  1. Thank you so much, an administrative correctiom of the original birth certificate could be the best and right path to go unless it takes a long time. Otherwise I will take the risk and just submit a higher resolution scan document with a letter explaining the situation hopefully they will take. Other question. I also received the following message from NVC: 3: No document requested by NVC but just a quick inbox message by NVC: The petition you have filed does not allow derivative status for family members. This means that any spouse, unmarried child under age 21, or parent will require his or her own petition to immigrate. -- What do they mean by this? When my wife filled out her DS-260 application, when asked for child, she entered our kid's info but there was a question asking if the child is also immigrating to the US and she answered yes because child is currently living with mom in Peru but our kid is a US Citizen, our kid obtained US Citizenship through CRBA in Lima Peru. Should I upload a copy of our kid CRBA certificate just in case as an additional document? or this is irrelevant?

I just spoke to my wife and is possible for the original birth certificate to be corrected legally by Reniec (authority who issues the certificates) in case the info is missing, not clear enough or in case the info is wrong. Can a correction of this document help? For sure everything will go through a process, wife need to have a valid reason to correct her birth certificate such as the hand written info is not visible or clear enough.
  3. Thank you for your quick response. I was also thinking the same, since I don't see anywhere in the NVC website that they will accept or required the translation in case the original document is not clear enough. How about if I apostilled the document translation by the foreign affairs office in Lima along with the original birth certificate? Can this validate the translation?
  4. The problem is the original document, not the scanned document. The original document contains hand writing info back from 1996 that is hard to read and before the 2000 is no possible to get a digital copy of the document. The original document is the right certificate, and the true certificate. And NVC rejected for the reason above. So I was planning in uploading the English translation along with the original document, or... Make the translation document apostille and legalized in case nvc takes it. Please guide me.
  5. Yes. I have the right document, from the right source, with the required seals. Only problem here is that this document is not very visible since some info was hand writing back in 1996, according to NVC they rejected the document for this reason: Part of this document is missing or is difficult to read. Please replace this with a scan that shows the complete text of the document. Please ensure all sides of every page are scanned and visible. This is the reason why my plan is to upload the English translation of the document along with my signature certifying the translation. Can you please tell me if I'm in the path? I'm really thanksful for your time and info here. You helped me a lot through my journey here.

This is what I found in the link above regarding my question: Special Seal(s) / Color / Format: Certificates vary in form and can be transcriptions in long hand, typewritten on a template, or microfilm photocopies of the original record. Pardon my ignorance but can you please help me understand this here? Does the above info means I can transcript the original birth certificate and upload to the NVC? I worked hard yesterday in translating the birth certificate to English and keeping the same format just in case NVC will accept it, but I want to do things the best I can I can't avoid delays.
  7. Thanks for your response, the info above was very helpful, it cleared a lot of doubts regarding the divorce decree. How about my wife's birth certificate that was rejected by NVC? The birth certificate contains some info in hand writing back from 1996 and is not very visible or clear for someone to read it, even though my wife is able to read it. Getting a new birth certificate won't help since it will look the same. Can I upload the english translation of the birth certificate along with my signature of certified translation? Or do you believe this document will need to be translated and apostilled by the foreign affairs office in Peru? Thanks.

Hi, Looks like my divorce decree from the notary also called *Testimony* is what the NVC is asking and not the simple page from Reniec but I am still confuse regarding the birth certificate for my wife, the info that was writing by hand back them by the registrar is not clear enough and I believe this is why the NVC rejected. Can I just upload an English translation of this document made by me? Or it needs to be professionaly translated and apostilled? Thanks.

