  1. If they're approved at the same time, then the I-130 will take longer. After approval the I-129F goes to the NVC, then on to the consulate. The I-130 it looks like needs to be requested to be forwarded (for a $200 fee) for NVC processing and there's a whole flowchart of things at that level before an interview.

    The CR is the better visa though since it is an immigrant visa. The K3 is non-immigrant and you have to adjust status upon arrival, however, it reunites you with your spouse much faster. If time is not of the essence, then go for the CR/IR over the K3.

    SUSPICION OF PROSTITUTION AS GROUNDS IN THAILAND:

    In Thailand, where some women work in entertainment establishments such as go-go and hostess bars, there are concerns that this employment may be connected to prostitution and therefore establish grounds for inadmissibility. If the BCIS determines that the woman was actually involved in prostitution, this may result in grounds for inadmissibility. However, an application for a waiver can still be applied for.

    If the BCIS independently discovers employment that could be deemed as prostitution they will interrogate the individual in order to confirm or deny such employment. If a visa application failed to list such employment (whether directly involved in prostitution or otherwise) this could result in additional investigation which may complicate the future waiver process.

    In the event that there is a criminal record of prostitution occurring within the past 10 years, it may be advisable to submit the waiver application subsequent with the visa application.

    The BCIS Bangkok Office will not provide any advisory opinions as to the likelihood of an application being accepted or rejected; applications and individuals are considered on a case by case basis.

  3. You know what's funny? I was thinking.. what a quirky question (wasn't making the connection).. and then I JUST realized after reading your post that I have to do that in a week!! Hee heee.. fly back from Montreal without my Passport.. HOKIE.. I'm not too bright sometimes :) I'll be sure to bring my driver's license. LOL

  4. Does she pay taxes at the massage place? One thing that some people may be asked is if they have been involved in prostitution within the past 10 years during the consulate interview. Doesn't matter if she didn't have sex with clients because it could still be viewed as prostitution.

    You may want to find someone else from Thailand and ask them about consulate questions, etc.

    If she lies, she could get busted and barred. If she tells the truth, she could get denied. Don't really know what to tell you.

  5. I just thought of something. What ID do you need if you are flying within Canada if you don't have a driver's license? I always fly with a passport even within Canada so what do you need if you don't have your passport (since the consulate keeps it) or a driver's license? Ontario has photo health cards but they can't be used as ID in a lot of places, even to buy cigarettes or booze.

    I wonder if I should even try to catch it at the NVC because as Jimmy the American said, Montreal transferred it without even asking for an address out west (that would be ideal for me). It might be easier to wait until it gets to Montreal. Oh this process just makes me all neurotic and crazy! :)

  7. Be honest and definitely bring the interview letter and possibly a copy of the K1 package you submitted along with copies of the NOAs to show that you are not the one trying to immigrate to Canada, but he's immigrating to the U.S. Also proof of ties of course.

  8. Bumping this since I got NOA2 on January 9. :happy dance:

    So my K3 is on it's way to NVC and hopefully just a short pitstop before it gets forwarded. I'll start calling them on Monday to see if it's been received/forwarded, etc.

    Okay, I have read a number of ways to request a transfer (wait for packet 3 then call or call and request once it gets there) but, has anyone successfully received a transfer direct from NVC? If so, how would I do that?

    Or should I just wait until Montreal receives it and then just call and ask to transfer to Vancouver? Ideally, it would be nice if I didn't have to give an address out west like in Jimmy's case but I have one if I need to. I noticed there's also an additional form that Vancouver issues out with Packet 3 that Montreal doesn't so I'd like the Packet 3 to come directly from them.

    Any additional advice or suggestions or comments?
