  1. That's not switching per se as you start the process from the beginning including the wait time. But yes, the spousal visa is superior to K-1 - as: one is a permanent resident from day of POE, can work right away, all the time since entry to the US counts for residency time for citizenship (unlike with K-1 where you're not a resident until GC approved which can be even after 12-24 months).
  2. 1. You can put whatever you want but the visa will be issued in the passport name. Unless that is changed post marriage, the green card will come in immigrant visa/current passport name. 2. It can be listed in both Chinese and romanized transliteration - not a problem.
  3. Can’t use primary residence for I-864 purposes (assets) as it would put you in a disadvantaged situation if you had to sell it - as in where would you live?

How not to overstay? Depart on time. What is your home country?
  5. Oh but it will be I had no idea this will ruin my life (2-3 years after the surgery) and now I want to go back. Parents should just do what Europe is doing and focus on mental health issues (therapy), cut off internet/tiktok and similar bullpoop and kid will outgrow the "need" for gender affirming care.
  6. Send a letter withdrawing your petition to the address listed on your NOA-1. List your details as petitioner and beneficiary details (full name, dob, pob).
  7. I-864 would need to be updated as your household size changed.
  8. Involve your congressional or senator's immigration aide to help with this. They'll get you results fast.
  9. Test now (rapid test) and if it is covid, stay home for 5 days. If you had covid, you can test positive on PCR for 90 days following infection. As a K-1 immigrant, you can opt out of any vaccines and get them in the US (just go to your local health department and they'll give them to you).
  10. You really don't want to get any vaccines if your immune system is down and you're not 100%. That includes having sniffles. Go back when you're 100% even if it's July.
  11. Did you as a USC petitioner file I-865 and mail it in as you were supposed to? That updates the address for sure.
  12. I've just deleted about 200-300 accounts. Looks like started in the past 7-8 hrs. Will keep at it for another couple hours until bedtime.
  13. Depends what's needed for registration - if it's SSN, then you'll have to wait until you get it (if you marked yes on DS-260 it will be assigned to you and sent after your entry into US and visa activation).
  14. Upon entry to the US your immigrant visa turns into temporary (1-yr) green card until your plastic card is mailed to you. There won't be a work permit as green card is all you need. Unrestricted social security card plus a driver's license is what you'll want to use for employment purposes. No employer can tell you what documents to produce for I-9 - that's all your decision.
  15. Separate piece of paper with the sponsor info and explanation of him being a veteran and where his income/benefits come from. This is in case they overlook the paperwork provided DD-214, benefit letter.
  16. Each individual needs a separate I-864. Same for I-864A.
  17. Exactly. If he's not currently working he's unemployed. This is when the personal statement in addition to I-864 will explain the matters.
  18. He's not employed by VA, he's receiving benefits from VA for his disability/service.
  19. As soon as you're processed at POE you'll get a stamp in your passport - page next to your immigrant visa and that will turn your immigrant visa into a temporary green card. You're then a green card holder aka LPR and that's your date for counting to I-751 (if applicable) and N-400.
  20. You actually CAN file I-865 even if you have yet to file I-864. I've done it twice while I-130 was still pending. Updated with no issues, confirmation letter received both times and I still haven't filed I-864.
  21. 1. So people don't turn around and use green card as a tourist visa. 2. Totally normal. Not a contradiction. Rule is that the USC petitioner must be in the US or come to the US when the immigrant comes.