Hi and thanks to all of you who responded but I haven't be back here since I submitted my documents and I just received some news from NVC. 2: Wife's birth certificate: NVC Response: Part of this document is missing or is difficult to read. Please replace this with a scan that shows the complete text of the document. Please ensure all sides of every page are scanned and visible. - Birth certificate is well scanned in color, but since this is a birth certificate before the year 2000, some info was written by hand and is hard to read. I don't think submitting a new copy of the birth certificate will fix the issue since it will look the same. Can an english translation and certification (by me) of the birth certificate fix the problem? (even though this is not required by NVC since the original document is in the same language of NVC's location) or my wife need to contact her municipality who issued the birth certificate and try to get a digital copy or another format. 2: Petitioner previous marriage in Peru, divorce decree NVC Response: Please replace this with an acceptable divorce, annulment, or death certificate from a correct issuing authority. - I previously married in Peru, and I also got divorce in Peru. The document that I uploaded was an original document that shows my previous marriage info and second page shows my divorce info, the divorce info is very limited, maybe 2 or 3 lines. This document was obtained from the *Reniec* in Lima, Peru which is the National Registry of Identification and Civil Status. I got divorce through a notary in Lima, Peru so my thought is that they are requesting the divorce decree or resoluction from the notary office which is about 5 pages? and not just the simple document from the (Reniec)?   10. Hi, There is one more question that I completely forgot to ask regarding this topic. If I was married before here in the United States, should I upload my divorce decree or certificate to NVC? I am asking this because according to NVC website, they are asking for the civil documents for the immigrant visa applicant and not the petitioner. Of course it will be a good idea if my wife can provide a copy of my previous marriage to NVC at the time of the interview in case they ask for it but my question is, should I upload my divorce certificate to the NVC portal now? Thanks!

  12. Thank you for all your information and please correct me if I am wrong. I'm just trying to learn as much as possible here and once again am thanksful for all the info. I just called my benefits case manager to ask her some questions and she told me the following: 1: In order for my wife to be able to live with me under my housing program, she needs to be a US Citizen or green card holder for at least 5 years besides having a low income requirement or been disabled. 2: I called my local social security office and they told something similar, my wife won't be elegible for any cash assistance benefits unless she qualifies on her own as a disabled individual and low income plus been a US Citizen or green card holder for at least 5 years. If everything goes fine at the interview, most likely my wife will be getting a conditional green card not even a permanent green card and by been married to me, does not mean my wife will automatically qualifies for public benefits. In conclusion, how can she be considered a public charge if she doesn't even qualifies for any type of benefits on her own? Once again, please correct me if I'm wrong. I am just trying to gather as much information as possible and hopefully this info helps other people in my situation. I don't believe I'm the only one in this situation trying to apply for a family green card.
  13. You are totally right about this. In order for my wife to live with me, she needs to meet certain income requirements, meaning she will need to earn little income which is not the goal here since we our child living with us, my ssi payments won't be enough to cover expenses, family can help support us in the meantime but that's not also the goal here. In this case, I will eventually need to give out my rent benefits and find another place to live with my wife and kid, a place which won't be subsidize.
  14. Hi As I mentioned earlier, I am currently living on my own, I have my own apartment for which I currently receive rent assistance, section 8. I been living on my own for the past couple years. Having my apartment even though is subsidize, helps at all? Can this be considered income? I monthly receive rent payments for my apartment as well. How will NVC could consider my wife a public charge without giving her the chance to arrive here in the US? I mean I am the one who is disable and getting the benefits, my wife won't be getting any disability payments or any cash payments at all she is not physically or mentally disabled and is still young and can easily find a job.

