want to charge tuition as a foreign student rate and that rate is nuts. So most wait until they can enter as a resident with the much lower tuition. They can do any type of true volunteer things. These things must be 100% volunteering, not job at the end one the EAD or GC arrive. If your local college has some sort of community class they can do those too. Most of those type of classes do not need much more then signing up and paying the class fee.

  13. Stick to the K1, your fiancé's daughter is already 19. If you switch the the spousal visa she will not get a visa through you. He would have to petition her after he comes to the US. It would be years for her to get to the US. The 125% poverty line applies when you get to the adjustment stage. Either get a sponsor or a another job/second job. When he goes next week for his interview you only need 100% for income. As long as the CO doesn't want more.

  16. Ahh, I didn't realize you're already at the end. Sorry dyslexia and when I read fast I miss chucks. Yes the K1 is much better with the older kids. No filling the alone does not give him work authorization. The EAD needs to be approved for him to be able to work.
  17. Yes you can count the child support. How I'm not sure, but others may know. Wait for them to come around. Second it doesn't sound like the K1 is the right visa for you two. He will not be able to work for several months after he enters on the K1 and after you've applied for AOS and the EAD. If you need him working asap. The best way is the CR1 Visa.

  21. Even if Colombia had a system to expunge her record. USCIS would still need it declared and want the court records. There is no hiding it.
