Medical Exam Before Interview Date
Loren Y replied to ZC92's topic in IR-1 / CR-1 Spouse Visa Process & Procedures
I checked the current review time, and it is only about 20 days. That's faster than usual, as it was closer to 70 days. -
Won't even make it that far. when my wife applied for a tourist visa with a pending K1 she went to the interview and they didn't even let her sit down. She walked to the window, they handed her a denial letter and that was it. didn't say one word to her, or like I said, even let her sit down. same thing will happen here. should have saved the 160 bucks.

This is how Fed-ex/ amazon, most drivers operate due to them being forced to get their numbers up to look good to the boss. Many times I will see UPS, Fed-ex, Amazon drivers scanning multiple packages at one of their stops. they are making them delivered with the scanner before they actually deliver them to keep ahead of the game and look like they are working hard, then they forget what they scanned and didn't, and the don't have time to deliver all the packages, and one that they scanned is left for Monday. This is further guaranteed on a Friday because it was almost Miller time, and driver wanted to go home.

Her passport should have been stamped. I just called my CBP friend in Calgary, she was working right now actually, and said as of today they are still stamping Immigrant visas. Ir-1/ CR1, etc. She was actually kinda shocked when I told her someone arrived and didn't get a stamp. It's really not optional. she said looks like some retraining is in order.

All the info is correct , and you are right also, if you have a valid visa for another country in an older passport, you carry both with you. My 10 Year China visa was put in my US passport with only about 6 years validity left, so I still have a few years I can use the old passport if necessary, along with my current US passport.

I also used double sided supporting documents with all the petitions I have filed. No issue, I never double sided any of the official USCIS forms themselves, but when I did the wifes I485, all the credit card, bank statements, utility bills, etc. were double sided, same with K-1 packet from the beginning, supporting evidence double sided.

I wouldn't worry about the license right away. My wife Naturalized on the 6th of April, we did the SS office same day, and applied for passport the next, but we are not doing her license until the 26th or 27th of this month. She has always had a real ID from the start, even with her temporary ID card when she arrived on her K1, the only thing you do for real ID is prove your address with utility bills, and bank statements and such. She used her restricted SS card even, and still got a real ID issued. So just about anyone can get real ID as long as you can prove your address. Don't think anything has to be done for the Drivers license anyway, but every state is different when it comes to State issued ID's. The US needs to get in line and come around with just about every other country in the world, and begin issuing National ID cards, then it's the same everywhere. My CDL is a Federal ID now, and I can use it alone to enter Canada and Mexico. I think it is called an Enhanced ID. Some states are beginning to issue these also I believe, and for that I think citizenship would come into play.

K1 wait time
Loren Y replied to Abdl_My's topic in K-1 Fiance(e) Visa Case Filing and Progress Reports
Usually you set up the delivery method when you fill out the forms, or at the interview. Usually it is Mail, or pick up at embassy. Once it changes to issued it means the visa is printed and in the passport. This is embassy specific also, I know the US embassy in thailand, once it is issued, you will have the passport back in 3- 5 days max. You can pick it up at just about any post office in the country, and you select it when you schedule the interview. Maybe check for anyone else who processed thru your embassy, and see if they have some comments or notes about getting their passport back, or how long it took. Also, double check you have the right email, most embassies have the main email, and then the actually Visa unit will have their own email and be more familiar with your case. If you got that response from the visa unit, then it is probably accurate, but I understand, 23 days seems a little longer than usual. -
Hello, If you can get to Las Vegas any morning I can get you married with certificate in hand within an hour. License is a little over 100 dollars, copies of the certificate are 20 dollars each. I don't charge VJ members for my services, so it is a pretty reasonable and quick way to get a certificate in hand. I have had people get the certificate and have their package ready to mail, and they have mailed it the same day. Message me for my contact information, and I can give you more information.

I have a CDL, and have had one over 20 years. If he got one back in the day, it wouldn't be a problem to get, I think I got mine out of a cracker jack box.. LOL, back when they were chauffeur licenses. They have really begun to crack down on the CDL's lately, and you could usually avoid issues by not having a Hazmat endorsement. The Hazmat triggers all types of fingerprinting and backround checks. I have had Hazmat ever since I have had my license, and since say 2011 they really began the crackdown, and now they are applying it to every CDL holder. Until he gets his work authorization his CDL is going to expire. Hopefully he can get the authorization before he has to retake all the testing and things they require now to issue one. back in the day anyone could easily get a CDL, not the case now with school requirements and things. Not much you can do but wait for the EAD. It is becoming a nightmare to be a CDL holder now a days, and I have given thought to ditching mine, but it is guaranteed employment just about anywhere. I cannot think of anyway to expidite the process, I would say he could get an offer letter from his current employer, but that would be weird as he is already working. Maybe he could get an offer letter from another company, and use that to expedite his EAD.

Next time buy a refundable ticket is my advice. Airlines love no shows, that's free money.

