  1. In reference to the following post ..

    Are there any other filers on the list from the Denver ASC office that can say how quickly after their NOA receipt date their Biometrics appointment was scheduled? I know this information isn't necessarily a way to get a set in stone date, but it should give some indication as to a trend. I'm sure there is some way to find this information from the board but I am not as "board savvy" as some here are..

    Just a quick question by looking at all the timelines. We are outside US now and probably our Biometrics notice is sitting in our mail box. I was not expecting to see these early appointments, specially some occurring the first week of October. My husband will be back in the US on October 4th, so he will be able to check the mail, but I am not back till the 9th. If our bio is later than this date no problem, but what happens is we miss it? has anyone had any experience rescheduling it?

  2. I just noticed something about your Philippine flood picture ..

    Take a look at the house, the design, the wood around the doors and windows, the fact that there is a kitchen inside the home and that there are multiple rooms .. my guess is that this home is not owned by poor family .. chances are, the POOR housekeepers are the ones cleaning .. LOL

  3. There are WAY too many opinions for mine to shake up the agenda at all but let me voice it none the less ..

    MOST Filipinos (and Filipinas) are very resilient as are MOST Americans .. the pictures that are missing from the original post are of the volunteers from all over the country coming to help out with the flood victims, cleanup, etc. and pictures of people opening their homes to the flood victims.

    In the US there are alot of people that feel that they are entitled to something simply because they are Americans (more than likely the ones in the original post) they vote for the party that they feel is most likely to give the handouts, they settle for what the government gives them, etc. etc.. Other Americans use their God given abilities (along with the free trade system, ingenuity, and drive) to do something that betters their lives. This opportunity is also afforded to the Americans in your picture but they more than likely find a way to blame someone else for their predicament (education, environment, unemployment, etc.) Regardless their excuse, the opportunity is there ..

    The real difference between your two pictures in my opinion is this .. the people in the U.S. have the opportunity to make something of themselves and choose not to, the people in the Philippines would probably do something to better their lives but a corrupt government, overpopulation, poor economy, and resources keep them from doing so. This may very well be the OP's point, and I agree if it is; but please don't feel compelled to generalize all Americans in this way.. I would like to think that there are lots of folks out there that wouldn't loot and steal in this same situation.

    As for religion, I think that plays a roll in it as well .. but not because God has made them better poeple, rather because religious people live their lives closer to the examples and commands of the bible; it is a great guide for that specific purpose !!! Prayer in and of itself probably doesn't determine a persons destiny, I do believe it brightens their outlook and centers them daily to return to their beliefs. I know people that pray every day, people that pray on Sundays, people that go to church on Christmas and Easter, and people that wouldn't know what to do with the crackers and grape juice .. each group has good people in it but you are far less likely to find a "bad seed" in the group that prays every day !!! I am speaking of Christian beliefs because that is the only religion I have any first hand knowledge of, I am sure it is a similar story with other religions as well.

  4. HELLO!!!! It's sooo nice to hear from old friends. Thank you all for the response, it helps to ease some of my worries. I've been trying to call USCIS but it's so hard to get a live person.

    I included my son, John, in the I-751 form and paid for two biometrics. While I received a NOA (I-797c) extending my status for one year, John received a separate letter from DHS-USCIS in plain bond paper called "Verification of Inclusion of a Dependent in Filing of Form I-751". It essentially tells him that he is "included as a dependent in the request for removal of conditions by the above-named principal alien and that this verification extends the validity of your alien registration and allows you to remain in the United States, with work authorization for one year from the filing date or until a final decision is made on the request whichever comes first."

    And so I received my biometrics appointment but John did not. If I don't get a live person at the USCIS or John does not receive a bio apppoinment in the next few days, I will just make a decision to pick him up from school so we can do biometrics together. I am sure that once I explain our circumstance at the Service Center (you know, drive 7 hours each way to pick up/drop the kid) that they will let him do it.

    I'm pretty sure that you will have to at the very least know what his actual case number is. There is one on the "Verification of Inclusion" letter but it isn't the actual number that is used for biometrics. I have been told by a couple of VJ members that without that number they CANNOT do the biometrics for your son's application for ROC.. simply because they don't have any reference where to enter the information. Hopefully the letter arrives soon.

  5. So we are getting ready to file the I-751 and I just had a question about how to answer #7:

    Have you ever been arrested, detained, charged, indicted, fined or imprisoned for breaking or violating any law or ordinance, or committed any crime which you were not arrested in the US or abroad.

    So i got denied entry and was allowed to voluntary withdraw my application, had to return to South Africa to file for a K3 visa, got the K3, came to the US and filed the I485 and received my conditional greencard in Dec 2007.

    So I would answer yes to this question? Seeing as i was 'detained'. Is that right?

    Don't want to make any other mistakes with the USCIS.

    Others here are better versed in USCIS regulations than myself, but my interpretation of the question that you have quoted above can be interpreted as such ..

    IF you have EVER been arrested, detained (held by authorities / like in jail), charged, indicted, fined or imprisoned for breaking a law then you would answer yes.

    IF you have ever committed a crime but were not arrested for it then you would also answer yes.

    In reference to your DETAINED / DENIED ENTRY statement, without more information as to why you were denied entry I cannot offer an answer. Detained by definition simply means held (as in jail) by authorities for breaking the law. Denied entry simply means that you were refused entry into the U.S. This being said, unless you were denied entry because you violated a law or an ordinance then your answer would be NO.

