  1. There's a difference between allegiance and citizenship. Don't confuse the two.
  2. File form I-864. Tax information needed is the I-864, Part 6, Question 23; transcript required for most recent tax year.
  3. You can correct it at the actual interview. Just let them know. Plus they are going to use the correct info anyways because they'll need the physical passport to affix the visa. Good luck.
  4. Adjust away, now that you know the pros and cons of doing so and are OK doing so. Good luck.
  5. On what basis did your get your J1 visa and how do you know the 2-year residency doesn't apply to you? Does your visa say something along the lines of '212(e) does not apply'? Or similar? There are 3 main exchange program categories where the 2-year residency is required. 1. J1 programs for foreign medical graduates with residency in the US 2. J1 programs in which you receive/received funding from US govt, own govt or international org. 3. J1 programs for teaching skills that are in short supply in their home countries. DOS maintains the list of skills. I'm assuming none of these apply to you?
  6. The general advice is, she should get on a plane and get back ASAP. And refuse to sign any I-407 at entry if pushed. Also, there is a chance she could be sent to secondary but she'll be let in. Good luck.
  7. She was taken into secondary. Even in some situations, you can still be taken into secondary with a physical greencard. Heck, even actual US citizens get taken into secondary sometimes, it doesn't mean you'll be denied entry.
  8. Ha, I wish I could say the gods on mount Olympus used their powers to adjudicate the case.😄. Standard Operating Procedure, as @Crazy Catalready said.
  9. What you need to be proving is physical presence.
  10. Congrats. Now you only have to concentrate on N400 interview. Approval of I-751 without interview is one of the SOP so it's nothing weird.
  11. This may be your only option outside of canceling your flight and rectifying the situation before leaving. Good luck.
  12. I don't see an immigration problem. I only see a marriage problem. Divorce and move on; get a good divorce lawyer. Marriages breakdown a lot of times, and USCIS even allows divorce people to extend their greencards without the help of the ex-US spouse. And you are also on hook for the affidavit of support you signed even in divorce so it will actually be to your benefit if she naturalizes at some point. Good luck.
  13. Check links below: Section - "I became a U.S. citizen through my parent who naturalized or through the Child Citizenship Act of 2000" https://travel.state.gov/content/travel/en/passports/how-apply/citizenship-evidence.html General Requirements https://travel.state.gov/content/travel/en/passports/need-passport/under-16.html High level summary. -Use your naturalization certificate to apply for the child -Both parents need to consent by attending appointment together or filling DS-3053. Unless you have full legal custody.
  14. The stamp guarantees entry through US borders and not borders of other countries. Heck, countries that exempt GC holders can choose to go back to require transit visas for green card holders to travel through their borders; US doesn't control this. Even US requires transit visas for everyone (including permanent residents of other countries) transiting through it's borders except VWP. It's best to do your due delegience and research before booking a flight especially if transit is involved.
  15. Ha. Like everyone waiting will just get pregnant. Then boom expedite to game the system.
  16. Usually a life or death situation is what is required to expedite. However, I have seen expedites approved for lesser things than that. So feel free to try. Since you are at NVC stage, you'll need to send your expedite request to the embassy through NVC. Embassy has final say. Also, the Embassy in Ghana is backlogged to the extent that even if you are approved for expedite it will not necessarily mean faster processing. Good luck. https://travel.state.gov/content/travel/en/us-visas/immigrate/national-visa-center/immigrant-visas-processing-general-faqs.html " I have been waiting for a very long time for my relative to get an immigrant visa. Now there is a family emergency and I need my relative to immigrate soon to the U.S. Can NVC help me? If a visa is available for your relative’s category, and their case involves a life or death medical emergency, processing of your case may be expedited. To request a review for expedite, please submit a scanned letter (or statement) to NVCExpedite@state.gov from a physician (or medical facility). The letter must include the physician’s (or medical facility’s) contact information, and declare a life or death medical emergency exists."
  17. That's not my experience. I always add beneficiary emails and they have always received exact same correspondence as me including interviews. And NVC actually encourages this.
  18. Just answer any questions truthfully, but don't volunteer any information if they don't ask.
  19. NVC will send the info to anybody whose email is in CEAC regardless of whether you petitioner or beneficiary. You can have multiple emails in CEAC.