  16. Wife speaks and understand basic English language, is young less than 28 years old. Previous job skills can be as a secretary doing office job and computer skills. Housing plan is for my wife and child to live with me in the meantime while we find a better place to live. I'm currently studying to finish my career in computer network so I can find an office job, I am also about 30 years old and I know I should had finish my studies before but I guess is never too late. Should I continue with my plan and submit the i864 along with the DS-260? Or should I wait and find a better sponsor with a higher and 3 year income history? Thanks!
  17. I'm sorry for the late response but I was doing my homework and looking for more information on my own. I am really thanksful to people like you and others who take some of their time to respond here. Regarding your point about the decision making process at the NVC, I'm not ignoring it. Actually this is what is keeping me busy and maybe over thinking it. At first I thought about finding a better joint sponsor but if my niece is good enough even for her age and only one year of income, I will just go with her. At the interview, my wife will simply just tell the truth, always the truth, she is no comming here to be a public charge, since what I get from SSI won't be enough for the 3 of us, so her plan is to find a job as soon as possible. Also, besides getting my ssi payments I also get rental assistance and I been living on my own for the past couple years, even though I am physically disabled I am very independent, and I will help my wife take care of our kid. By the way, does my rental assistance helps? Does it counts as income for me? If so, should I also include it? Thanks.
  18. Hi, thanks for your reply. According to USCIS a sponsor with a household of 2, needs to meet 125% of HHS poverty guideline which is $24,650. Please correct me if I'm wrong. My niece's gross income from last year 2022 was about 50K and her current income for this year 2023 is about 31K. Can my niece still qualify? As I mentioned earlier, my wife is not physically or mentally disabled and she should be able to find a job with the help of my family here. Is not the purpose of her to be a public charge here, even myself i am planning to finish my studies to get out of public charge and find an office job where I can transport myself using my power wheelchair. I want to make the i864 as simple as possible and straight forward without asking another family member to be a joint sponsor. Please guide me to the right path, and I am really thanksful to all of you who replied. Thanks again!!
  19. does the gross income counts as per paycheck? Or the total amount she takes home a week? For example her gross and current income per week as of today is about 800$ a week but the total amount she takes home is about $650. Which of the two should I include? I'm afraid that she won't be elegible as a sponsor. Can you help me here please? Thanks!
  20. Thanks again! Sorry to ask you this, but if I decide not to include my SSI Income in the i-864 form, what should i enter here instead? 0? Regarding my niece i-864 form, where it ask for current annual income, is this the income that she is expecting to earn this year correct? and not the income that she made last year.   21. Thanks again for your quick reply! My niece is about to be 21 years old, single, no children so I guess her total household in this case should be 2, counting her and my wife. In current income for my niece i-864 form I entered 35K since this is what she is expecting to earn this year, last year 2022 she made about 50K because she worked 2 jobs. Did I answered this correctly? Correct me if I am wrong. I have pretty much all my family here in the United States, most of them are US Citizens and green card holders, they alll are currently working but all of them have dependents, so my niece was the better option as a joint sponsor. My wife is not physical or mentally disabled so I assumed she will find a job to support herself with the help of my family here while she attend college to find a better employment opportunity. To conclude this, should I include my SSI income as my current individual total income? I read in other places that NVC don't count SSI as income and therefor should not be included in the form. If you can guide me here I will be really thanksful.
  22. Thanks for your quick reply, here goes the other part of my situation. We have a 2 years old daughter who was born in Peru but already adquired US Citizenship through CRBA. My special need for my wife to be here with me is my daughter, who inherited my medical condition and needs medical treatment here in the US, is nothing mayor or no life LIFE-THREATENING but needs medical treatment. Our daughter is still very young and needs to travel with mom, this is the main reason why I need my wife to be here with me. Also, in my i-864 form, should I include my daughter in my household? Even if she is not living here in the US with me? Regarding my SSI income, should I include this in my i-864 form? I read in other places that SSI don't look good for NVC. Thanks!
  23. Hi, I am originally from Peru living here in the United States as a US Citizen. Last year, I submited the i-130 form for my wife who is currently in Peru and the petition just got approved last month and now I am in the process of filling out the i-864 affidavit forms. My personal situation: I am a physical disabled individual, never worked before and my only source of income is SSI $950 a month (Suplemental Security Income), no other income and not personal assets. I am not required to file taxes and I asked my niece who is also a US Citizen to be my wife's sponsor. Last year, 2022 was my niece's (sponsor) first time filling taxes and she made around 50K. Question 1: Can my niece be good enough to be my wife's sponsor with one year only of income tax? She is still employed and currently working. Question 2: Form i-864 for myself (the petitioner) Part 5: Question 7 My current individual annual income. Is this referring to work income only? or should I add my SSI monthly payments? Question 3: Form i-864 for myself (the petitioner) Part 6: Question 20 My current annual household income is: Should I add my monthly SSI payments? Does SSI payments counts as annual household income? Question 4: Form i-864 for my niece (the sponsor) Part 6: 23.A Have you filed a federal income tax return for each of the three most recent tax years? I answered to this question NO because my niece only has one year of income tax. Did I answered this correctly? Question 5: Form i-864 for myself (the petitioner). I am not required to file taxes and my SSI payments are below the poverty line. 1: Should I include my social security statement where it shows all the years that I never report income? 2: or should I attach my social security benefit verification letter where it shows my current SSI payments? Filling out this form is very important for me since I don't have the money to hire a lawyer and I have a special need to have my wife here with me.
