@RetroPeach12 if you are a worrier I would research the possibilities of the spousal visa - it currently takes as long as the k1 visa but when you enter you will be allowed to work, open a bank account (as soon as you receive your SSN), and drive. You will probably start overthinking the K1 after you submit it so get all the research in now before you make the final decision. The evidence you have so far is great for both K1 and spousal. Only issue would be getting married - you could visit your partner in the US and get married or go the Utah online route and get married if he needs to visit you in the UK. Getting married in the UK involves an application whereas you are allowed to get married in the US on ESTA or tourist visa as long as you are planning on leaving before your stay expires (I've done it as have many other posters here on VJ).

You’ll have 6 months after the medical to enter the US… so right now if the beneficiary had their medical tomorrow they would have to enter before November 29… not sure when you’ll be scheduled for interview but you should be fine. Just enter after 2nd anniversary and remind CBP of your wedding date.

Father most likely had straightforward case to GC if his son was a US citizen without the VAWA claim… unless he entered the US without inspection… then he was never allowed to exit the country with the travel document. I agree he was scammed by the lawyer but agree with @Timona there is more to this story.

Your baby will still needs to be petitioned/ needs a visa that allows them to live in the US. When the petition is approved you will add the baby to your DS260. This will not happen anytime soon… your husband should not naturalize but you might also want to file an i-130 for the baby in case something happens and he needs to naturalize.

Generally the K3 is processed at the same time as the I-130 (and the same center). If you have not filed an I-130 before the K3 you will receive an RFE. K3 processing times vary wildly just like the I-130. Some people have their I-130 approved 2-3 months after they file the I-129F whilst others only have the petition approved after a year. Potomac Service Center I-129F/I-130s appeared to be processed fairly quickly after submission but no word on I-129Fs in Texas speeding up the process. -
You will probably receive a message from NVC stating they cannot determine if you are qualified to sponsor and they will suggest a joint sponsor but the CO will make the final decision. This is a message everyone who did not make enough on the previous year's taxes receives. As long as you get a Documentarily Qualified message you are good to go and they will schedule your partner for an interview. You can then complete an additional I-864 with assets for your partner to take to interview in case they request a joint sponsor. But, you should be fine.

Depending on the language they speak and the route they fly to the US - there could be flight attendants who speak their language and airport workers speaking their language when (if) they transit. First - you need to secure the tourist visa or the ESTA for them. If they need a tourist visa, they should be able to interview in their language. You can complete the DS160s for them and pay the fee if they are unable to read and write English.

Oh! Is it not possible to break the lease? Or maybe look for a shorter term lease if she hasn’t moved into the new place yet? I had to break mine when I moved to the US. There was a penalty to pay but we were more interested in being together in the US as opposed to prolonging the time out of the country.

It is easier - for example you can transit through the UK without having to apply for a transit visa. But, you should research which country is easiest to get a Schengen through (if planning on traveling to Europe). Some countries are still fairly strict about the time allowed in the region whilst others will give a longer stay.

USCIS doesn't like assets even though they say you can use them to qualify. Consulates are a little more forgiving. I would go the route @Mike E suggested buuuuut you might want to consider applying 6 months or so into your spouse's OPT (they aren't by any chance in STEM are they?). This way you might get the GC after 2 years of marriage and skip the very expensive and drawn out ROC.

We aren’t really giving advice to not go forward with the application as OP has already submitted both student visa and completed DS260… but I will follow this with interest because the question of applying for student visa with pending immigrant visa comes up often but most people do not return to update us…- 23 replies

Well by completing the DS260 you’ve demonstrated immigrant intent. And applying for the F1 with a pending immigrant visa could lead to the officer thinking the F1 is a way for you to live in the US in case you don’t get the immigrant visa… but you will only find out once they adjudicate your student application.- 23 replies

Your actions don’t quite match your words. No one enters the DV lottery just for fun? if you only intended to study in the US there was no need to apply for the DV lottery. They might call you for an F1 interview. They might not. If they do- tell them what you said here- but they might then question why you applied to move to the US if you had no intention of living there. Have you investigated schools in other countries in case you are not accepted? Also, be aware if you are refused the F1 visa this puts your ESTA at risk. Good Luck! Keep us updated…- 23 replies

You will have 6 months after medical to fly to the US. I suppose you could schedule an interview then reschedule again to a later date to prolong your partner’s time in the UK BUUUUUUUT CO might question why the interviews were delayed. Another member delayed her interview and CO requested more relationship evidence. Would you be visiting your partner in the UK between now and August 2024?

Are you aware of the timeline for DCF? First you write London and see if they will accept your request for DCF. If they accept the request you submit the petition. Then you are good to go! I'm not sure of London timelines right now, but I believe it is about 3-6 months. Wait until you get the OKAY from London to submit the petition. Then go house hunting etc. ETA: London appears to be extremely lax with DCF. A few months ago someone was approved with a part time job offer that was not enough to sponsor the intending immigrant. Her husband (the immigrant) was able to use his income to qualify (as he was going to continue working for the same company in the US).
