  1. You can file the petition if you wish. Child would then be IR2. Might be quicker might be the same amount of time. Best to see if you can find out how many interviews Vietnam do every month.

If you know he has any of the medical inadmissiblities: DUI, drug use, harm to self and/or others, refusal of vaccinations, need for a psych evaluation he will most likely be refused and you’ll be given options if they are available to you

  4. The type of health insurance you can obtain depends on the state you live in. Here is a helpful post: If your parents speak English and drive they’ll probably adapt better than if they only speak Korean- unless you live in a place that is walkable and has a good Korean community.
  5. You can’t enter the US with the intention of adjusting status. You are following the correct procedures. If you stick around long enough you’ll realize 1.) USCIS marriage evidence is based on people adjusting status 2.) People who go through the consulate generally just submit marriage certificate and proof of living together 3.) If you enter the U.S. with the intent of adjusting status or CBP thinks you intend to stay- you can be sent back to your home country (and face a ban) 4.) You can visit while the I130 is pending 5.) London is one of the faster consulates and they don’t require a lot of evidence. Poster posted about getting denied entry earlier today… ETA: How would you have joint bank accounts and all the other stuff adjusting status? You can’t obtain that evidence as a tourist… you would have more than likely submitted a similar packet if you had applied for AOS. Then you would be stressing about denial and deportation for not having a strong case?
  6. I would upload a new I864 and not include any of her information. you can submit the letter you wrote and maybe include a request for them in notes to review the new I864 instead of the old one.

  8. Sounds like this interview went better than the previous interview! Hopefully they will grant the visa soon. I feel like it is a good sign they kept the passport!!! Did you mention you had a bank account in both your names (is it US based on DR based) or was this something that interviewer decided he wanted for more proof?
  9. it’s been 2 years since the ESTA denial but 1 year since the B1/B2 refusal. you’re lucky your wife was able to withdraw her entry and return to Japan. I’d be surprised if your wife receives the ESTA with the most recent B1/B2 revocation. I would plan on continuing to visit her in Japan until she is finally able to come over on her immigrant visa.
  10. Yes. You can receive multiple vaccines in one day. I decided to get my vaccines before my medical so I could stagger them… as I heard some people feel unwell after their medical for a few days.
  11. Did you include her income on the I864? / is her employment going to continue when she moved to the US?

In my time following cases an early active review can mean several things: ONE: The case was assigned to another center (you only discover this for certain when you receive NOA2- be aware your case can change centers several times) TWO: Nothing. THREE: 3-7 days after 1st active review you receive APPROVAL! FOUR: Case will only be approved after 12-18 months... this case had amazing evidence - the couple resided together in a third country so they a lot of evidence going back years.... side note: I was told by many to not pay attention to the first active review- only get excited when the second active review appeared. Here is hoping you receive good news soon! If not, remember the average processing time for the I130 is currently 12 months. Also know- the average time from filing to visa in hand is 18-24 months. It doesn't matter how strong your evidence is. I've seen couples married with children wait 12 months for the initial I-130 approval. The only good thing about a case that is well organized is you are less likely to receive an RFE- but then again- the more paperwork you submit- the likelier a page does not scan correctly and you receive an RFE where they request you resubmit the paperwork. If I were you, I would try to forget about the immigration process and enjoy every day. You have a lawyer handling your case- so let him worry about the journey.
  13. Then she does not need your assistance. She should go to the US Embassy Dominican Republic and follow the links to apply for the B1/B2. She will then have to schedule an appointment. New appointment times are released on Wednesday so she should monitor the website on Wednesdays to try to get an appointment time. Currently the wait time for an appointment is 259 days. This does not mean it will be 259 days until she can obtain an appointment. Usually it is a little longer or a little shorter. You will just have to monitor the website to get the best time for you.
  14. So to show you entered into the marriage in good faith- send in the evidence of living together in SC. As you mentioned USCIS doesn't know you lived together after 2020- so in their mind you haven't been together for 4 years. At the same time: file for divorce- I would file for divorce ASAP. Quick google shows an uncontested divorce in VA can take a month or two. Respond to the RFE requesting the divorce waiver and if the divorce has been finalized submit that paperwork. If it hasn't send in the paperwork indicating you filed for divorce. You'll hopefully receive another RFE requesting the divorce paperwork once you request the divorce waiver and the case should not be denied. Third party affidavits can be from people who knew you but were not friends or family. so, co-workers in SC- either yours or your husband's who knew about the relationship. The landlord of the place you lived together in SC. If your husband or you have evidence that you were emergency contacts during your time in SC. It is great that you were added to his health insurance not him added to yours. Do you know if he has any correspondence with his job about adding you to his health insurance because you were relocating to SC? A paper trail showing special enrollment would be great evidence as it will indicate you were working on the marriage. Good Luck! I hope you get that 10 year GC! If not you can always refile... we have several members who've had to refile a denied I751. But hopefully if you respond to the RFE with proof of working on your marriage after 2021 you should be able to counter the picture of marrying only for an immigration benefit. This is also a great example of why immigrants need to always be thinking of the next step in immigration and keeping evidence of shared life with their partner.
  15. Mom will have to show proof of name change with marriage certificate from the third marriage. Did she use her second husband’s name? I believe when you complete the DS260 you have to show all names used AND proof of name change. Mom might receive an RFE for proof of termination of all marriages at the NVC stage. I don’t think your mother will be able to move to the US until she sorts out the second and third marriage.

  18. So you don’t have to worry about the records for DS260. These records only matter if you file the I129F for K3. Im sure you’re aware you need to file the I130/I130a BEFORE you mail in the I129F because you need to include I130 receipt. Personally, I’ve not seen a lot of successful K3s pushing the I130 to approval… and the most successful ones have been when the I130 was at Potomac AND the I129F was filed after a month…. But, the K3 hack doesn’t always work. So, if filing the petition is being delayed because you don’t have the documentation for I129F I personally wouldn’t delay any longer. ETA good luck I wish you a speedy approval.

    How did you become US citizens? Did you both arrive on k1 or immigrant visas OR did you adjust from B1/B2?
  20. Are the records for the USC or the beneficiary? And when was the I130/I130a submitted?
  21. Where are you right now? In the US or overseas? Did you submit the I130 and I130a online and only those documents or did you submit additional forms? ETA: where did you say you were going to interview in the US or in another country?

  23. Am I understanding correctly that you haven’t seen your husband/considered yourself married for the last 2 years? Or you don’t have proof from 2 years ago but you have documentation for 2022/2023?
