Not sure where the USC currently lives and where you plan on traveling but make sure they maintain ties to the US, and either have a job based out of the US they maintain or a qualified joint sponsor! And if planning on traveling for 6 months, be aware the CO will ask about travel history after NVC submission. They may or may not request a PCC if the beneficiary stayed in one place for more than 6 months.
  2. Where in the process are you? Once the petition is approved you need to submit documentation to NVC. Currently timelines are about a month. But, this fluctuates and can take as long as 3 months from submission of NVC documents to DQ. Do you plan on traveling for 3-6 months? You can always delay submission of documents at NVC stage if you aren't quite ready to move to the US.
  3. I suggest you use your parents address for mailing address. They send documents there. The NOA1 and Approval notice. It won’t make your case stronger or weaker because you only have to prove domicile at NVC stage. The I-130 petition is just showing your relative qualifies for a visa.

  5. If using a joint sponsor. It is generally encouraged they make enough money and do not need to use assets. But, I’m sure assets can be used. 3X because you are a USC.
  6. She will have to wait for AP connected to second application/ petition. If her ability to travel/ leave the US is more important than her need to remain in the US with you.   9. If using assets, it is calculated as an average over 12 months. You’re supposed to show 12 months of bank statements. Big recent deposits should be explained. You can always file the I864 with your current circumstances and really work hard to get a job ASAP. If they don’t request RFE and ask you to submit another I864 you’re golden. If they do- resubmit a new I864 with updated job details… Here is a post you can follow Here is another thread where the petitioner had issues with sponsorship. So, if you don’t meet the requirements first time round and you receive an RFE make sure your I864 response is perfect the second time you submit.
  10. Check timelines for Thailand @Dan and Akari K1 vs CR1/IR1 K1s out of Thailand with a late 2021 filing are interviewing now until August/ September… about 20 months. CR1s are a little more varied with filing to interview as short as 11 months. I don’t really think you will lose any time if you switch now. Spousal appears to be quicker for the Thailand consulate. Also keep in mind you have to schedule your own interview with K1… if you ever delve into the K1 threads you’ll see some have a harder time finding dates which prolongs the process.
  11. The estimated waiting times changes every couple of months. Also, even though your NOA1 might state your petition is at Vermont. That might not be true in a month or two as they can and do transfer cases. I will tell you our wait time for both service centers was not accurate at all. As difficult as it is... you should forget about the petition and hope your partner enters the US after May 26, 2025 so they will receive an IR visa not the dreaded CR visa which entails filing ROC. ETA: I see you are currently living with your partner? This means waiting together is easier than waiting in two different countries. Enjoy your lives in Colombia while you can and enjoy all the things you might miss after moving to the US.

There are engagement parties and engagement parties… also, with a lot of these “engagement parties” formal marriage generally follows AT MOST a year or so after… with K1 taking 1.5-2 years… how is the CO to know if the couple didn’t take the next step? @Dan and Akari has a choice to make.. he is up against two cultures, the desire to move to the US, and the whim of a CO in Thailand or Myanmar who can either take them at their word or believe they are actually married… Roll the dice. They are still fairly early in on the process so switching to spousal visa won’t impact them too much. Adding to the fact they probably applied for K1 with a Thai address - if @Dan and Akari‘s wife is in Myanmar and needs to interview there… they will be adding several months after the petition is approved trying to get the interview moved from Thailand to Myanmar. My opinion? They should marry and apply for spousal visa. It will add up to the same amount of time as unless Akari remains in Thailand as a legal resident she will add several months to the process after she moves back home.

  15. As your husband is from Russia it might take a little longer for him to get to the US. Conservative timeline is 18-24 months from filing petition. Your stepson would be maybe be 12/13 when he finally arrives to the US. How much time do you think he would need to settle? 1-2 years or longer? Stepson might only move to the US at 16-18 if you delay filing for him now. Then- the US currently does not have a consulate in Russia. This means your husband (and your stepson) have to interview in a different country. You will have to research how to get both of them to another country for interview. Is the mom willing to travel with him? Would your husband travel back to Russia and then the third country to assist your son in the interview? Is the staggered arrival a must or do you think the parents would reconsider having your stepson move to the US with your husband? You should read timelines and journeys for the visa process in the RUB subforum. ETA it will be an IR1 visa not CR1 as you’ve been married for more than 2 years.
  16. Tell the truth in your interview. As you were already married you filed the incorrect petition. Did you both claim you were single and free to marry in your K1 application? How did the CO discover you were married to each other.

And you appear to only be speaking about adjusting status not consular processing. While I find this topic interesting. I can't have a discussion with someone who doesn't understand the basics of US immigration.

The belief the Diversity Visa doesn’t have a cap and Diversity Visa applicants do not have to be educated being the most egregiously incorrect statement. And then staying adult brothers and sister of US citizens have one of the fastest processing times… I’m mostly trying to understand where OP got their “facts”.

  21. In addition: F1 visa is a nonimmigrant visa. Students are expected to go back to their home country after the complete their studies. Some are lucky enough to find sponsors for jobs but it is not a right for a student to enter the student on a certain path to employment in the US or permanent residency.
  22. So, you’re saying all F1 students who marry a USC are committing immigration fraud? They are not marrying for love but because they want to stay in the US? If you are aware of this- you should report it. VJ does not condone immigrant fraud and they have who to contact on the main page.
  23. Isn’t sibling of US citizens category the longest waiting time? why are they in the first group? The only DV and E2 and E3 and the only visa categories you mention that require experience or qualifications… So, 7 out of the 10 visas you mentioned do not require experience or qualifications and 3 come from the second group and 4 come from the first group. Why is the second group superior to the first group?
