K1 Visa With Criminal Record

Follow with what K1visahopeful instructed to do. Starting off with married name when you apply for AOS is the easiest. Waiting more than 3 yrs to change the last name, and then all your ID, update all the Doctors, car insurance, and all the other little things here and there is a much bigger pain in the rear then doing it now. When you go to get the SSN don't mentioned the marriage or name changes. Many times it just confuses them and they think it voided the K1. It one reason why we recommend getting the social prior to marriage. The SSC may come if you check the box but it also may never come in. That is something that does happened a lot. By going down to the office it might come in faster. That can be helpful when adding your wife to your insurance, many HR stories on here that do not know they can add a spouse without a SSN.

Yes you will stop being a resident of Canada, you can still work in Canada if you will live close enough to the border to travel back and forth. Also taxes would be changed to non resident, for most it doesn't make sense to continue working in Canada. You will stop receiving the child tax credit, it is usually direct deposit so make sure once you cross do not withdraw any deposits out of the account. So if you leave Canada on the 8 and get a deposit on the 20th do not touch it. They will eventually ask for it back. Now for maternity leave you can still get that even after you move. That and employment insurance you are allowed to collect after the move. These ones are not from the government and you paid into them so make sure you do continue with it.

After your interview the CO gave you a letter asking for the right PC. On that letter is should say where to send it. When you email the consulate you are not actually getting a reply from the CO who interviewed you. The person that replied did not know you were given the 221G form for the PC. Get a copy of that 221G for your records and send that asap with your PC.

When you got the 221G for the PC you should have sent that in as soon as you got the correct one. The paper they gave you is for that, they will not ask for the police check again. If you haven't sent that in get it mailed to them asap. That alone will hold things up.

Last name change to Husband’s when N400

It should just be an administrative name change. Assuming your husband's last name is a simple matter and not need a court order. -
Is filing N-600 really necessary?

I have not applied for the N600 for the two younger ones that derived citizenship through me. Years ago when I was researching it someone mentioned the only time he has ever seen anyone needing more than a passport as proof of USC was for some very high top security clearance. Both of my now adult kids just renewed their passports without issues. The passports were expired and they still did not need to send my certificate with the applications. My son said he may apply for the N600 it just to have it, so that is up to him. I really feel the wave of ppl who come through here also change the stance of the recommendation of the N600. -
When were you going to head back to Canada? Even sending mail priority it takes its sweet old time getting through the border. Plus chances of it getting lost.

Even before the DS-5535 issue started Montreal took 8 weeks to clear AP for missing or extra documents. You should be just about done.

Yes K2 is just like the K1, except when it comes to getting SSN K2's have to wait until they get their EAD even if they are only 8 and won't be working they need the EAD. Follow to join would work to let your fiance get settled first. Basically at the interview your fiance would go without his son and let them know he will follow to join later. This gives you 1 yr from your fiance's visa approval or interview to get the K2. He will do the medical and interview later. Make sure you check the timing of AP, incase your fiance can't go back to finish things up and bring his son to the US.

If you are thinking of getting the K2 there are a few issues. 1. You fiance's son would need a letter from the other parent that gives consent to move the child to the US permanently, or sole custody of the child. Some countries are more strict than others when it comes to what you need. Canada for example, sole custody is not enough and a letter from the other parent or court order is still needed. 2. If the child leaves the US without advance parole then he cannot come back without you starting the all over again. The K1 is a 1 time use visa, he cannot come back on it, it cannot be used like a tourist visa. 3. If waiting until the EAD is approved to have him come later that could be 6-8 months. What is the point of waiting until the work permit comes? Is it again to visit or to move then after finishing school for the year? I've noticed that US schools do not line up with schools of other countries and they most likely still be entering mid year. This option would be the Follow to join with the K2 again the consent to move the child will be needed. Tourist visas are not a given even if it is a child. You need to be sure to understand that if he is not coming on the K2 that he may never get a B2 to visit.
