  1. Yes, marriage alone does not grant any immigration benefits. @Mike E where's the link to that one thread where someone got deported after getting pulled over in traffic? Submit it as soon as you have everything. As soon as you get the NOA, you will have proof if authorized stay. Some people live for years while in overstay without problems. Others don't. I wouldn't risk it.
  2. There is no deadline for submitting AOS. However, once the 90 days are over your spouse will be out of status and can therefore be deported. All it takes is a run-in with the police (can be as much as getting pulled over)
  3. If she's already going to be here in April, why not marry and file for CR1? That way you can avoid all the extra headache that comes with K1 and AOS.
  4. All any of us can advise it that what you are planning is fraud, and not to do it. Stick with the K1.

  6. But wouldn't that be fraud? To enter on a tourist visa, say she plans to return to her country knowing that that was never the plan? The first time AOS was filed it she might not have had immigration intent, but this time she definitely did.
  7. You should familiarize yourself with the process some more. There is no I-485 involved if you are outside the U.S.

  9. So as I have said in previous posts my first ROC got denied because I supposedly never answered their RFE, even though I did. The denial letter even says, "since you have not responded..." I recently filed a FOIA to make sure they didn't issue an NTA and lo and behold, what do I find in my A-file? My entire RFE package scanned in page by page. I honestly thought that they maybe somehow lost it between the lockbox and the USCIS desk, but no, they actually had it and scanned it in and then denied me for not sending it. It is in my A-file followed by the denial letter for "not responding"! How?
  10. I agree with that. I'd hate to go through all that trouble just for uscis to give you a 2 year card because of a technicality like timezones. Just like you should always wait until a day or two after you can apply for ROC or citizenship
  11. As someone who is currently in the waiting game for my second I-751, what happens to the first petition once the second one gets approved? Could they still issue an NTA afterwards?
  12. It depends. Sometimes they schedule an interview, sometimes they waive it. If it's a clear cut case with lots of evidence they are more likely to waive it, but all you can do is hope.
  13. I could also see people having issues with the whole "willing to bear arms, etc." if the law requires questions. I will definitely have to think hard about whether I want to get an exception to the "bearing arms" part if I ever get the chance to naturalize.
  14. I'm another case of no dual citizenship. If I was allowed dual citizenship I'd apply in a heartbeat. Well actually, I'd wait the extra 7 months to apply under the 5 year rule and save on printer ink. There's just no way I could give up my EU citizenship, especially since I can pass it on to my children.
  15. I've honestly given thought to the whole 'file N-400 and withdraw' thing but I'd be too scared of being accused of fraud or gaming the system. Another plan I had was to get Hungarian citizenship (takes a year or so, but I'd have to learn Hungarian first, then I'd be eligible since I know I have ancestors there), automatically lose my Austrian citizenship when I take on the Hungarian one, and then apply for N-400 since Hungary allows dual citizenship. As is, I will wait a few more years before doing something so drastic. Here's another interesting question though: I just got the ADIT stamp and USCIS did not take away my greencard. If they actually send 48 month extension letters to everyone with pending I-751s, could I use either to travel? Both?
  16. My case may not be moving forward, but at least I finally got an appointment to get the ADIT stamp, after 2 months of waiting for their "within 30 days" callback
  17. This is probably a better question to ask in a german specific forum. I know Germany recently changed some laws surrounding dual citizenship but I don't know what exactly they changed
  18. Were you subject to the 2 year rule? I don't know if it's still the case, but when I had a J-1 visa it had "not subject to 2 year requirement" written on it. So that's what I put when applying for subsequent visas.
  19. Unrelated question, but why did you have a conditional greencard when you were already married 4 years by the time you became a lpr? If you were given a 2 year greencard by mistake, you should have filed I-90 instead of I-751
