  12. I believe you have 4 months from date of NOA 2 approval to make an appointment. You can make an appointment AFTER the 4 months. If you can’t find an appointment you should write to the consulate to see about extension… but you might not have to communicate with them depending on the consulate.

Tunisia Spousal Visas: 129 Tunisia K1: 11 Nigeria Spousal: 197 Nigeria K1: 67 Philippines Spousal: 90 Philippines K1: 773 Why would you think Tunis has a high approval rate? 36 K visas were issued to Tunisians in 2023. Compare that to the 502 from Nigeria. compare that to the 3402 in Philippines. 19825 total K1 visas were issued in 2023. You can see the K1 is more common in Philippines but the Spousal visa is more common for Nigeria and Tunisia.
  14. You forget the other red flag is you are from a high fraud country. So 2 red flags. Even couples from “low fraud” countries like Philippines have their K1 denied if the CO believes they did. not see each other enough. It won’t be an instant denial. A couple of things might happen: 1. CO asks for additional evidence of relationship- like your text messages or maybe text messages between you and her family or her and your family. Then you go for another interview and you are questioned about the contents of the messages… 2. CO sits on your case and the K1 “expires”. This is a test to see if you will file again or get married or break up… 3.   15. Don’t do anything until the I130 is approved. You will update everything when it gets to the NVC. Think about it this way: I130s are for various family relationships. It’s about verifying a visa can be issued. People could theoretically move 3 or 4 times while the petition is pending (e.g. siblings of USCs). NVC has instructions on how to change the consulate location if it is the wrong one… None of her paperwork will go to the actual consulate until they accept all her documentation and they have an interview slot for her- this could take 1-6 months depending on various factors. Probably closer to 1-3 months for you because you are in Germany.
  16. You can’t change anything until the I130 is approved. It doesn’t matter which consulate you chose- it will probably be the consulate associated with your wife’s most recent address on I130- after it moves from USCIS (where it is now) to NVC (where the visa process will begin) you can update your wife’s information and where you want to email. you will receive a DIFFERENT case number at NVC the first three letters will indicate the consulate your wife is scheduled to interview.
  17. @Dataunavailable I have been following your journey and am rooting for you! Your tenacity after the two denials is amazing! If the consulate rejects this third attempt I would be very surprised. But, why would you have to give up your US citizenship? Do you have a second citizenship you can fall back on? I know several USCs who live in Cambodia and have for many, many years. Cambodia is an amazing place... but hopefully, you'll just continue visiting there after your wife moves to the US with you. And you don't have to relocate there permanently!. But, another thought is if you are denied a third time- after living together in Cambodia for a few years, that should be incredible proof of your very strong relationship. When is the interview so I can think of you that day?
  18. Denial of tourist visa (multiple denials) shouldn't impact the immigration process.
  19. You should really thank @seekingthetruth. He is the one that put together the "Delay at NVC" plan... Husband and I just applied when we were ready and decided to "go with the flow". We didn't delay our process once we started our immigration journey.
  20. Yep! This is also what we did. We got married a few years before we decided to move to the US. Then when we were ready to move to the US, my husband petitioned me.
  21. This couple lived and taught in Thailand together and the wife moved to the US before the I-130 was approved/ visa was issued. You might have to come to terms with the fact that moving to the US isn't going to be an "easy" process that allows you to plan your life around approvals. This is why I suggest pausing at the NVC level. But, NVC processing can take between 1-3 months. Then wait from DQ to interview can be anywhere from 2 months to over a year. @Dewald & Brittney were DQ'ed December 9, 2022 and he had his interview February 15, 2023... There is a thread you can read here: Okay! I think I'm done sharing links. Just wanted to note the immigration process to the US is really quite tedious and the US isn't really interested in helping out couples who are in a third country together. Why give your spouse a reunification visa if you are already together.... and then they won't give your spouse a tourist visa because they think she won't ever leave. Final suggestion is for you and the wife to travel to several countries together and then see if she can get a tourist visa on her third try... I have a friend who was refused twice when just dating his US girlfriend but received a tourist visa after they married...
  22. Want to add: we were in a similar situation to you. My husband and I were both teachers in Korea. We loved our life in Korea but decided we would move to the US when I received my visa. My husband quit his job 2 months before my interview because we knew if he was still employed I would most likely not receive the visa. Our experience here: There is a massive teaching shortage in the US. We were both offered 3 or 4 teaching positions early September when we arrived. I started teaching 2 or 3 weeks after I moved here (mid September). You’ll probably want to research how to convert your wife’s teaching certificate/ license in the US before you move here. Depending on the state it could be extremely easy or she might want to change careers. But, it really doesn’t matter when you arrive because teaching jobs are plentiful.
  23. “Temporary Green Card/ visa” is only valid for 1 year not 2… How is this possible? Just wanting to confirm student is CR2 not IR2.

Child entered Feb 2024 and I551 expires in Feb 2025- @jackiegringa is thinking this is the endorsed visa in passport when she entered not the actual physical green card. @CJlove was the I551 CR2 or IR2? If student registered at school did the student give them a copy of her I551 when she enrolled? Does school have any of her documentation on file? Asking as this is how she might have received her student card…
  25. If you want to live in the US eventually, file I130 and I130a now and then delay at NVC until you decide you want to move. Post about that process here: Your plan most likely won’t work- especially if you move to the US and your wife has a conditional green card- they’ll be confused when you file I751 and she has a foreign address, paying foreign taxes, with bonafide marriage evidence from Thailand. Easier to complete the IV process when you decide you no longer want to live Thailand and want to live in the U.S. The green card is for living in the US and the family based green card is for reuniting families. If you (the USC) have no intention of moving to the US after she receives her GC- you’ll probably get a request to show proof you’ve quit your job in Thailand or made moves to live in the U.S. without your spouse…so plan accordingly.
