    My fiance is in Philippines and I am in usa. We filed 129f on march 3.

    I have two kids for whom im partially responsible. It specifically asks on the 134f if i am fully or partially responsible. Do two partial children count as one full? They do not live with me and i don't claim them on my tax return.

    Also, I have a 401-k that can be easily liquidated within one year. I am at the income requirement for myself, my fiance and two partial kids counting as one full dependant. Has anyone ever used a 401K as an asset?

    Oh finally, I am self employed but also started a part time job that pays 300/mo. can i use the 2006 income tax return (for self employed) plus paystubs from the part time job, which i started jan 2007 and is permanent, at the same time?

    Who is a good attorney to do a consult with if i need more help?

  2. Does anyone know if the US embassy in manila uses 100% or 125% of poverty level as an income guideline?

    I know technically the 134f uses the pre 1997 i-864 guildelines which are 100% but I heard different embassies use different amounts.

    Also, I have 2 children who don't live with me but are partial dependents. Is this counted as one full dependent in figuring the family size?

  3. I have a fiance in the philippines. We are filing for K-1. I have 2 children that aren't listed as dependents on my tax returns. I also have a small business. In addition i have gotten a part time job recently. My adjusted gross income for 2005 was only 11,000us my unadjusted was 29,000 big discrepency due to startup expenses. It is much higher in 2006. My ex wife owes me 50,000 from equity in our house. I have documentation of this. I have money in a 401k as well.

    What is the best way to file all this in i-134? Can i use the 401k or the owed money? Do i have to list my kids as partial dependents on the form?
