I am starting custody battle in court in my home country. My teens live with their dad, who is not allowing them to live with me. I want to time the visas being approved with the court date so that I get the kids' visas around the same 6 months that court finishes. (In a year or two). Is it possible to apply for my visas for my teens without their dad's approval, considering if I win the court case, he will have to approve the visas, otherwise the courts will sign on his behalf. I have not filled in I assume will be i130s, so do not know what they ask of me, or where the USCIS letters would go in my home country, considering the embassy and interviews will be there, and I am in the USA. Could I have the letters go to my family's address in that country instead of the kids' address? Any ideas on how to time this/do it? TIA

Hi everyone! I immigrated to the USA on a K1 visa in 2019, and became a USCitizen December 2023. I am looking at bringing my children (all under 21) to live with me this/next year. I read this on the uscis.gov website: "If you had children who did not obtain permanent residence at the same time you did, they may be eligible for follow-to-join benefits. This means that you do not have to submit a separate Form I-130 for your children. In addition, your children will not have to wait any extra time for a visa number to become available. In this case, you may simply notify a U.S. consulate that you are a permanent resident so that your children can apply for an immigrant visa." Does anyone know how to go about this? I recently got naturalization. Married to a USC. I want to bring my 14 year old son over to live with me. How do I go about this, and how long does it take? Can he move to me while paperwork is processing? Thx

I immigrated to the USA 3.5 years ago and my children stayed with their father abroad, I was going to settle for a year and then we would look at visitation. Before I left, my ex typed and we signed a maintenance agreement which was never filed at court, but he understood that it would take 6 months for me to be able to work and was gracious in that regard. When I arrived here, and looked at the job market I realized I would not be able to afford to pay him what I said I would (he typed the agreement up and said I must pay what he had been paying, but he had a corporate job and I have never had one). I kept in contact with him regarding this. AS soon as I got my green card COVID hit, and everything shut down. I was unable to find work until July last year (2021) and I sent him 25% of my income. I worked from home tutoring kids as that is what I have always done. I am currently studying and my ex has refused to accept any money from me unless it is the amount he wants ($800pm). I can't send that, so I have opted to pay money to the kids school directly, which I have done all of this year. Recently he got an attorney and said I owe a ton of backpay for the last 3.5 years, at the rate of $800. There is no court doc stating what I should pay. He will not write a letter saying I have paid. I have all my proof of payments. What on earth do I do for my application??

How do I fill in N-400 Part 9 if I'm filing after 3 years being married to a US citizen? It asks for total days outside USA in the last 5 years, but I have only been here 3.5 years. Do I include the year and a half I was living abroad initially in my days?

I am applying for citizenship soon, as I married a US citizen. Once I am a citizen, can I only apply for citizenship for my children under 18 who live abroad, if they were to live with me in the US? Or can I apply for citizenship for them while they live abroad?