I don't think she is going to be able to pull off a US passport either just because she married you. I agree you can add her to your insurance, bank accounts, and things like that as a married couple. I also agree you don;t have to get married again in the US, your marriage if legal in Manila, will be legal anywhere else in the world. Why would they even have a CR1 visa if you could just marry a foreign national and get them a passport at the embassy. I wish I would have known this and avoided 4-5 years of K1, AOS, Removing of Conditions, and N400 filings. Would have saved me Thousands of dollars also, I would double check on the US passport thing, and if it's possible, post back and let everyone know. Good news is, you got the hard part done and started the clock on the marriage, that means it will be an easy 2 years before she can enter on her visa( They are taking 18 months or so, and you haven't even filed yet), and she will avoid removing conditions and go straight to 10 year green card. SO you should have no issues entering after your 2 year marriage date. And if it processes faster, suck it up and wait the extra few months to get past the 2 year mark, and she will enter on a IR1 if memory serves instead of a CR1.

You shouldn't have an issue via land as CBP can verify your citizenship status with a copy of the Naturalization certificate. My CBP friend is currently stationed in Calgary,CA and her wife just got citizenship, and they have been traveling between the US and Canada, and even went to Alaska just using the Certificate. You should have no issue, as even she said her wife can't Fly anywhere until she gets her passport because the airlines have no way to verify and allow you to board a flight with the certificate, but any CBP port of entry should be able to verify you are a citizen and let you in. My wife is currently waiting for her passport also as she plans to travel to Thailand later in July. She will have no problem leaving and entering Thailand as she holds dual citizenship now, but getting on the plane to come back without any proof of her status as a US citizen won't fly, so she is waiting for the passport to be safe.

N-400 Online Filing Required Docs
Loren Y replied to GEOntificator's topic in US Citizenship General Discussion
I uploaded 3 years of transcripts with my wifes N400, but she was 3 year rule. Still, save the money and do it yourself, The N400 was the easiest part of the whole process. -
File N400 while I751 is pending
Loren Y replied to Jmeff2324's topic in Removing Conditions on Residency General Discussion
When I did my wifes N400 this past November, they approved The I-751 and had the green card only 19 days after filing N400, so I believe it speeds up the I-751 process in my experience. And only like 4 months after green card arrived, wife did interview, and then took oath a few weeks later. Was a citizen within 5 months of filing N400. -
I would do Emirates or Qatar, I have flown all the airlines mentioned, and these would be my top 2, might not be the cheapest of the 4. I am not a big fan of Turkish airline, but I had no issues, and have only flown them once, but didn't get that welcoming vibe like you definitely get with Emirates. Etihad is pretty good also, but I have only flown them once also, while I have Multiple trips on Emirates and Qatar. As for travel with the extension letter, had no issues with my wife, other than one time in Korea, but I blame that on the gate agent there, were were all checked thru at the beginning of the trip, and then this gate agent got flaky on our layover, but still worked out.

When you come thru the POE, one of the questions the officer will ask is " Have you paid your Green card fee" if you have he will ask to verify the address on file. If they don't ask, make sure you bring it up at POE, that is your only chance to check the address the card will be mailed to if you already paid the fee online. After you enter it will be a real time trying to figure things out. Just make sure you verify at POE.

I had to book my wifes appointment over an hour away at a middle of nowhere post office to get an appointment even 3 weeks out. I scheduled it as soon as she passed the citizenship test, and knew oath would be in 3 weeks. Look in the middle of nowhere for a post office there. Might have to drive 2 to 3 hours out to get it done, but not much choice. Some libraries do it, but they fill up fast. If needed fly to the middle of Iowa, or Ohio, easy to get appointments there. or find a state closer to you that has appointments. There are a few in Montana also that always have appointments. Or you suck it up and pay a few hundred extra at one of the agencies that will do it for you.

Can I return to America?
Loren Y replied to erosfromarg's topic in General Immigration-Related Discussion
Agree with all the others advice, Be polite but firm, remember, they don't have the authority to revoke your status, they can make your life miserable for a few hours, but other than that just stay strong, and know your rights. Prepare for the worst, but you may just roll thru no issues also. Think positive. -
Passed N400 Interview BUT...
Loren Y replied to balba's topic in US Citizenship Case Filing and Progress Reports
You should have his name on some of the paperwork, so you should try to contact him locally directly if possible. As much as I hate USCIS, most of the IO's I encountered were very nice, but there was one, but anyway, You can contact your senators office and have them inquire, but try the polite way first as hard as it is, especially being this close to the end, and then if a reasonable amount of time has passed with no results, I agree with hitting them full bore with a full on lawsuit. You are at 4 weeks, and that is about the right amount of time for something to happen, I think you will see an oath notice in the next week or so. Good luck, and hang in there, you are almost done, and my wife just became a citizen in April, so trust me I understand where your at.
