  1. One more question… if DCF is accepted will you wife be able to remain in Dubai if you have to move back to the US before she receives her immigrant visa?
  2. Ah… sounds like you have a battle.. hopefully your evidence the marriage is legitimate is strong and your wife taking the material and explaining it is the best course as opposed to just submitting the documents
  3. What is your timeline? How did you get your green card was it through marriage? Was the marriage denied due to bonafides?
  4. The spouse visa you applied for... is that for Dubai or the US? Have you sent in the I-130 yet or did you just decide to live together in Dubai together for a few months/years...? Where were you living before you moved to Dubai?
  5. Yaounde is in Cameroon not Nigeria... are you a naturalized USC originally from Nigeria petitioning a spouse from Cameroon? Or are you an LPR from Nigeria petitioning a spouse... you first posted in the Permanent Residents forum but have since posted in the CR1/IR1 forum... How did you obtain your green card/citizenship? I would also like to add... it might not have been smart to request another interview... there is a chance the embassy was just going through background checks and they would have been happy to issue the visa to your spouse without her having to return... it has happened to other applicants in the past...

Trick with birth cert etc is to have a family member apply for it in a rural/farm town… you get it super quick that way… so I’m sure agents have special relationships with certain Home Affairs offices to jump the line 😉😉… either way when factoring in the cost of FedEx and asking a family member to do the legwork paying an agent is slightly more expensive…
  7. Right? Apparently, foreigners were marrying SA citizens to get status without their knowledge (someone was selling ID numbers)... so now if you do marry a foreigner in SA you have to interview before obtaining the marriage license to prove you actually know each other...

South Africa has one... it is called a Letter of no Impediment... you can also text your ID number to check someone hasn't married you without your consent~ Verifying your marital status Due to the large number of fraudulent marriages reported to the Department of Home Affairs every year, a facility has been created for you to check your marital status at any time. You will need your South African ID number in order to use this facility. You can also sms the letter M followed by your ID number (example: M 5001010050080) to 32551 A reply sms He managed to get his wife and child their visas after a long AP... Follow the visa bulletin: https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2023/visa-bulletin-for-june-2023.html They are currently working on petitions of adult children of LPRs from India 22 SEPT 2015 (so 8 years of waiting). If your brother gets married the petition will be denied as there is no category for married children of LPRs. Your mother will have to become a citizen.... Your brother should continue to take his medication, see the relevant doctors and make sure he doesn't get into trouble... when his case opens up at NVC he will have to submit his Canadian PCC (you don't have to worry about that for the next 7-8 years)... but you can obtain the record now if you know your brother will not be returning to Canada ever again... Contact the local Canadian embassy in India for directions on how to obtain a PCC from India.
  10. So, no need to file I407 If OP is only considering moving to the US in 18-the 24 months wife can file I-130 now and they can consular process? This holds even if OP has a 10 yr GC that has not yet expired? Older post shows OP received 10yrGC in 2015... but left August 2015 before they received it... So, 10 yr is up for renewal in 2025...

  12. Did she file MFS? Good to know… as often USCs who leave the country don’t realize they have to file taxes… You have not been filing US taxes? Then SB1 is probably out for this reason, too… Follow @Mike E’s advice if you want to move to the US soon alternatively you need to check your status and formally give up your GC otherwise your wife won’t be able to petition you… (you can’t petition someone if they already have a GC).
  13. Well… there is no way to expedite a South African PCC. And I didn’t expedite my application I paid an agent to submit my paperwork (most people either pay an agent or ask a family member to take your application to the closest police station…). Maybe you can submit it directly to Pretoria but I’ve never done that… So, OP is misinformed about that. There was a company charging ZAR5000 ($257) to expedite PCCs inside SA but turns out those PCCs were forged. They added maybe ZAR2000 to the service if you were overseas… Getting the PCC from SA to Korea will probably cost OP ZAR1,430 (that’s how much I paid last year) when I had my PCC sent to Korea… I’m terrible at math and converting from ZAR to USD but just checked and it comes out to $76…. I stated I paid $200 total because I made a trip to the South African embassy to get my fingerprints done and added in the price of travel to Seoul and staying over a night… But, if OP is not near Seoul they can just go to a local Korean Police station and get their fingerprints done there… which will also lower the overall cost.

  15. You’ll need to get another police clearance from SA. They want originals not copies… Also, currently it is taking SAPS about 4 weeks to issue police clearance certs not 6 months. At the height of their inefficiency I only had to wait 8 weeks and paid $200. Get a family member to submit your clearance if you don’t want to pay that much… Don’t pay the MRV fee before you request the transfer: If you are requesting a transfer for a K Visa, the receiving Embassy or Consulate has the discretion to approve or deny the acceptance of a K visa application from an applicant outside the consular district. Contact the potential gaining U.S. embassy or consulate in writing to request a transfer of your case and include the reason for the transfer request. If you paid the MRV fee at the original post and the transfer request to a new post is subsequently approved, a new visa fee will be required.
  16. 💯 agree with @carmel34 but will add one more step @K&E2009… you’ll need to formally withdraw your green card before your with petitions you as you are potentially still a green card holder… ETA: have you and your wife been filing US taxes? Just your wife? Neither of you? ETA2: When does the 10 year GC expire? @Mike E might have some words of wisdom…

But, your parents are currently not in the US… Have you seen the reasoning behind B1/B2 denials? https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/visa-denials.html if the CO believes your parents are only going to the US to adjust not visit they’re visa will be denied. if CBP believes on entry your parents are coming to live not visit they’ll probably go into secondary where they’ll be questioned, maybe have their bags searched and if CBP believes they are going to adjust they could be refused entry and sent back to Kenya… Of course if your parents were already here in the US they could adjust… but they aren’t here… It is also against visajourney TOS to condone fraud so I’m OUT.
  18. If they already have a tourist visa they can visit while the I-130 is processing. But, if they are only obtaining the tourist visa with the intent of adjusting, this is fraud and they will probably not be granted the non-immigrant visa.

  20. If you change to divorce waiver they will request copy of divorce decree. You will have maybe 60-90 days (not sure of the exact time) to produce the final divorce. It is probably in your best interest to file another I-751.... paging @mindthegap and @Family for tips.
  21. If this is for a spouse and the spouse is overseas no need to upload the photos according to the I-130 instructions. "You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is in the United States) taken within 30 days of filing this petition" But, passport photo will be required at NVC stage.

  23. Many factors go into a denial: the beneficiary's home country, the age of the petitioner, if the petitioner is male vs female... If an older (close to retirement) female USC is petitioning a younger (20-30) male and he is not working and being supported by the USC (but she also requires a joint sponsor)... you can see why that might lead to denial - public charge issues. If a young male USC (just out of school or college) sponsors a young female beneficiary (thinking about going to school/ just completed school/lives in a country where women aren't expected to work...) being supported by the USC or family members - probably won't be denied because they're both just starting out in life. ETA: Consulate says you shouldn't quit your job before you receive the visa (in case there is a denial/long AP) but it doesn't say you have to be employed when you interview~
  24. Your parents are arriving before July/ after July or TBD? Unfortunately, some rental places love paperwork and ticking very particular boxes. You can see how even a US citizen returning to the US with no job would not be able to rent this place…