  8. Thanks CountryBoy! I will check them out on the web and see where exactly are they.

    I noticed we have very similar timelines, have you received your appointment for biometrics? Here is my problem, I will make a separate post and see what people think: I am leaving on Friday morning for 2 weeks on an international trip. I was hoping to get my biometrics notice and do a walk-in... but so far we have not received it yet. I am afraid I will miss it if the note arrives while we are gone. I was thinking of going tomorrow morning (after mail man delivers) and explain my situation... it is a try and maybe I will be lucky...

    My wife hasn't gotten her bio letter yet, but for some odd reason a member whose NOA was dated 10 days after my wifes received his bio letter today... looking at past timelines I am not late, he is just very, very early .. I guess anything is possible.

    You can't get the bio done without the appointment letter for sure .. if it gets there tomorrow then go for it OR if you are leaving late enough on Friday and the letter arrives that would work too, however just showing up without the letter is out of the question.

    Even if you don't do your bio until you get back then you'll only be 2 weeks later in the entire process. To be honest with you, chances are your actual bio appointment will probably be scheduled for a date after you return anyways..

  9. hi friends i m asking this question for a friend of mine who just got conditions removed from his residency recently . he and his wife r a married couple since 4 years and they r still living together .so the question is can he file for Citizenship now or does he has to wait few more months ? he got his CGC in 2007 and got his 10 years in september 09 .thanx

  10. The relevant link to the proper form ( I-90 ) is HERE

    Open the instructions for filling out the form at the bottom of the page and note the following 2 paragraphs ..

    Section 1, paragraph 1 .. do not use this form if your green card is expiring, use I-751 to remove conditions (paraphrasing) - since your green card isn't expiring then you DO need to use form I-90.

    Section 2, paragraph 2 .. use this form to update your card after changing your name or other biographic data (paraphrasing) - that sounds pretty clear ..

    If you really want to know if you have to do it, setup an infopass appointment at your local office and ask .. that's free. If it was me, I can read what is written on the I-90 instructions very clearly as stating that I should do it. Spending that $370 may very well save you alot of headaches in the end.

    They don't care about your original date if the date is not expired.

    I went a month earlier and they accepted .

    Go there on weekdays ( but Monday is closed ) early in the moring.

    I went there at 9am and very few people were there and it took me only a half hour.

    Don't go there on Saturday at noon. It was so crowded and it took me THREE HOURS to get done.

  12. I don't know that the name matters that much or if the info I tell you here will be relevant to your case at all but...

    I did happen to talk to my circuit clerk today about getting my step-daughters name changed, she said that if I adopt or attempt a name change before my step-daughter gets her citizenship that it is a real pain in the butt. She said I will have to hire a lawyer if I want to do it right .. according to her the name change itself is granted thru the court first and then all name changes elsewhere are done by providing proof of the name change to them, but to get it accomplished a lawyer will have to fill out several papers, supply birth certificate, get paperwork from the philippines, etc. but if I wait another year and she becomes naturalized then I pay $160 and I can get it done within a week without a lawyer.

    Now, that being said .. my step-daughter is a minor and that may play into the complication involved with her name change. Since you are not a minor and had the opportunity to change your name at the time of your marriage it may be as simple as contacting your circuit clerk (or whoever you get a marriage license from in your state) and signing a paper. I'm sure changing your name thru the bank, uscis, ssa, irs, etc. etc. is what will take some time ..

    I entered the usa under f1 back in 2004. I was happily married and I adjusted my status to 2 year temporary green card. My wife had a family emergency and had to leave the country, we were not expecting that she would stay away very long but things happened, like her sister dieing. While she was gone my temporary green card expired, I lost my job, and I had been going through a rough time; when she came back and we start looking to get things together again we had a hard time .. I had suffered alot and I looked at things differently but I couldn't do anything. I have being consulting with attorneys and they kept telling me something about my not being able to file by myself because I am still married. Things went down hill between me and my wife and we felt we couldn't stay together anymore. Now I'm divorced and I'm filling by myself.

    I don't know how it is going to work out for me

  15. We are going to be able to get a number of affidavits, all notarized. Some are from some big-wigs in NYC (like a guy who runs one of the hospitals). That should help. My best friend and the best man at our wedding provided one prior, but I am going to have him do another one and get it notarized. He met Anh prior to her even coming to the USA. I was with Anh in Germany and he was there on a three hour stopover, so we had lunch with him at the airport. He owns three businesses and even teaches knife disarming to NYC police officers. I mean, how much better of character witness is that?! Like HE would lie about something!

    Sounds like you have this pretty well covered .. however, you need to make sure that each includes the information relevant to your specific case...

    #1 .. include the submitters current address and place of birth

    #2 .. establish your relationship with the submitter (photos etc.)

    #3 .. establish that the submitter has witnessed your relationship on a very regular basis over the period since your wife arrived

    #4 .. establish that the submitter believes that you and your wife are in a genuine marriage with no intentions of skirting USCIS regulations

    #5 .. have the affidavit notarized (thus the sworn / affirmed statement)

    Like I've said before .. I don't have first hand experience with RFE's but from all I have read this is the format of choice and the one that I chose ..
