  2. Next question. The man who was shot and killed (the robber) he did this several times… how does this impact the other U visa applicants? Were they actually cooperating with police to get the assailant arrested or was it just for the EAD? How long was this scheme sustainable? Surely the police/ USCIS would have realized it was the same gas station/ the same perpetrator and all the victims happened to be undocumented… I need to find some more scams and schemes and how people get sussed out.

But I’m asking if THIS couple now qualifies to apply for the U visa because even though they were involved in the robbery scheme they NOW have witnessed a man get shot… I’m just wondering what the parameters of a U visa are… if you were involved in CRIME A but then you witness a crime B while perpetrating the Crime A… can you apply for U visa?

  5. He might not know the divorce was fake. If you listen to a certain YouTube show with a certain lawyer. You’ll find out people get divorced in Nigeria when they are overseas and the lawyer handling their case will take the money and run. And then send them fake paperwork. The advice to many Nigerians is to get divorced IN AMERICA then remarry their USC spouse so USCIS doesn’t question the validity of the divorce document. OP might not know the full story… her husband might have obtained a divorce in Turkey but used Nigerian divorce paperwork for first immigration benefit. I know a few people get confused and get divorced twice (once in country they live in and again in their home country)… But also, OP might have been lied to by the lawyer in Nigeria- he could have said the divorce was fake when it was actually real…

  8. He will have to remarry the first wife if he wants to petition her. Otherwise he is admitting to polygamy. If USCIS/ the consulate in Turkey didn’t catch the first divorce was fake they’ll probably catch it the second time around. Especially, if they interview in Nigeria. I personally don’t think hubby is bringing first wife to the US. The fact of divorce first wife, marry USC, divorce USC, remarry first wife is a known scam… @Bengoj should submit her evidence to the places @TBoneTX suggested and then move on with her life. The fraud finding/ stripping of US citizenship isn’t going to happen over night… so thinking about this for the next 5+ years won’t be too productive. And bothering USCIS over and over will most likely make it look like she is a bitter spouse not someone interested in justice.
  9. Simple answer: The spouse of a USC can naturalize in 3 years so you need THREE years of savings to support them until they become a citizen. All other family members can only naturalize after 5 years so you need FIVE years of savings to support them until they become a citizen. So, you'll need 3X savings for you wife to be and 5X savings for her child.

I said it might suffice not that it will… You might have to move to the US before your wife interviews… I believe common advice on this thread is to have 3 months worth of paystubs at NVC and/or interview stage. Job offer serves two purposes: 1) it shows you have made moves to return to the US 2.) it shows you are able to make enough to support your spouse. If you do not want to be separated from your spouse during this process AND you don’t have sufficient savings I recommend you get a joint sponsor.
  12. Qualified joint sponsor. I haven’t seen any successful cases of assets being used for AOS case. As you know we used assets for consular processing… but even that is hit or miss as some consulates don’t accept assets either and request JS.
  13. This service is a sponsor of VJ and one of the people working for them posts a lot on VJ. So, if you stay on VJ you will see them a lot and how they interact with others. seeing as you’ve already working with them I don’t know what type of feedback you’re looking for…
  14. What do you want to happen and why? You are no longer on the I864 hook because he naturalized. You can divorce and move on with your life safe in the knowledge he is in Nigeria and you won’t have to run into him.
  15. Correct. At this stage you need to file I130 and I130a with supporting marital evidence. That’s all you need at this stage. You will then wait about a year before you get to the next stage at NVC. Financial evidence is for the I864 and that is at NVC.
  16. Please keep updated on the process. Have you had the medical yet or do you still have to go? There was one other person who had to complete a waiver for his tourist visa (not a medical) so this information would be helpful to others in a similar situation.
  17. You would only need the job offer at NVC stage. It could also serve as proof of intent to re-establish domicile. Do you have an I130/I130a on file? You don’t need to wait for an employment offer from a friend UNLESS you want to try DCF through Warsaw.
  18. Any employment you have should be in the US. A job offer letter at NVC stage might suffice. Joint sponsor would be the easiest option to be honest though. How often are you going back to the US? @Crazy Cat might be able to give more info about the disability.But IIRC you just submit your benefits letter as proof of income. ETA: You can use the difference you need to make up in savings. If you cannot secure employment in the US. Maybe 12-15k in savings?

  20. I think your validity might only be a year. IIRC you want to go to Disney with your kids. You should be fine. But, of course there are no guarantees.

It isn’t… I’ve seen people move countries and leave their pets behind because the cost of moving was 1.) too expensive and arduous and 2.) they could get another pet in the new country… The amount of people who leave the pet in the care of a family member or friend is numerous… OP has already demonstrated she can leave the cat in the Netherlands for 3 months with no issues… so… not a strong tie.
  22. You wouldn’t be in the US without status though. You would be in the US with a U.S.C boyfriend who you could marry and and get a GC through… The consulate isn’t only worried about people staying longer than allowed. They are worried about people who go to the US and apply for a green card instead of getting an immigrant visa through the consulate. So, don’t be surprised if you are denied and they tell you to marry your boyfriend if you want to return to the U.S… But, you’re also from The Netherlands so they might give you the tourist visa no issue… it really depends on if they think you are going to use the tourist visa to LIVE in the US for 3 months every couple of months.
  23. You will only know once you try… I would wait for your boyfriend to visit 1-2 times before you apply for the tourist visa though. If you apply for the tourist visa right now (less than a month after you returned). It makes it look like you are very desperate to return to the US… Good luck! What is the long term plan? Does your boyfriend plan to move to the Netherlands eventually if you have no interest in moving to the US?
  24. I think it would probably be wise to have that statement or a copy of medical as we have been seeing a few K1 AOS cases where they request a medical… 🙃 But as you said not required…
