  4. Your GF should be 100% open and honest about her intentions when coming to the US. Is she going to this particular Community College only because she wants to explore her relationship with you without going through the expensive and time consuming K1/ CR1 process or does she want to go to this CC because it ticks all the boxes she wants ticked when going to College? If your gf is not honest and later applies for an immigrant visa she might be hit with misrep when USCIS discovers her motivation for moving to the US was going to live near/with you and not to study. Friendly advice, if she does obtain a student visa make sure she goes to school and doesn’t drop out immediately because reasons… A poster not too long ago was interested in studying close to his gf because he wanted to get to know her better and it went awry…

  7. If you are not made of money you should consider the TOTAL cost of staying with your GF and petitioning her for the K1 and then the TOTAL COST of marrying her before she comes to the US. So many times people are short sighted thinking K1 is cheaper and then discover they cannot afford to support two people on one income and pay for adjustment of status. K1 is more expensive in the long run. Think of going to see her one more time and marrying (via Utah) as an investment in your future happiness and financial well being… I would like to add… timelines for K1 and CR1 are about 2 years. So, one assumes you’ll want to see your partner at least once or two more times before she moves to the US. Travel is one of the costs you definitely have to factor in when entering into an international relationship.
  8. Consult with immigration lawyer to determine if you have valid status in US. But, I’ve seen this story before and it usually ends in tears. 1.) I don’t think you’ll ever become a U.S. citizen 2.) Because you voided your visa before arriving you cannot petition your wife and children and they will probably never be able to move to the US as immigrants via you. Hopefully someone will correct me and tell me I’m wrong but … it doesn’t look good.   9. Did you marry before entering the US for the first time? if so, I believe you voided your visa as you were no longer an UNMARRIED SON/DAUGHTER but a MARRIED son/daughter and your current status in the US is not valid.
  10. Sounds like you should create 5-10 year plan and consult with a lawyer to try to figure out the best course of action. Are you looking for citizenship for the girls, study visas or just the ability to visit the US as tourists? If so many people are abandoning the US do you think it’s a smart move to burden them with US citizenship and the duty to file taxes regardless of where they live? Is studying in the US the best option or should you consider Europe or another country? Either way, I think moving to the Philippines and enrolling them in good schools there would probably be the best plan of action. One more question, how old are the girls?   11. One meeting should be enough for Manila and K1… but K1 is taking a long time so if you’re really sure you want to be with this woman forever visit her one more time, get married and petition her and her children.
  12. Additional questions: is the plan for the child to travel with you to US when your wife activates her visa? Or will she visit after you have settled? Is the plan for her to travel as an unaccompanied minor or do you plan on flying to the US and back to Colombia? Are you comfortable doing tourist things AND immigration/ moving things at the same time? Speaking as someone who just moved to the US, I’ll confess the last thing I wanted to do when I arrived was go on a vacation. I was more interested in getting my SSN, DL, physical green card and a job 😂
  13. Double check interview waiver requirements for Colombia. India has this caveat: Children under 14 years of age must submit a photocopy of each parent’s passport biographic information page and valid U.S. visa. If the parents do not hold U.S. visas, the children are not eligible for the interview waiver. Basically with everything you can apply and hope for the best but your niece will probably have to go to the interview with an adult and they might find it odd the parents aren’t planning to travel with her. Questions: Why do her parents not want to visit the US with their daughter ? Has the daughter spent significant time away from her family? Does she understand the length of her stay and how far away she will be from her environment?

You’re going to have to show the income will continue in the US after the move. will your husband transfer to a job based out of the US or is the plan to continue working for a Canadian company but remote? I’ve only ever read success stories of the beneficiary self sponsoring (because that’s what it is) when going through London and DCF (no NVC involved). I advise finding a joint sponsor or using assets. Unless you have solid proof your husband's company is comfortable having him work remote and has made and will make all the arrangements to allow him to work in the US (tax compliance etc). you can read this thread for ideas And this post
  15. Domicile proof for NVC will be fine. Seoul might request additional information/ proof at the interview (they did for us). Complete your 2022 taxes and submit it. Make sure to keep copies of your taxes because Seoul requests hardcopies at the interview. You might not receive your transcript in time so upload statement of no W2/1099 if you submit the 1040 and 2555 in place of transcript.
  16. They know because they request proof of status: passport with stamp showing legal entry to the US and I94 indicating the permitted period of stay - you can find it online. And you have to provide proof of identity when you marry. Sometimes people aren’t first language English speakers/ don’t use their words correctly so “pre-application” to me read as “completing my application before I submit it” . if you have any questions best advice I can give is to identify the form. Id like to add, state and county laws differ so some places will allow you to marry out of status and others won’t… So, if you have any state/ county specific questions you should identify where you are…I believe some counties really drag on issuing the marriage certificate and people have been caught out by marrying too late and having the beneficiary fall out of status. question: does your partner have their original birth certificate with them? Not a copy… I hope you’re aware this is needed for the application.

  19. When the petition is approved and moves to NVC it will be scheduled for Montreal. MTL will generally ask for proof of residency, so make sure to upload proof of permanent resident status when you submit your documentation. I suggest you follow the Canada forum for any potential issues you might encounter when submitting documents.

Marry ASAP and file as soon as you have all the required documents but, discuss with your partner if they’re okay with potentially needing to Uber and rely on others for transport until they get their EAD. It might be okay as everything is still new but after 5 or so months it might get a little frustrating…

We brought updated financial information but I would definitely bring the I864 you uploaded AND an updated I864 with your husband's information when you go to interview. The Seoul consulate was very friendly but they do like to see updated information.
